SUMMARY

Grant number plates according to the vehicle owners’ ID numbers from August 15

On July 01, 2023, the Ministry of Public Security issues Circular No. 24/2023/TT-BCA prescribing the grant and revocation of registration certificates and number plates of motor vehicles. To be specific:

1. Number plates shall be granted and managed using ID numbers of the respective vehicle owners from August 15, 2023:

- For Vietnamese individual vehicle owners, the number plates shall be managed using their personal identification numbers.

- For foreign individual vehicle owners, the number plates shall be managed using their foreigner identification numbers generated by the electronic identification and authentication system, or the numbers of their permanent/temporary residence cards, or other identification numbers granted by competent authorities.

- For organizational vehicle owners, the number plates shall be managed using electronic identification numbers of the respective organizations generated by the electronic identification and authentication system. In the case where the organizations do not have electronic identification numbers, the plates shall be managed according to the respective tax ID numbers or establishment decisions.

2. In the case where the vehicles have expired durations, are damaged or have the titles transferred, the identification number plates of their owners shall be revoked and re-granted by the vehicle registration agencies when such owners register for other vehicles under their vehicle titles.

3. In the case where a vehicle owner relocates from a province/centrally-run city to another province/centrally-run city, he/she/it may keep that identification number plate (the number plate remains unchanged).

4. Time limit for grant of number plates:

- Grant of number plates for the first time: Right after receipt of valid vehicle registration dossiers.

- Renewal and re-grant of number plates, grant of number plates sold at auction, and re-grant of identification number plates: No later than 07 working days from the date on which the complete and valid dossiers are received.

This Circular takes effect on August 15, 2023.

CIRCULAR

On grant and revocation of registration certificates and license plates of motor vehicles[1]

 

Pursuant to the November 24, 2015 Civil Code;

Pursuant to the November 13, 2008 Law on Road Traffic;

Pursuant to the November 20, 2018 Law Amending and Supplementing a Number of Articles of Thirty-Seven Laws Related to Planning;

Pursuant to the National Assembly’s Resolution No. 73/2022/QH15 of November 15, 2022, on pilot auction of automobile license plates;

Pursuant to the Government’s Decree No. 39/2023/ND-CP of June 26, 2023, detailing a number of articles of the National Assembly’s Resolution No. 73/2022/QH15 of November 15, 2022, on pilot auction of automobile license plates;

Pursuant to the Government’s Decree No. 01/2018/ND-CP of August 6, 2018, defining the functions, tasks, powers and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Department;

The Minister of Public Security promulgates the Circular on grant and revocation of registration certificates and license plates of motor vehicles.

 

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Circular specifies dossiers and procedures for grant and revocation of registration certificates and license plates of motor vehicles provided in the Law on Road Traffic, including: first-time vehicle registration; registration of vehicle title transfer and vehicle movement; renewal of vehicle registration certificates and license plates; re-grant of vehicle registration certificates and license plates; temporary vehicle registration; revocation of vehicle registration certificates and license plates; registration and grant of auction-winning vehicle license plates (below referred to as vehicle registration); guides the settlement of a number of specific cases; and provides forms and validity duration of vehicle registration certificates, identification of manufacture year of vehicles and vehicle number plates.

Article 2. Subjects of application

1. This Circular applies to:

a/ Officers and non-commissioned officers of the People’s Public Security Forces who perform the duty of vehicle registration (below referred to as vehicle registry officers);

b/ Vehicle registry offices;

c/ Public security agencies of units and localities;

d/ Organizations and individuals involved in vehicle registration.

2. This Circular does not apply to the registration of motor vehicles of the Army for use for national defense purposes.

Article 3. Vehicle registration principles

1. A motor vehicle that is of lawful origin and up to technical safety and environmental protection standards may be registered and granted a license plate set under this Circular.

2. Vehicle owners that are organizations or individuals shall register their vehicles at vehicle registry offices of localities where their head offices or places of residence (places of permanent residence or temporary residence) are located, except the case specified in Clause 14, Article 3 of this Circular.

3. Vehicle license plates shall be granted and managed based on identification numbers of vehicle owners (below referred to as ID-based license plates). ID-based license plates are license plates that have signs, alphanumeric series, font size of letters and digits, and colors comply with this Circular.

4. For vehicle owners being Vietnamese citizens, vehicle license plates shall be managed according to their personal identification numbers.

5. For vehicle owners being foreigners, vehicle license plates shall be managed according to their personal identification numbers created by the e-identification and authentication system or serial numbers of their permanent residence cards, temporary residence cards or other identity cards granted by competent agencies.

6. For vehicle owners being organizations, vehicle license plates shall be managed according to their e-identification numbers created by the e-identification and authentication system. For organizations that have no e-identification numbers, their vehicle license plates shall be managed according to their tax identification numbers or establishment decisions.

7. For vehicles with expired use duration, damaged vehicles or vehicles subject to title transfer, vehicle registry offices shall revoke their owners’ ID-based license plates and re-grant such license plates to the vehicle owners when they register other vehicles under their ownership. An ID-based license plate number shall be retained for its vehicle owner for 5 years from the date of revocation. Past that time limit, if the vehicle owner has yet to register a new vehicle, such license plate shall be transferred into the license plate store for registration and grant to another organization or individual under regulations.

8. A vehicle owner that relocates its/his/her head office or place of residence from a province or centrally run city to another may retain its/his/her ID-based license plate (change of the vehicle number plate is not required).

9. Individuals who are aged full 15 years or older may register vehicles. In case an individual aged between full 15 years and under 18 years wishes to register a vehicle, he/she must obtain the consent of his/her parent or guardian who shall sign and write the word “consent”, his/her full name and relation with the guardianee in the vehicle registration declaration form.

10. The vehicle registration declaration shall be made on the National Public Service Portal or the Ministry of Public Security’s Public Service Portal (below referred to as the public service portal). Vehicle owners shall use the dossier codes already declared on the public service portal for carrying out procedures for vehicle registration. In case it is impossible to make vehicle registration declaration on the public service portal due to lack of e-data or a technical error, vehicle owners shall carry out declaration procedures directly at vehicle registry offices.

11. The payment of the vehicle registration fee shall be made via banks or payment intermediaries that are connected or integrated and provide online payment services on the public service portal. In case it is impossible to make payment on the public service portal, vehicle owners shall pay the fee at vehicle registry offices.

12. Vehicle registration results shall be received on the public service portal or via public-utility postal services (in case of provision of fully online public services) or at vehicle registry offices as vehicle owners so wish.

13. E-data on papers and documents in vehicle dossiers received by the vehicle registration and management system from the public service portal or databases of ministries and sectors or e-date scanned from documents in vehicle dossiers, engine and chassis number stencil imprints, administrative procedure settlement result slips converted from paper documents and bearing digital signatures of vehicle registry officers and seals of vehicle registry offices (below referred to as dossier digitalization) are legally valid as paper documents.

14. Organizations and individuals that win the auction of automobile license plates may choose to register and be granted auction-winning automobile license plates at Traffic Police Divisions, Road and Railway Traffic Police Divisions or Road Traffic Police Divisions of provincial-level Public Security Departments (below referred to as Traffic Police Divisions) of localities where vehicle owners are headquartered or reside, or at Traffic Police Divisions managing such auction-winning automobile license plates.

15. Organizations and individuals that have violated traffic order and safety regulations but fail to execute decisions on sanctioning of administrative violations in the traffic field will be ineligible for vehicle registration. After completely executing decisions on sanctioning of administrative violations in the traffic field, they may make vehicle registration in accordance with this Circular.

