CIRCULAR

Providing the Lists of potentially unsafe products and goods under the Ministry of Information and Communications’ management

Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Radio Frequencies dated November 23, 2009; the Law on Amending and Supplementing a Number of Articles of the Law on Radio Frequencies dated November 09, 2022;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality; the Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP, detailing the implementation of a number of articles of the Law on Product and Goods Quality;

Pursuant to the Government’s Decree No. 154/2018/ND-CP dated November 09, 2018, on amending, supplementing and repealing certain regulations on investment and business conditions in sectors under management of the Ministry of Science and Technology and certain regulations on specialized inspections;

Pursuant to the Decree No. 13/2022/ND-CP dated January 21, 2022, amending and supplementing a number of articles of Decree No. 132/2008/ND-CP dated December 31, 2008, and Decree No. 74/2018/ND-CP dated May 15, 2018 of the Government, detailing the implementation of a number of articles of the Law on Product and Goods Quality, and Decree No. 86/2012/ND-CP dated October 19, 2012 of the Government, detailing and guiding the implementation of a number of articles of the Law on Measurement;

Pursuant to the Government’s Decree No. 48/2022/ND-CP dated July 26, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Department of Science and Technology,

The Minister of Information and Communications promulgates the Circular providing the Lists of potentially unsafe products and goods under the Ministry of Information and Communications’ management.

 

Article 1. Scope of regulation

1. This Circular provides the Lists of potentially unsafe products and goods under the Ministry of Information and Communications’ management (below referred to as the Lists of category-2 products and goods) and principles for management of category-2 products and goods; a number of cases where products and goods are exempt from regulation conformity certification, regulation conformity declaration; cases of cessation of effect or optional application of part/whole of some technical regulations.

2. This Circular only applies to products and goods with HS codes and descriptions specified in the Lists of category-2 products and goods.

Article 2. Subjects of application

This Decree shall apply to:

1. Organizations and individuals engaged in production and trading of products and goods on the Lists of category-2 products and goods in Vietnam.

2. Organizations and individuals engaged in activities related to quality control of products and goods on the Lists of category-2 products and goods in Vietnam.

Article 3. Lists of category-2 products and goods

The Lists of category-2 products and goods and the measure of management thereof are as follows:

1. The List of specialized information and communication technology products and goods subject to mandatory regulation conformity certification and declaration is provided in Appendix I to this Circular.

2. The List of specialized information and communication technology products and goods subject to mandatory regulation conformity declaration is provided in Appendix II to this Circular.

Article 4. Principles for management of category-2 products and goods

1. The quality control of products and goods on the Lists of category-2 products and goods must comply with the Ministry of Information and Communications’ regulations on certification of regulation conformity, declaration of regulation conformity and quality inspection for specialized information and communication technology products and goods and corresponding technical regulations.

2. Products and goods on the Lists of category-2 products and goods integrated with other products and goods on the Lists of category-2 products and goods shall be subject to certification and declaration of conformity with technical regulations applied to both such products and goods and the integrated products and goods.

3. Products and goods on the Lists of category-2 products and goods that are subject to application of two or more technical regulations shall be subject to regulation conformity certification and declaration according to technical regulations.

4. In case technical regulations issued before the effective date of this Circular have provisions different from those of this Circular, this Circular shall prevail.

5. From the effective date of this Circular, in case new technical regulations are issued to replace the technical regulations specified in the Lists of category-2 products and goods; or in case new technical regulations are issued to additional apply to Lists of category-2 products and goods, the Circular promulgating the new technical regulations shall shall be applied.

Article 5. A number of cases where category-2 products and goods are exempt from regulation conformity certification and declaration

1. Products and goods defined in Section 1, Section 2 of the Appendix II issued together with this Circular that are integrated with short-range radio equipment specified in Section 2 Appendix I or Section 4 Appendix II to this Circular and are not integrated with other radio transmitter, receiver-transmitter shall be exempt from regulation conformity certification and declaration if they meet all of the following requirements:

a) They are imported for use by the importing organizations and individuals;

b) Importation of a maximum of 03 (three) products and goods for each category in the shipment is allowed;

c) Products and goods with frequency bands and specifications satisfying technical and operational conditions defined in Circular No. 08/2021/TT-BTTTT dated October l4, 2021 of the Ministry of Information and Communications, providing the list of radio frequency use license-exempt radio devices and accompanying technical and operational conditions.

