DIRECTIVE
On promoting the reform of administrative procedures for issuance of judicial record cards to create convenience for people and enterprises
___________
In implementation of the Law on Judicial Records and regulations of specialized laws, in recent times, the issuance of judicial record cards and exploitation of judicial record information has been in order and has had many positive movements, basically meeting the requirements of agencies, organizations, competent persons as well as people and enterprises.
However, many administrative procedures still require judicial record cards1; some organizations, enterprises, and individuals still abuse the requirement to provide judicial record cards as a basis for recruitment, management, and employment; some provinces and cities have not proactively resolved to promptly respond to the recent spike in receiving applications for judicial record cards, leading to delays and congestion, leading to pressing concerns in the society.
The main reasons for the above shortcomings, limitations include: (1) The awareness of some agencies, organizations, enterprises and individuals on the judicial record cards and the law on judicial records is incomplete; (2) The State agencies, political organizations, and socio-political organizations have not proactively exercised the right to request the issuance of judicial record cards in accordance with the Law on Judicial Records, but mainly request the submission of judicial record cards from officials, civil servants, public employees, and people; have not proactively reviewed legal regulations that require the submission of judicial record cards in administrative procedures to make reasonable simplification; (3) The application of information technology is still limited, the information system for handling administrative procedures in some localities has not yet met the requirements for implementing online issuance of judicial record cards; (4) The human resources, equipment, physical foundations and work organization in some localities have not met the requirements due to the increased request for issuance of judicial record cards.
To promptly rectify and overcome the above shortcomings, limitations, and causes, strengthen administrative procedure reform in receiving and resolving requests for issuance of judicial record cards to facilitate and reduce time and social costs for people, the Prime Minister requests the following contents:
1. The Ministers, the Heads of ministerial-level agencies, Government-attached agencies, and the Chairpersons of People's Committees of provinces and centrally-run cities thoroughly grasp and comply with the right to request the issuance of judicial record cards in accordance with Clause 3, Article 7 of the Law on Judicial Records; take effective solutions and move towards terminating requests for the people to submit judicial record cards in contravention of law. In particular, focus on directing the effective implementation of the following tasks:
a) Strengthen propaganda, raise awareness and responsibility to comply with Clauses 2 and 3, Article 7 of the Law on Judicial Records on the right to request issuance of judicial record cards, in order to limit the requirement for people to submit judicial record cards to serve the management and handling of administrative procedures under their management sector and field; take measures to correct the abuse of the requirement to submit judicial record cards by organizations and enterprises under their management; ensure confidentiality of judicial record information as prescribed.
b) Review, amend and supplement according to authority, or propose and report to competent authorities to consider and amend regulations and administrative procedures related to judicial record cards under their management sector or field to simplify unreasonable requirements for submitting judicial record cards in carrying out administrative procedures; the State agencies proactively exercise the right to request the issuance of judicial record cards in accordance with Clauses 2 and 3, Article 7 of the Law on Judicial Records, without requiring officials, civil servants, public employees and people to submit judicial record cards; have appropriate and effective solutions to prevent the difficulties and incurring costs of requests to submit judicial record cards; promptly detect and prevent requests to provide judicial record cards in contravention of law, causing difficulties and incurring costs for people; report to the Prime Minister a plan to simplify these regulations and procedures in August 2023 (Appendix: List of administrative procedures with request to attach judicial record card).
c) Upgrade the information system for handling administrative procedures at the ministerial and provincial levels to satisfy the requirements of connection, sharing, digitization and reuse in accordance with the Government's requirements in the Decree No. 107/2021/ND-CP dated December 6, 2021 and direction of the Prime Minister in the Document No. 452/TTg-KSTT dated May 23, 2023; pay attention to the arrangement of human resources and working conditions to meet the requirements of judicial record work, ensuring compliance with current laws, in accordance with the requirements and practical conditions of ministries, agencies and localities.
2. The Ministry of Justice shall assume the prime responsibility for and coordinate with the Ministry of Public Security and relevant agencies in performing the following tasks:
a) Authorize the provincial-level Justice Departments to exploit and search the judicial record database at the National Center for Judicial Records to serve the issuance of judicial record cards in order to increase proactiveness, accountability, and reduce implementation time and costs.
b) Advise the Government to report to the National Assembly to pilot decentralization of the issuance of judicial record cards to the Justice Divisions under the district-level People's Committees in Hanoi city and Nghe An province, and submit to the Government as soon as possible.
c) Promote digitization and completion of the judicial record database, connect and share data to serve the issuance of judicial record cards and handle administrative procedures for the people.
d) Urgently review and propose to reduce the charges for providing judicial record information to encourage the implementation of online public services and send it to the Ministry of Finance under the direction of the Prime Minister in the Document No. 3561/VPCP-KSTT dated May 18, 2023 of the Government Office.
dd) Coordinate with the Ministry of Public Security in researching and developing solutions to pilot the issuance of judicial record cards on the VNeID application as required in the Resolution No. 74/NQ-CP dated May 7, 2023 of the Government.
3. The Ministry of Public Security shall assume the prime responsibility for and coordinate with relevant agencies and localities in performing the following tasks:
a) Assume the prime responsibility for and coordinate with the Ministry of Justice, the Ministry of National Defence, the Supreme People's Court, the Supreme People's Procuracy and the relevant agencies in connecting and sharing the National Population Database with the judicial record database, the database of civil judgment enforcement agencies, the database managed by the Public Security sector, the database of the Ministry of National Defence, the Supreme People's Court, the Supreme People's Procuracy to serve to issue judicial record cards and handle administrative procedures according to the law.
b) Coordinate with the Ministry of Justice, the Ministry of Information and Communications, and the People's Committee of Thua Thien Hue province in researching and developing solutions to pilot the issuance of judicial record cards on the VNeID application according to the Resolution No. 74/NQ-CP dated May 7, 2023 of the Government. On such basis, make a preliminary review and report to the competent authorities on nationwide implementation thereof.
4. It is recommended that political organizations, socio-political organizations, and associations thoroughly grasp and deploy the implementation of this Directive to their members to limit abuse of the request to provide judicial record cards.
5. The Ministry of Information and Communications shall assume the prime responsibility for and coordinate with the news and press agencies in propagating regulations on issuance of judicial record cards so that the organizations and enterprises can understand and implement them correctly, limiting the abuse of asking the people to provide judicial record cards; directing enterprises to provide public postal services to coordinate closely with agencies issuing judicial record cards to provide at-home services of receiving and returning results of processing dossiers for issuance of judicial record cards upon the people’s needs.
6. The Ministers, the Heads of ministerial-level agencies, the Government-attached agencies, the Chairpersons of the People's Committees of provinces and centrally-run cities shall organize the implementation and direct agencies, organizations and units under their management to strictly implement this Directive. Quarterly report to the Prime Minister on the situation and results of implementation in the report on administrative procedure control of the ministries, sectors and localities.
The Government Office assists the Prime Minister in urging ministries, sectors and localities to implement this Directive./.