Article 4. Vehicle registry offices

1. The Traffic Police Department shall carry out registration for vehicles of the Ministry of Public Security; automobiles of the agencies and organizations specified in Appendix 1 to this Circular; automobiles of diplomatic missions and representative offices of international organizations in Vietnam, and automobiles of foreigners working in such missions or offices.

2. Traffic Police Divisions shall carry out registration for the following vehicles (except the vehicles specified in Clause 1 of this Article):

a/ Automobiles, tractors, trailers, semi-trailers, and vehicles of similar structure (below referred to as automobiles) of organizations and individuals that have their head offices located or places of residence in urban districts and cities of centrally run cities; cities, rural districts or towns of provinces where Traffic Police Divisions are located;

 b/ Automobiles registered with auction-winning license plates; vehicles confiscated in accordance with law and motorcycles of a cylinder capacity of 175 cm3 or more of local organizations and individuals for which registration is carried out for the first time;

c/ Automobiles; motorcycles, motorbikes (including also electric motorbikes) and vehicles of similar structure (below referred to as motorcycles) of foreign organizations and individuals, including also consular offices based in localities.

3. Public security agencies of urban districts, rural districts, towns or cities of provinces or centrally run cities (below referred to as district-level public security agencies) shall carry out registration for automobiles and motorcycles of domestic organizations and individuals that have their head offices located or places of residence in their localities (except the vehicles specified in Clauses 1, 2 and 4 of this Article).

4. Public security agencies of communes, wards or townships (below collectively referred to as commune-level public security agencies) shall carry out vehicle registration (except the cases specified in Clauses 1 and 2 of this Article) as follows:

a/ Commune-level public security agencies of rural districts and towns of centrally run cities shall carry out registration for motorcycles of domestic organizations and individuals that have their head offices located or places of residence in their localities;

b/ Commune-level public security agencies of rural districts, towns and cities of provinces (except commune-level public security agencies in localities where Traffic Police Divisions of public security agencies of such rural districts, towns or cities are located) where there are at least 150 vehicles are registered for the first time every year (the average number for the latest 3 years) shall carry out registration for motorcycles of domestic organizations and individuals that have their head offices located or places of residence in their localities.

5. For special geographical areas, based on the actual number of registered vehicles, local characteristics and geographical distances, directors of provincial-level Public Security Departments shall reach agreement with the Traffic Police Department shall decide to organize the vehicle registration as follows:

a/ For commune-level localities each having less than 150 motorcycles subject to new registration every year, to assign commune-level public security agencies of that localities to carry out vehicle registration or assign public security agencies of districts, towns or cities or commune-level public security agencies that have been empowered to carry out vehicle registration to organize the cluster-based vehicle registration;

b/ For commune-level localities each having a number of to-be-registered vehicles exceeding the handling capacity of the commune-level public security agencies, in addition to assigning such public security agencies to carry out the vehicle registration, public security agencies of districts, towns or cities or public security agencies of adjacent communes that have been empowered to carry out vehicle registration may be assigned to carry out cluster-based vehicle registration for domestic organizations and individuals that have their head offices located or places of residence in their localities.

6. Vehicle registry offices shall ensure physical foundations and arrange convenient places for receipt and settlement of vehicle registration dossiers and procedures and prioritize the receipt and settlement of vehicle registration procedures on the public service portal. Places for vehicle registration must have instructional diagrams, citizen reception schedules and title/post signs of vehicle registry officers, seats, vehicle parking lots and feedback boxes, and publicly post up regulations on vehicle registration procedures and fee, acts of violation and sanctions to be imposed for violations.

Article 5. Responsibilities of vehicle registry offices and officers

1. To receive and examine vehicle registration dossiers, carry out physical inspection of vehicles, make engine and chassis number stencil imprints, and digitalize and upload vehicle dossiers to the vehicle registration and management system.

2. To receive vehicle dossiers and e-data thereon for vehicle registration, if such dossiers and e-data are properly made under regulations. In case such dossiers and e-data are not properly made, to provide specific and adequate instructions in the dossier instruction sheets and take responsibility for their instructions.

3. In the course of registration, vehicle registry officers shall strictly observe consuetudinaries of the People’s Public Security forces, properly behave to and respect the People; and comply with this Circular and other relevant regulations on vehicle registration. It is strictly prohibited to additionally specify vehicle registration procedures in contravention of this Circular.

Article 6. Responsibilities of vehicle owners   

1. To abide by regulations on vehicle registration; to carry out vehicle registration procedures on the public service portal, and truthfully, adequately and accurately provide and declare required information on vehicle registration; to take responsibility before law for legality of vehicles and vehicle dossiers; to strictly refrain from committing acts of forging dossiers or illegally interfering in the public service portal and the vehicle registration and management system in order to change electronic information and data or original vehicle engine and chassis numbers for the purpose of vehicle registration.

2. To take their vehicles to the vehicle registry offices specified in Article 4 of this Circular for checking, for vehicles subject to first-time registration, title transfer registration or vehicle movement registration, converted vehicles or vehicles with changed paint colors. In case of vehicle registration certificates or license plates are faded, damaged or lost, vehicle owners shall make declaration thereof and carry out procedures for renewal or re-grant of the vehicle registration certificates or license plates (below referred to as renewal or re-grant) under regulations.

3. Within 30 days after being granted by a competent agency a technical safety and environmental protection certificate for a converted vehicle or a vehicle with changed information on the vehicle owner’s name or address of its/his/her head office or place of residence relocated to another province or centrally run city or upon the expiration of the validity duration of the vehicle registration certificate, the vehicle owner shall come to the vehicle registry office to carry out procedures for renewal or revocation of the vehicle registration certificate and license plate (below referred to as revocation procedures) under regulations.

4. Upon the sale, donation, giving as a gift, leaving as an inheritance, exchange, contribution as capital, allocation or transfer of a vehicle (below referred to as vehicle title transfer):

a/ The vehicle owner shall retain the vehicle registration certificate and license plate (not hand them over to the vehicle title transferee) and submit them to the vehicle registry office for carrying out revocation procedures. In case of transfer of vehicle title together with the auction-winning vehicle license plate, the vehicle owner shall submit the vehicle registration certificate to the vehicle registry office for carrying out revocation procedures.

b/ Within 30 days after making a document on vehicle title transfer, the vehicle owner shall carry out revocation procedures. Past that time limit, if the vehicle owner fails to carry out revocation procedures or hand over the vehicle registration certificate and license plate to the vehicle title transferee for carrying out revocation procedures, the vehicle registry office shall, before settling the revocation, issue a sanctioning decision for the vehicle owner’s act of failure to carry out revocation procedures under regulations.

In case the vehicle owner fails to carry out revocation procedures after transferring the title of its/his/her vehicle, it/he/she shall be held responsible before law for violations related to such vehicle.

c/ After the vehicle owner carries out revocation procedures, the vehicle title transferee shall carry out procedures for vehicle title transfer registration under regulations.

5. Within 7 days after the use duration of a vehicle expires or a vehicle is irreparably damaged or destroyed due to an external reason, the vehicle owner shall make declaration on the public service portal and submit the vehicle registration certificate and license plate to the vehicle registry office or commune-level public security agency (regardless of the vehicle owner’s place of residence) for carrying out revocation procedures.

Article 7. Time limits for settlement of vehicle registration procedures

1. The time limit for grant of a vehicle registration certificate is 2 working days from the date of receipt of a valid and complete dossier, except the case of re-grant of a vehicle registration certificate which requires verification under Clause 2 of this Article.