2. Products and goods defined in Section 1 and Section 2 of Appendix II issued with this Circular shall be exempted from regulation conformity certification and declaration for technical regulations of QCVN 101:2020/BTTTT, QCVN 132:2022/BTTTT, for the content of technical regulations that requires the testing of sample destruction if all of the following requirements are met:

a) Importation of a maximum of 03 (three) products and goods for each category in the shipment is allowed;

b) The importing organizations or individuals shall commit in written that the products and goods comply with partial or whole technical regulations with the testing of sample destruction and be fully responsible for the safety of the imported products and goods.

3. The exemption from regulation conformity certification and declaration for products and goods specified in Clauses 1 and 2 of this Article shall comply with Point c Clause 2 Article 16 of Circular No. 30/2011/TT-BTTTT dated October 31, 2011, that has been amended and supplemented according to Circular No. 15/2018/TT-BTTTT dated November 15, 2018 and Circular No. 10/2020/TT-BTTTT dated May 7, 2020 of the Minister Ministry of Information and Communications.

Article 6. Cases subject to cessation of the effect of, and cases of part/whole of, some technical regulations not yet compulsorily applied

1. A number of products and goods for which some required technical regulations shall, in part or in whole, cease to be effective or have not yet compulsorily applied until the end of June 30, 2025 are defined in Appendices I and II issued together with this Circular.

2. From the effective date of this Circular until the end of June 30, 2025, the implementation of regulation conformity certification and declaration for products and goods specified in Clause 1 of this Article for all corresponding technical regulations shall be encouraged.

3. From July 1, 2025, in case products and goods specified in Clause 1 of this Article of which regulation conformity certification and declaration are implemented for the period from July 15, 2023 until the end of June 30, 2025 continue to be produced or imported, the performance or additional performance of regulation conformity certification and declaration in accordance with corresponding technical regulations is required.

Article 7. Effect

1. This Circular takes effect on May 15, 2024.

2. Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications, providing the Lists of potentially unsafe products and goods under the Ministry of Information and Communications’ management and of the Circular No. 10/2023/TT-BTTTT dated September 05, 2023 of the Minister of Information and Communications, on ceasing, in part or in whole, the application of a number of technical regulations mentioned in Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications shall cease to be effective from the date the Circular takes effect.

Article 8. Transitional provisions

1. Regulation conformity certificates or notices of receipt of letters of regulation conformity declaration for products and foods defined in Clause 1 Article 6 of this Circular issued from July 15, 2023 to the date before the effective date of this Circular shall remain valid until the time limit stated in such certificates or notices.  

2. Producing and importing organizations and individuals may complete dossiers for regulation conformity declaration and registration of quality inspection of imported goods during the period from January 1, 2024 to the date before the effective date of this Circular in accordance with to provisions for technical regulations in Circular No. 04/2023/TT-BTTTT dated May 31, 2023 and Circular No. 10/2023/TT-BTTTT dated September 5, 2023, or in accordance with provisions for technical regulations in Clause 1, Article 6 of this Circular.

Article 9. Organization of implementation

1. The Chief of the Office, Director of the Department of Science and Technology, heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals shall be responsible for implementing this Circular.

2. Any difficulty and problem arising in the course of application of this Circular should be promptly reported to the Ministry of Information and Communications (the Department of Science and Technology) and its concerned guidance must be complied.

3. The Department of Science and Technology under the Ministry of Information and Communications shall coordinate with the General Department of Customs under the Ministry of Finance in guiding and handling any difficulty arising in determination of HS code of imports being potentially unsafe products and goods subject the scope of application of this Circular./.

- For QCVN 117:2020/BTTTT: Technical requirements in severe/extreme conditions ceases to be effective until June 30, 2024.

- For QCVN 117:2023/BTTTT: Technical requirements in severe/extreme conditions are not yet required until June 30, 2025.