2. The time limit for verification of loss of a vehicle registration certificate upon the settlement of procedures for re-grant of such vehicle registration certificate is 30 days. The time limit for verification shall not be counted into the time limit for re-grant of such vehicle registration certificate specified in Clause 1 of this Article.

3. First-time grant of ID-based license plate: upon the receipt of a valid vehicle registration dossier.

4. The time limit for renewal or re-grant of a vehicle license plate, grant of an auction-winning vehicle license plate, or re-grant of an ID-based license plate is 7 working days after the receipt of a valid dossier.

5. For grant of a temporary vehicle registration certificate or vehicle registration and license plate revocation certificate:

a/ In case of providing fully online public services on the public service portal: After a vehicle owner carrying out procedures fills in the temporary vehicle registration declaration form or vehicle registration and license plate revocation declaration form and pays a fee under regulations (for cases of temporary vehicle registration) and the vehicle registry office checks and ensures the dossier’s validity, the administrative procedure settlement result shall be notified within 8 working hours after the dossier is received from the public service portal;

b/ In case of providing partially online public services: The time limit is 1 working day (for temporary vehicle registration) or 2 working days from the date of receipt of a valid and complete dossier (for grant of a vehicle registration and license plate revocation certificate).

6. The time limits for notification of vehicle registration results under Clauses 1, 3, 4 and 5 of this Article shall be counted from the date a valid and complete dossier is received and the vehicle registration and management system receives results of the certification of the full payment of the vehicle registration fee from the public service portal.

 

Chapter II

VEHICLE REGISTRATION DOSSIERS AND PROCEDURES

Section 1

FIRST-TIME VEHICLE REGISTRATION

Article 8. First-time vehicle registration dossiers

A first-time vehicle registration dossier must comprise:

1. Vehicle registration declaration form.

2. Documents of the vehicle owner.

3. Vehicle documents.   

Article 9. Vehicle registration declaration forms

1. A vehicle owner shall log in the public service portal and fully fill in all fields of the vehicle registration declaration form as required and affix its/his/her digital signature or sign and write his/her full name or append its seal (for agencies and organizations). 

2. After successfully making the declaration, a vehicle owner shall receive an online vehicle registration dossier code and an appointment for dossier processing sent by the public service portal via the text message or email for carrying out vehicle registration procedures; and then provide the vehicle registration dossier code to the vehicle registry office for carrying out the vehicle registration procedures under regulations. In case it is impossible to make vehicle registration on the public service portal, the vehicle owner shall fill in the vehicle registration declaration form directly at the vehicle registry office.

Article 10. Documents of vehicle owners

1. Vehicle owners being Vietnamese individuals shall use level-2 e-identification accounts for carrying out vehicle registration procedures on the public service portal or produce their citizen identity cards or passports.

Armed forces personnel shall produce their People’s Public Security or People’s Army identity cards or certifications issued by heads of their agencies or units at the regiment, division or level equivalent to district-level public security agencies or higher level (for those not yet granted armed forces identity cards).

2. For vehicle owners being foreigners

a/ Vehicle owners who are members of foreign diplomatic missions or consulates or representative offices of international organizations in Vietnam shall produce diplomat identity cards, official-duty identity cards, consul identity cards, honorable consul identity cards, (ordinary) citizen identity cards which remain valid and submit letters of introduction issued by the Directorate of State Protocol or provincial-level Foreign Affairs Bureaus;

b/ Vehicle owners who are foreigners residing and working in Vietnam (except persons specified at Point a of this Clause) shall produce permanent residence cards or temporary residence cards which remain valid for residence in Vietnam for at least 6 months.

3. For vehicle owners being organizations

a/ Vehicle owners being organizations (except those specified at Point b, Clause 3 of this Article) shall use level-2 e-identification accounts to carry out vehicle registration procedures on the public service portal. Organizations that have not yet been granted level-2 e-identification accounts shall produce notices of their tax identification numbers or their establishment decisions.

For vehicles of military enterprises, a letter of introduction issued by the Ministry of National Defense’s General Department of Technology’s Vehicle and Machinery Department is additionally required;

For vehicles used for automobile transport business operation, a copy of the automobile transport business license granted by the provincial-level Transport Department enclosed with the original license for collation is additionally required. For vehicles of other organizations and individuals, a vehicle rent contract or business cooperation contract or service contract is additionally required.

b/ Vehicle owners being foreign diplomatic missions or consulates or representative offices of international organizations in Vietnam shall use level-2 e-identification accounts to carry out vehicle registration procedures on the public service portal. Organizations that have not yet been granted level-2 e-identification accounts shall produce notices of their tax identification numbers and submit letters of introduction issued by the Directorate of State Protocol or provincial-level Foreign Affairs Bureaus;

c/ Persons introduced by agencies and organizations to carry out procedures shall submit documents of vehicle owners as specified and produce their personal identification papers under Clauses 1 and 2 of this Article.

4. Persons authorized to complete vehicle registration procedures shall, in addition to documents of vehicle owners specified in Clauses 1, 2 and 3 of this Article, produce their personal identification papers and submit letters of authorization which are notarized or authenticated under regulations.

Article 11. Vehicle documents

1. Proofs of origin:

a/ For imported vehicles:

E-data on information of imported vehicles received by the vehicle registration and management system from the public service portal or the customs offices’ databases;

For vehicles having no e-customs data and vehicles imported before December 1, 2020, proofs of origin include declaration form of origin of imported automobile or motorbike under regulations (for vehicles imported under commercial contracts), paper of temporary import of vehicle under regulations (for vehicles imported under the regime of temporary import for re-export by subjects entitled to diplomatic privileges and immunities as specified by law or treaties to which Vietnam is a contracting party);

b/ For domestically manufactured or assembled vehicles

E-data on ex-works quality inspection sheets received by the vehicle registration and management system from the public service portal or the vehicle inspection agency’s database;

In case e-data on ex-works quality inspection sheets are not available, proofs of origin of manufactured or assembled vehicles are ex-works quality inspection sheets for road motor vehicles under regulations (paper documents);

c/ For vehicles confiscated under regulations

Original decisions on vehicle confiscation or decisions on establishment of all-people ownership over confiscated vehicles under regulations or court judgments’ excerpts on the vehicle confiscation (below referred to as confiscation decisions) issued for each vehicle, fully stating basic characteristics of the vehicle; brand, model code, type, engine number, chassis number and cylinder capacity; the vehicle must be completely built with engine and chassis parts having the same technical parameters.

Sale invoices of public assets, state assets or confiscated assets as specified by law.

2. Documents on vehicle title transfer, which may be one of the following documents:

a/ E-invoice data received by the vehicle registration and management system from the public service portal or the tax administration agency’s database. In case e-invoice data are not available, paper invoices or invoices converted from e-invoices under regulations are required;

b/ Decision of a competent agency or document on vehicle sale, donation or giving as gifts or inheritance, and the vehicle’s financial documents as specified by law. Documents on vehicle sale, donation or giving as gifts or inheritance of individuals must be notarized, authenticated or certified by agencies, organizations or units where the concerned individuals are working (for armed forces personnel and foreigners working in diplomatic missions, consulates or representative offices of international organizations who make vehicle registration according to addresses of their agencies, organizations or units);

c/ For vehicles liquidated by Public Security agencies: A competent authority’s decision on vehicle liquidation and a sale invoice of public assets or state assets;

d/ For vehicles liquidated by the Army: Official letter of the Ministry of National Defense’s General Department of Technology’s Vehicle and Machinery Department certifying that the vehicle is no longer a military equipment, and an invoice under regulations.

3. Vehicle registration fee receipts:

E-data on registration fee received by the vehicle registration and management system from the public service portal or the tax administration agency’s database;

In case e-data on registration fee are not available, papers on fee remittance into the state budget or other registration fee payment documents as specified by law are required. For vehicles exempt from registration fee, notices of registration fee payment of the tax administration agency containing registration fee exemption information are required.

Article 12. Procedures for first-time vehicle registration

1. An organization or individual that registers its/his/her vehicle shall comply with Article 9 of this Circular; and take the vehicle to a vehicle registry office and submit the papers specified in Articles 10 and 11 of this Circular.

2. After a vehicle registry officer checks the vehicle dossier and the actual vehicle conditions and ensures that the dossier is valid and the vehicle conforms to regulations, a vehicle license plate shall be granted as follows:

a/ In case the vehicle owner has not yet been granted an ID-based license plate or has been granted an ID-based license plate but registered such plate for another vehicle, it/he/she shall be granted new license plate;

b/ In case the vehicle owner’s ID-based license plate has been revoked, it shall be re-granted.

In case the vehicle or vehicle dossier does not meet the prescribed requirements, the vehicle owner shall supplement and complete the dossier as instructed by the vehicle registry officer in the dossier instruction sheet.

3. The vehicle owner shall receive an appointment for notification of results, pay vehicle registration fee and receive the vehicle license plate (in case of grant of vehicle license plate under Point a, Clause 2 of this Article). If the vehicle owner wishes to receive vehicle registration results via public-utility postal services, it/he/she shall register such with public-utility postal service providers.

4. The vehicle owners shall receive the vehicle registration certificate and license plate (in case of grant of vehicle number plates under Point b, Clause 2 of this Article) at the vehicle registry office or from public-utility postal service providers.    

Section 2

REGISTRATION OF VEHICLE TITLE TRANSFER AND VEHICLE MOVEMENT

Article 13. Cases of registration of vehicle title transfer and vehicle movement

1. When transfer title of their vehicles or relocate their offices or places of residence from certain provinces or centrally run cities to others (below referred to as movement of vehicles as personal belongings), vehicle owners shall carry out procedures for vehicle registration and license plate revocation at the offices currently managing dossiers of such vehicles.

2. Vehicle title transferees and vehicle owners (for cases of movement of vehicles as personal belongings) shall carry out procedures for registration of vehicle title transfer or vehicle movement at vehicle registry offices under Article 4 of this Circular.

Article 14. Dossiers of registration for vehicle title transfer or vehicle movement

1. A vehicle registration and license plate revocation dossier must comprise:

a/ Declaration form for vehicle registration and license plate revocation;

b/ Documents of the vehicle owner specified in Article 10 of this Circular;

c/ Two vehicle engine and chassis number stencil imprints;

d/ Vehicle registration certificate;

dd/ Vehicle number plate;

In cases of movement of vehicles as personal belongings, vehicle owners are not required to return vehicle license plates, except vehicles with 3-digit or 4-digit license plates which must be returned;

In cases of loss of vehicle registration certificates or vehicle number plates, reasons for such loss must be clearly stated in declaration forms for vehicle registration and license plate revocation;

e/ A copy of the document on vehicle title transfer specified in Clause 2, Article 11 of this Circular (except cases of movement of vehicles as personal belongings).

2. A dossier for registration of vehicle title transfer or vehicle movement must comprise:

a/ Declaration form for vehicle registration;

b/ Documents of the vehicle owner as specified in Article 10 of this Circular;

c/ Document on vehicle title transfer specified in Clause 2, Article 11 of this Circular (except cases of movement of vehicles as personal belongings);

d/ Registration fee receipt as specified in Clause 3, Article 11 of this Circular;

dd/ Vehicle registration and number plate revocation certificate.

Article 15. Procedures for registration of vehicle title transfer and vehicle movement  

1. Procedures for vehicle registration and license plate revocation

a/ A vehicle owner shall fill in a declaration form for vehicle registration and license plate revocation on the public service portal; provide the online vehicle registration dossier code; submit a revocation dossier as specified in  Clause 1, Article 14 of this Circular and receive a written appointment for notification of the vehicle registration result under regulations;

b/ After checking and ensuring validity of the vehicle dossier, the vehicle registry office shall grant a vehicle registration and number plate revocation certificate under regulations (stapled and “fan-stamped” together with the vehicle engine and chassis number imprints by the vehicle registry office): 1 copy thereof shall be handed over to the vehicle owner and 1 copy shall be kept in the vehicle dossier. In case of loss of the vehicle registration certificate, verification is required under regulations.

2. Procedures for registration of vehicle title transfer and movement of vehicles as personal belongings

a/ A vehicle title transferee or vehicle owner (for cases of movement of vehicles as personal belongings) shall fill in the vehicle registration declaration form specified in Article 9 of this Circular; and take the vehicle to the vehicle registry office for checking, provide the online vehicle registration dossier code, and submit the dossier specified in Clause 2, Article 14 of this Circular;

b/ After the vehicle dossier and the vehicle’s actual conditions are checked and deemed valid, the vehicle title transferee or vehicle owner shall be granted a vehicle license plate by the vehicle registry office under Clause 2, Article 12 of this Circular;

c/ The vehicle title transferee or vehicle owner shall receive a written appointment for notification of the vehicle registration result, pay vehicle registration fee and receive the vehicle license plate (in case of grant of vehicle license plates under Point a, Clause 2, Article 12 of this Circular). In case the vehicle owner wishes to receive the vehicle registration result via public-utility postal services, it/he/she shall register so with the public-utility postal service provider;

d/ The vehicle title transferee or vehicle owner shall receive the vehicle registration certificate and license plate (in case of grant of vehicle license plates under Point a, Clause 2, Article 12 of this Circular) at the vehicle registry office or from the public-utility postal service provider.

In case of registration of the movement of a vehicle as a personal belonging, the license plate shall be retained unchanged if it is an ID-based (5-digit) license plate; 3-digit or 4-digit license plate shall be converted into an ID-based license plate in accordance with this Circular.

Section 3

RENEWAL AND RE-GRANT OF VEHICLE REGISTRATION CERTIFICATES AND LICENSE PLATES

Article 16. Cases of renewal and re-grant of vehicle registration certificates and license plates

1. Eligible for renewal of vehicle registration certificates and license plates are converted vehicles; vehicles with their original paint colors changed; vehicles previously registered for grant of license plates with black digits and letters on a white background converted into license plates with black digits and letters on a yellow background (vehicles used for automobile transportation business) or vice versa; vehicles eligible for extension of vehicle registration certificates; vehicles with changed information on vehicle owners (names, personal identification numbers and addresses); vehicles with their registration certificates damaged faded or torn, or with their license plates damaged, faded or broken or with their owners wishing to have old vehicle registration certificates and license plates renewed into new ones in accordance with this Circular.

2. Cases eligible for re-grant of vehicle registration certificates or license plates: Vehicle registration certificates or license plates are lost.

Article 17. Renewal or re-grant dossier

1. Vehicle registration declaration form.

2. Documents of the vehicle owner as specified in Article 10 of this Circular.

3. Vehicle registration certificate (for cases of renewal of vehicle registration certificates) or vehicle license plate (for cases of renewal of vehicle number plates).

4. Other documents:

a/ For renewal of a license plate with black digits and letters on a yellow background converted into a license plate with black digits and letters on a white background, a decision on revocation of the vehicle owner’s transport business license, badge or signboard is additionally required;

b/ For a converted vehicle with replaced complete engine and chassis parts, the proof of origin, registration fee receipt and title transfer documents for such complete engine and chassis parts as specified in Article 11 of this Circular are additionally required;

c/ For a converted vehicle with replaced complete engine and chassis parts of different labels, a technical safety and environmental protection certificate for the converted motor vehicle is additionally required under regulations;

d/ For a converted vehicle with replaced complete engine and chassis parts  which has been previously registered, a certificate of revocation of such registered vehicle’s registration certificate and license plate is required.