- Terrestrial mobile communication terminal other than mobile phones must use E-UTRA (4G) technology from July 1, 2024. Regulation conformity certificates applicable to terrestrial mobile communication terminal other than mobile phones only integrated W-CDMA FDD (3G), GSM (2G and 2.5G) technologies under QCVN 117:2020/BTTTT shall continue to be applied until the expire date, but not later than June 30, 2024.

- For QCVN 101:2020/BTTTT: only apply to terrestrial mobile phones using removable lithium batteries or having lithium batteries included/installed in the device (as an inseparable part of the device).

(2) When applying QCVN 47:2015/BTTTT, in addition to the requirements specified in QCVN 47:2015/BTTTT, products and goods must comply with Vietnam's radio frequency master plans.

(3) Such products and goods shall be not applicable to explosion-proof communication equipment.

(4) Short-range radio equipment excludes radio receiver-only equipment; wideband data transmission equipment operating in the 2.4 GHz band with an equivalent isotropic radiated power (EIRP) of less than 60 mW; radio access equipment in the 5 GHz band with an equivalent isotropic radiated power (EIRP) of less than 60 mW. Certification and declaration of conformity shall only be carried out when the equipment is suitable in terms of frequency bands and technical and operational conditions as prescribed in the Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of Information and Communications.

Certification and declaration of conformity for wideband data transmission equipment, radio access equipment operating in one or several of frequency bands with support of 6 GHz band (between 5.925 GHz and 7.125 GHz) (hereinafter referred to as Wi-Fi 6E, Wi-Fi 7 equipment) shall only be carried out provided that the manufacturer of the Wi-Fi 6E, Wi-Fi 7 equipment commits in writing that the 6 GHz band is disabled and users cannot activate and use such band without the manufacturer's support.

Certification and declaration of conformity for equipment integrated with functions of Wi-Fi 6E, Wi-Fi 7 equipment shall only be carried out provided that the manufacturer of the equipment integrated with functions of Wi-Fi 6E, Wi-Fi 7 equipment commits in writing that the 6 GHz band is disabled and users cannot activate and use such band without the manufacturer's support.

(5) Certification and declaration of conformity shall only be carried out when the equipment is suitable in terms of frequency bands and technical and operational conditions as prescribed in the Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of Information and Communications providing the list of radio frequency use license-exempt radio devices and accompanying technical and operational conditions.

(6) Organizations and enterprises that manufacture, import, distribute and use base station equipment and mobile communication repeaters shall commit to strictly comply with the law on management and use of radio frequencies.

(7) With respect to QCVN 117:2023/BTTTT: The requirements for Total Radiated Sensitivity of the Receiver (TRS) in Article 2.2.12 and Total Radiated Power (TRP) in Article 2.2.13 of the technical regulations shall not been yet applied.

(8) With respect to QCVN 101:2020/BTTTT: Only the declaration of conformity with requirements on safety characteristics specified in article 2.6 of the regulation is required.

(9) With respect to QCVN 65:2021/BTTTT: Not apply formula (1) in Article 2.1.2 of QCVN 65:2021/BTTTT.

(10) With respect to QCVN 128:2021/BTTTT: Requirements for 5G base station performance defined in Article 2.4 shall not been yet applied. In case of applying QCVN 128:2021/BTTTT, devices supporting n77 and n78 bands must apply the requirements in Appendix D of QCVN 128:2021/BTTTT, except for the requirement of limit spurious emissions in section D.4 of QCVN 128:2021/BTTTT.

(12) It is not allowed to use measurement/test results of domestic or foreign testing laboratories that have not been designated or recognized, or measurement/test results of the manufacturer to evaluate conformity to this technical regulation.

(13) With respect to QCVN 132:2022/BTTTT: In case products and goods use adapters, if they are included, test QCVN 132:2022/BTTT for products and goods with adapters; If not, test QCVN 132:2022/BTTTT for products and goods without adapters.

(14) With respect to QCVN 53:2017/BTTTT: Requirements for antenna defined in Article 2.3 of the technical regulations shall not been yet applied.

(15) Requirements for electromagnetic compatibility defined in this technical regulations shall not be applied.