Article 18. Procedures for renewal and re-grant  

1. Fully online public services shall be provided in cases of re-grant of vehicle registration certificates or vehicle license plates (except vehicles registered with 3-digit or 4-digit license plates)

a/ Vehicle owners shall fill in vehicle registration declaration forms under Article 9 of this Circular and send them, together with scanned copies of vehicle engine number and chassis number stencil imprints, on the public service portal;

b/ After checking the validity of vehicle dossiers, vehicle registry offices shall send to vehicle owners notices of vehicle registration fee and public-utility postal service charge payment on the public service portal before notifying vehicle registration results under regulations;

c/ Vehicle owners shall receive vehicle registration certificates or vehicle number plates under regulations from public-utility postal service providers.

2. Partially online public services shall be provided in the following cases (except the cases specified in Clause 1 of this Article):

a/ Vehicle owners fill in vehicle registration declaration forms under Article 9 of this Circular, submit dossiers for renewal or re-grant specified in Article 17 of this Circular, and pay a fee according to regulations. They are not required to take their vehicles to vehicle registry offices for checking (except converted vehicles and vehicles having their original paint colors changed);

b/ After checking the validity of vehicle dossiers, vehicle registry offices shall renew or re-grant vehicle registration certificates or vehicle license plates under regulations; and vehicle owners shall receive vehicle registration results at vehicle registry offices or from public-utility postal service providers.

For cases of renewal or re-grant of vehicle registration certificates and vehicle license plates, ID-based license plates shall be kept unchanged; for vehicles registered with 3-digit or 4-digit license plates, ID license plates shall be granted under regulations (original vehicle registration certificates and 3-digit or 4-digit license plates shall be revoked).

For cases of renewal of license plates with black digits and letters on a white background into license plates with black digits and letters on a yellow background or vice versa, new ID-based license plates shall be granted (for vehicles without ID-based license plates) or existing ID-based license plates shall be re-granted (for vehicles with ID-based license plates).

Section 4

TEMPORARY VEHICLE REGISTRATION

Article 19. Vehicles eligible for temporary registration

1. Vehicles that are imported, exported, manufactured, assembled or circulated from factories to warehouses or ports or from warehouses, ports, factories or sale agents to vehicle registration locations or to other agents or warehouses.

2. Automobiles that are undergoing procedures for recall for re-export to countries of origin or title transfer.

3. Automobiles that can operate only in limited areas (vehicles not joining road traffic).

4. Overseas registered vehicles, including also right-hand drive ones, that are permitted by competent agencies to be transited through Vietnam or temporarily imported into Vietnam for a definite period for participation in conferences, trade fairs, exhibitions, physical training and sports or tourism events before being re-exported, except vehicles not subject to grant of temporary number plates under treaties to which Vietnam is a contracting party.

5. Vehicles that are temporarily imported for re-export or manufactured or assembled in Vietnam for test run on public roads.

6. Vehicles that are used to serve conferences held by the Party and the State.

Article 20. Temporary vehicle registration dossier

1. Vehicle registration declaration form.

2. Documents of the vehicle owner as specified in Article 10 of this Circular.

3. Vehicle document which may be one of the following documents:

a/ E-data on or a copy of the proof of origin specified in Clause 1, Article 11 of this Circular or a copy of the invoice or delivery bill (for the case specified in Clause 1, Article 19 of this Circular);

b/ Vehicle registration certificate, to be produced. For unregistered vehicles, the proof of origin specified in Clause 1, Article 11 of this Circular (for the case specified in Clause 3, Article 19 of this Circular) is required;

c/ A competent agency’s written permission for the vehicle to join traffic, enclosed with the list of vehicles and a photocopy of the host country’s vehicle registration (for the case specified in Clause 4, Article 19 of this Circular);

d/ The Vietnam Register’s written certification of the vehicle’s technical safety and environmental protection quality, permitting its test run on public roads (for the case specified in Clause 5, Article 19 of this Circular);

dd/ A competent authority’s written approval of the request for temporary vehicle registration, enclosed with the list of vehicles (for the case specified in Clause 6, Article 19 of this Circular);

4. Vehicle owners that carry out procedures for recall of vehicles for re-export to countries of origin or for vehicle title transfer shall be granted temporary vehicle registrations enclosed with recall dossiers (if vehicle owners so wish) without having to submit temporary vehicle registration dossiers.

Article 21. Procedures for temporary vehicle registration

1. For the case specified in Clause 1, Article 19 of this Circular, fully online public services shall be carried out as follows:

a/ Vehicle owners shall fill in vehicle registration declaration forms and send them together with photocopies of sale invoices or delivery bills on the public service portal;

b/ After checking validity of vehicle dossiers, vehicle registry offices shall send to vehicle owners notices of fee payment under regulations; vehicle owners shall receive verification results and print out temporary vehicle registration certificates from the public service portal.

2. Partially online public services shall be carried out as follows (for cases other than that specified in Clause 1 of this Article):

a/ Vehicle owners fill in vehicle registration declaration forms on the public service portal; provide online vehicle registration dossier codes and submit documents for temporary vehicle registration under Article 20 of this Circular. In case it is impossible to fill in the forms on the public service portal, vehicle owners may fill in declaration forms directly at convenient vehicle registry offices;

b/ After receiving and checking the validity of vehicle dossiers, vehicle registry offices shall collect registration fee and grant temporary vehicle registration certificates and temporary vehicle license plates to vehicle owners under regulations.

Article 22. Validity duration of temporary vehicle registration certificates

1. In the cases specified in Clauses 1 and 2, Article 19 of this Circular, a temporary vehicle registration certificate is valid for 15 days and may be extended only once for up to 15 days. Upon applying for the extension, vehicle owners shall fill in temporary vehicle registration declaration forms on the public service portal or directly at vehicle registry offices.

2. In the cases specified in Clauses 3, 4, 5 and 6, Article 19 of this Circular, the validity duration of a temporary vehicle registration certificate is the period during which the vehicle is permitted by a competent agency to be used for proper activities.

3. A temporarily registered vehicle may join traffic during the period, along the routes and within the operation scope stated in its temporary registration certificate.

Section 5

REVOCATION OF VEHICLE REGISTRATION CERTIFICATES AND
LICENSE PLATES

Article 23. Vehicles subject to revocation of vehicle registration certificates and license plates

1. Vehicles that are irreparably damaged or demolished due to external reasons.

2. Vehicles with expired use durations; vehicles not permitted for road use in accordance with law.

3. Vehicles that are stolen or appropriated without any whereabouts or disposed of and requested by their owners to have their registration certificates and number plates revoked.

4. Vehicles that are imported free of duty or temporarily imported by foreign agencies, organizations and individuals for re-export or title transfer or demolition.

5. Vehicles registered in economic zones under the Government’s regulations upon their re-export or transfer into Vietnam.

6. Vehicles undergoing procedures for registration of title transfer or movement as personal belongings.

7. Vehicles with their engines or chassis removed for registration for other vehicles.

8. Vehicles that have been registered with forged dossiers or vehicles that have their engine and/or chassis numbers cut off, welded, chiseled, erased or rubbed out as concluded by competent agencies or granted number plates in contravention of regulations.

Article 24. Vehicle registration certificate and number plate revocation dossiers

1. For the cases specified in Clauses 1, 2 and 3, Article 23 of this Circular, revocation dossiers shall be made under Points a, b, d and dd, Clause 1, Article 14 of this Circular.

2. For the cases specified in Clauses 4, 5, 6 and 7, Article 23 of this Circular, revocation dossiers shall be made under Clause 1, Article 14 of this Circular.

For vehicles of diplomatic missions, consular offices, representative offices of international organizations in Vietnam or foreign individuals being members of such missions, offices or organizations, letters of introduction of the Directorate of State Protocol (for diplomatic missions and representative offices of international organizations) or provincial-level Foreign Affairs Bureaus (for consular offices).

3. For the case specified in Clause 8, Article 23 of this Circular, vehicle registry offices shall issue decisions on vehicle registration certificate and number plate revocation without requiring vehicle owners to submit revocation dossiers.

Article 25. Procedures for vehicle registration certificate and number plate revocation

1. For the cases specified in Clauses 1, 2 and 3, Article 23 of this Circular, fully online public services shall be carried out as follows:

a/ Vehicle owners shall fill in vehicle registration certificate and number plate revocation declaration forms on the public service portal and return vehicle registration certificates and license plates to vehicle registry offices via postal services;

b/ After receiving and checking the validity of dossiers, vehicle registry offices shall notify results of the grant of vehicle registration certificate and number plate revocation certificates to vehicle owners on the public service portal.

2. Partially online public services shall be carried out as follows (for cases other than that specified in Clause 1 of this Article):

a/ Vehicle owners shall fill in vehicle registration certificate and license plate revocation declaration forms on the public service portal; provide online vehicle registration dossier codes and submit revocation dossiers under Article 24 of this Circular; and receive written appointments for notification of vehicle registration results under regulations;

b/ After receiving and checking the validity of dossiers, vehicle registry offices shall grant vehicle registration certificate and license plate revocation certificates under regulations, with 1 copy handed over to the vehicle owner and 1 copy to be filed in the vehicle dossier.

For the cases of revocation specified in Clauses 4, 5, 6 and 7, Article 23 of this Circular, vehicle registration certificate and license plate revocation certificates shall be stapled and “fan-stamped” together with vehicle engine and chassis number stencil imprints by vehicle registry offices.

Article 26. Responsibilities of public security agencies of units and localities in the revocation of vehicle registration certificates and number plates

1. Responsibilities of vehicle registry offices:

a/ Based on the list of automobiles with expired use duration and vehicles unpermitted for use on public roads in accordance with regulations of vehicle inspection agencies or other competent state agencies, to review and notify vehicle owners of the revocation of vehicle registration certificates and license plates for the latter to carry out revocation procedures. Within 30 days after being notified of the revocation, if vehicle owners fail to carry out revocation procedures, their administrative violations shall be handled in accordance with law;

b/ To update information declared by vehicle owners on the website of the Traffic Police Department or the public service portal about vehicles with expired use duration, disposed vehicles, irreparably damaged vehicles, and vehicles demolished due to external reasons that must undergo revocation procedures under this Circular;

c/ To notify the list of automobiles with expired use duration and vehicles unpermitted for use on public roads and stolen vehicles in accordance with law to public security agencies of units and localities performing the task of maintaining traffic order and safety for detection and handling of traffic violations in accordance with law as well as to vehicle owners via email, phone text message or the public service portal;

d/ For vehicles registered under Clause 8, Article 23 of this Circular, to notify vehicle owners and issue decisions on vehicle registration certificate and license plate revocation. For vehicles of which dossiers are concluded by competent agencies as having been forged or with engine numbers or chassis numbers cut off, welded, chiseled, erased or rubbed out, to forward the cases to investigation bodies for verification and handling in accordance with law.

2. Responsibilities of public security agencies of units and localities and functional forces performing the task of maintaining traffic order and safety:

a/ If detecting, through the work of maintaining traffic and social order and safety, violations involving vehicles specified in Clauses 2, 3 and 8, Article 23 of this Circular, to make records of violations and handle them in accordance with law, and notify such in writing to vehicle registry offices that have registered such vehicles for monitoring;

b/ Based on lists of automobiles with expired use duration and vehicles unpermitted for use on public roads provided by vehicle registry offices, commune-level public security agencies shall notify thereof to vehicle owners or current vehicle users that are headquartered or reside in their localities,  revoke vehicle registration certificates and license plates and grant revocation certificates (in paper or electronic form). In case commune-level public security agencies are not yet empowered to carry out vehicle registration, they shall revoke and return vehicle registration certificates and license plates to their managing district-level public security agencies for the latter to carry out the revocation on the vehicle registration and management system under regulations;

c/ For vehicles irreparably crashed in traffic accidents, agencies that accept traffic accident cases for handling shall temporarily seize vehicle registration certificates and license plates and notify thereof in writing to offices that have registered such vehicles for the latter to carry out revocation procedures under regulations.

Section 6

REGISTRATION AND GRANT OF AUCTION-WINNING AUTOMOBILE LICENSE PLATES

Article 27. Dossier for registration and grant of an auction-winning automobile license plate

1. In case the vehicle bearing the auction-winning license plate has yet to be registered 

a/ Vehicle registration documents as specified in Article 8 of this Circular;

b/ Written certification of the auction-winning vehicle license plate issued by the Traffic Police Department and remaining valid. If the original certification has expired, the extended written certification issued by the Traffic Police Department is required.

2. In case the vehicle bearing the auction-winning license plate has been registered under the ownership of the auction winner

a/ Vehicle registration declaration form;

b/ Vehicle registration certificate and license plate;

In case the office that has carried out procedure for registration and grant of the auction-winning license plate is not the office managing the dossier of the vehicle, the vehicle owner shall carry out revocation procedures for the vehicle;

c/ Written certification of the auction-winning vehicle license plate issued by the Traffic Police Department and remaining valid. If the original certification has expired, the extended written certification issued by the Traffic Police Department is required.

3. In case the vehicle bearing the auction-winning license plate is transferred from another organization or individual under a title transfer

a/ Vehicle registration declaration form;

b/ Vehicle title transfer document specified in Clause 2, Article 11 of this Circular;

c/ Registration fee receipt specified in Clause 3, Article 11 of this Circular;

d/ Vehicle registration certificate and license plate revocation certificate;

dd/ Written certification of the auction-winning vehicle number plate issued by the Traffic Police Department and remaining valid. If the original certification has expired, the extended written certification issued by the Traffic Police Department is required.

Article 28. Vehicle registration procedures

1. An automobile license plate auction winner shall register its/his/her vehicle as follows:

a/ To fill in the vehicle registration declaration form specified in Article 9 of this Circular;

b/ To take the vehicle to the traffic police division of the locality where it is headquartered or he/she resides or that manages the auction-winning vehicle license plate for checking; to provide the online vehicle registration dossier code and submit the vehicle dossier under Article 27 of this Circular;

c/ After the vehicle registry officer checks the validity of the vehicle dossier and actual conditions of the vehicle, to be granted the auction-winning vehicle license plate by the vehicle registry office under regulations. If wishing to receive vehicle registration results via public-utility postal services, to register such with a public-utility postal service provider;

d/ To receive vehicle registration results at the vehicle registry office or from a public-utility postal service provider.

2. In case of vehicle title transfer without an auction-winning license plate

a/ The vehicle owner shall submit the dossier and carry out revocation procedures under Clause 1, Article 14 and Clause 1, Article 15 of this Circular;

b/ The vehicle title transferee shall submit the dossier and carry out procedures for vehicle title transfer registration under Clause 2, Article 14 and Clause 2, Article 15 of this Circular.

3. In case of vehicle title transfer with an auction-winning license plate  

a/ The vehicle owner shall submit the dossier and carry out revocation procedures under Clause 1, Article 14 and Clause 1, Article 15 of this Circular, and not be required to return the auction-winning license plate but have to submit a copy of the vehicle title transfer document and produce the original document for collation (such document must clearly show the content of vehicle title transfer together with the auction-winning vehicle license plate);

b/ The vehicle title transferee shall submit the dossier and carry out procedures for vehicle title transfer registration under Clause 2, Article 14 and Clause 2, Article 15 of this Circular and may register and retain the auction-winning vehicle license plate (the vehicle title transfer document must clearly show the content of vehicle title transfer together with the auction-winning vehicle license plate).

The vehicle title transferee that has received the auction-winning vehicle license plate may not further transfer the vehicle title together with the auction-winning vehicle license plate to another organization or individual, but may transfer the vehicle title under regulations.

Article 29. Management of auction-winning vehicle title plates following vehicle registration

1. In the course of vehicle use, if a vehicle registration certificate or license  plate is damaged or lost or upon the vehicle conversion or paint color change, the vehicle owner (the vehicle license plate auction winner) shall carry out procedures for renewal or re-grant of such vehicle registration certificate or license plate at the vehicle registry office that has registered and granted the license plate for such vehicle under Articles 16, 17 and 18 of this Circular.

2. Upon the relocation of its head office or his/her place of residence to another province or centrally run city, a vehicle owner shall carry out revocation and vehicle registration procedures under Articles 13, 14 and 15 of this Circular.

Section 7

GUIDANCE ON A NUMBER OF SPECIFIC CASES

Article 30. Cases related to vehicle engine and chassis numbers

1. Unregistered vehicles or registered vehicles with engine and chassis numbers cut off, welded, chiseled, erased or rubbed out; and vehicles subject to confiscation decisions not stating engine and chassis numbers or stating “unidentified numbers”, “unclear numbers” or “no numbers available” may not be registered.

2. For unregistered imported vehicles and domestically manufactured or assembled vehicles:

a/ If these vehicles have only vehicle identification numbers (VIN) and have no engine and chassis numbers, vehicle registry offices shall re-emboss vehicle chassis numbers according to VIN and re-emboss vehicle engine numbers according to their license plate numbers;

b/ For vehicles with their in-etiquette, painted or laser-embossed engine and chassis numbers faded, rusty or corroded due to environmental impacts, vehicle registry offices shall re-emboss vehicle chassis numbers according to those stated in the proofs of origin specified at Points a and b, Clause 1, Article 11 of this Circular;

c/ Vehicles with erroneously embossed engine and chassis numbers which are certified by manufacturers may be registered and have their engine and chassis numbers re-embossed according to their license plate numbers. For imported vehicles, foreign manufacturers’ written certifications must be consularly legalized;

d/ Vehicles with re-embossed engine and chassis numbers which are concluded by assessment agencies as original may be registered.

3. In case of replacement of complete engine parts, blocks or complete chassis parts bearing no numbers, engine and chassis numbers shall be embossed according to license plate numbers.

4. For registered vehicles with engine and chassis numbers corroded, faded, rusty or having one character or several characters lost throughout the course of use which are concluded by assessment agencies as original, such engine and chassis numbers may be re-embossed according to those stated in the proofs of origin specified in Clause 1, Article 11 of this Circular.

5. For vehicles confiscated in accordance with law with engine and chassis numbers or having their engine and chassis numbers welded, cut off, chiseled, erased or rubbed out, making it impossible to identify original numbers, if fully satisfying conditions for being registered for joining traffic and before being confiscated, agencies assigned to assume the prime responsibility for asset disposal shall request local traffic police divisions to coordinate with them in organizing the re-embossing of engine and chassis numbers in the following principle: serial number of the locality of registration; year of making and number of minutes of temporary custody of exhibits and means involved in the administrative violation and practice certificate; decision on confiscation or minutes of confiscation showing engine and chassis numbers re-embossed by the traffic police division on the principle specified in this Clause, enclosed with the engine and chassis embossing decision as a basis for making vehicle registration (engine and chassis number stencil imprints after embossing shall be stapled with the engine and chassis embossing decision).

6. In any cases, the re-embossing of engine and chassis numbers under Points a, b and c, Clause 2, and Clauses 3, 4 and 5 of this Article shall be carried out by vehicle registry offices.

Article 31. Title transfer registration for a vehicle having previously undergone more than one title transfer

1. The current vehicle user shall come to the agency managing the vehicles’ registration dossier to carry out revocation procedures and carry out vehicle title transfer registration procedures at the vehicle registry office of the localities where it is headquartered or he/she resides under Article 4 of this Circular. In case the agency managing the vehicle registration dossier is also the agency carrying out vehicle title transfer registration procedures, it is not required to carry out revocation procedures.

2. Revocation dossier and procedures

The current vehicle user shall come to the agency managing the vehicle registration dossier to submit the revocation dossier and carry out revocation procedures under Articles 14 and 15 of this Circular.

3. Vehicle title transfer dossiers and procedures

A vehicle current user shall produce the documents specified in Article 10 of this Circular and submit the following documents:

a/ Vehicle registration declaration form, clearly stating the purchase and sale process and commitment to taking responsibility for the lawful origin of the vehicle;

b/ The vehicle owner’s and the last seller’s vehicle title transfer documents (if any);

c/ Registration fee receipt specified in Clause 3, Article 11 of this Circular;

d/ Vehicle registration certificate and license plate revocation certificate (stapled and “fan-stamped” together with engine and chassis number stencil imprints by the vehicle registry office).

In case the agency managing the vehicle dossier is the agency carrying out the vehicle title transfer registration procedures, the current vehicle user shall submit the vehicle registration certificate and license plate instead of the vehicle registration certificate and license plate revocation certificate.

4. Responsibilities of vehicle registry offices

a/ In case a vehicle current user has the vehicle owner’s and the last seller’s vehicle title transfer documents: Within 2 working days after receiving a complete and valid dossier, a vehicle registry office shall issue a decision on sanctioning of the act of failing to carry out revocation procedures under regulations and register the vehicle title transfer under Article 15 of this Circular;

b/ In case a vehicle current user does not have the vehicle owner’s and the last seller’s vehicle title transfer documents: A vehicle registry office shall issue a written appointment which is valid for vehicle use for 30 days. Within 2 working days after receiving a vehicle title transfer registration dossier, the vehicle registry office shall send a notice to the vehicle owner and concurrently to the vehicle registry office that has previously made the registration for such vehicle; publicly post up the receipt of such dossier at its office; search and verify archived records of the stolen vehicle and vehicle registration data. If there is no dispute, complaint or lawsuit after 30 days from the date of dossier receipt, the vehicle registry office shall issue a decision on sanctioning of the act of failing to carry out revocation procedures and register the vehicle title transfer under Article 15 of this Circular.

5. Responsibilities of the unit managing the database on stolen vehicles and vehicles used as material evidences

Within 7 working days after receiving a vehicle registry office’s written request for information verification, the unit managing data on stolen vehicles and vehicles used as material evidences shall issue a written reply to the vehicle registry office.

Article 32. Settlement of a number of cases of vehicle registration and grant of vehicle license plates

1. Regarding invoices

a/ For vehicles registered for the first time and sold through different organizations or enterprises, the original invoice issued or e-invoice data created by the last-selling organization or enterprise is required;

b/ For vehicles of enterprises or business establishments, a value-added invoice or sale invoice as specified by law is required. In case of purchase of liquidated vehicles of state agencies, a state asset sale invoice or public asset sale invoice is required. For vehicles confiscated in accordance with law, an invoice on sale of assets confiscated for the state fund or a state asset sale invoice or a public asset sale invoice (the original or a notarized or duly certified copy) is required. For vehicles auctioned by credit institutions, a law-specified invoice or e-data on such invoice
is/are required;

c/ For an organization or individual that contributes capital to an enterprise and such contribution is recorded in a capital contribution minutes or an asset delivery and receipt minutes, upon the capital withdrawal from the enterprise, a vehicle return minutes or an asset delivery and receipt minutes is required in accordance with law (if there is a capital contribution invoice).

2. For converted vehicles

a/ For imported used vehicles that are converted before registered, a first-time vehicle registration dossier specified in Article 8 of this Circular and a technical safety and environmental protection certificate are required;

b/ Other automobiles converted into passenger cars or special-use vehicles with their functions and utilities converted at least 5 years or refrigerator trucks converted at least 3 years before the date of their importation may not be registered;

c/ Complete engine and chassis parts may not be used to replace parts of other vehicles, for vehicles with expired use duration, disposed vehicles, vehicles unpermitted for use on public roads prescribed by law, duty-free vehicles, vehicles temporarily imported for re-export by diplomatic missions, consulates and representative offices of international organizations entitled to diplomatic privileges and immunities or consular immunities;

d/ Throughout the course of use, each vehicle may only change either of complete engine parts or complete chassis parts.

3. For imported trailers, semi-trailers and tractors, a technical safety and environmental protection quality certificate for imported motor vehicles (for number plate registration) is required for use as the proof of origin.

4. For vehicles to be handled as inventories left at ports, warehouses and storing yards laying within customs operation areas in accordance with law, the vehicle dossier shall be made under Articles 9 and 10, and Clause 3, Article 11 of this Circular, and enclosed with:

a/ Public asset sale invoice (1 original);

b/ Auctioned asset purchase and sale contract (1 original);

c/ Delivery bill issued by the unit assigned to store and preserve goods (1 original).

Particularly for vehicles on the Government-promulgated list of goods banned from import, a vehicle confiscation decision is required under Point c, Clause 1, Article 11 of this Circular.

5. For vehicles subject to retrospective collection of additional import duty, the registration dossier shall be made under Article 8 of this Circular, and enclosed with:

a/ The competent customs office’s retrospective tax collection decision;

b/ A paper on the remittance of import duty into the state budget.

6. For vehicles in national reserves, the registration dossier shall be made under Articles 9 and 10, and Clauses 1 and 3, Article 11 of this Circular, and enclosed with the decision on sale of national reserves goods, issued by a minister or the head of a sector managing national reserves goods. In case one decision is issued for more than one vehicle, one copy of such decision is required for each vehicle (certified by the ministry or sector managing national reserves goods).

For imported vehicles without any proof of origin, a written certification issued by the customs office (one original for each vehicle), indicating the vehicle type, brand, type code, engine number, chassis number, cylinder capacity and year of manufacture.

7. For vehicles to be sold under decisions of competent agencies to secure judgment execution or debt collection

a/ Vehicles with valid original dossiers and papers proving lawful ownership of vehicle owners may be registered. Vehicles with unidentified origin or without paper proving lawful ownership of vehicle owners may not be registered and competent agencies shall guide vehicle owners to come to agencies that have issued auction decisions for settlement;

b/ For vehicles for which judgment execution offices have issued sale decisions to secure judgment execution, a vehicle registration dossier must comprise a copy of the court ruling or an excerpt of the court judgment or judgment execution decision of a competent civil judgment execution office, money collection paper or asset handover minutes;

For an unregistered vehicle, the registration dossier shall be supplemented under Article 8 of this Circular.

For a registered vehicle, the vehicle purchaser shall carry out procedures for revocation of the vehicle registration certificate and license plate under Article 14 of this Circular (if the vehicle registration certificate is lost, the judgment execution office’s written certification is required) and additionally submit a vehicle registration dossier comprising the vehicle registration declaration form, documents of the vehicle owner specified in Article 10 of this Circular, registration fee receipt specified in Article 11 of this Circular, and vehicle registration certificate and license plate revocation certificate;

c/ For mortgaged vehicles that are sold by credit institutions for debt collection, a vehicle registration dossier must comprise a copy of the mortgage contract or credit contract or security contract for capital borrowing concurrently serving as a credit contract (by endorsed by the credit institution); and invoice(s) as specified by law.

For an unregistered vehicle, the registration dossier shall be supplemented under Article 8 of this Circular.

For a registered vehicle, the vehicle purchaser shall carry out procedures for revocation of the vehicle registration certificate and license plate under Article 14 of this Circular (if the vehicle registration certificate is lost, the credit institution’s written certification is required) and additionally submit a vehicle registration dossier comprising the vehicle registration declaration form, documents of the vehicle owner specified in Article 10 of this Circular, registration fee receipt specified in Article 11 of this Circular, and vehicle registration certificate and license plate revocation certificate;

d/ For vehicles subject to forcible distraint decisions issued by competent agencies to secure the execution of notices of debts and late-payment interests in accordance with the customs law, a vehicle registration dossier shall be made under Article 8 of this Circular, enclosed with a copy of the decision on enforcement with the measure of asset distraint for auction, asset auction minutes made by a competent agency, and and invoice(s) as specified by law.

8. For special-use automobiles rented from foreign parties, a registration dossier must comprise:

a/ The documents specified in Articles 9 and 10, and Clauses 1 and 3, Article 11 of this Circular;

b/ Vehicle rent contract.

9. For registered vehicles of foreign aid projects that are handed over to Vietnamese parties upon project completion, a vehicle title transfer registration dossier shall be made under Article 14 of this Circular and enclosed with:

a/ Decision on establishment of the all-people ownership over the vehicle (for central agencies, such decision shall be issued by a ministerial-level head; for local agencies, such decision shall be issued by a provincial-level People’s Committee chairperson) and minutes of handover and receipt of assets from the donor;

b/ A competent authority’s decision on asset handling, if wishing to sell  vehicles given as aid to these projects.

10. For registered vehicles of a project that are handed over to another project for further use, a vehicle title transfer registration dossier shall be made under Article 14 of this Circular and enclosed with:

a/ The foreign project owner’s document on vehicle handover;

b/ A competent state agency’s official letter certifying aid goods.

11. For registered vehicles that are revoked from completed projects under competent authorities’ asset handling decisions, and other state assets, a vehicle title transfer registration dossier shall be made under Article 14 of this Circular and enclosed with:

a/ A competent authority’s asset handling decision;

b/ A state asset sale invoice or public asset sale invoice issued by a competent state agency in case the assets are sold or liquidated; or a asset handover and receipt minutes in case the assets are transferred.

12. For registered vehicles of dissolved enterprises that liquidate their assets, a vehicle purchaser shall register the vehicle title transfer under Articles 14 and 15 of this Circular and additionally submit:

a/ The vehicle registration certificate;

b/ The competent authority’s dissolution decision or a copy of the decision on revocation of the enterprise registration certificate.

13. For vehicles being common assets of husbands and wives

For a registered vehicle (under the names of both husband and wife or under the name of either husband or wife) with the person named in the vehicle registration certificate dead (with a death certificate) or missing (as declared by a court), the vehicle title transfer may be carried out if the heir gives a written consent under regulations.

14. For vehicles registered for mortgage, when procedures for vehicle title transfer registration, or renewal or re-grant of vehicle registration certificates and license plates, a competent state agency’s written certification of mortgage release (in the paper or electronic form) is required.

15. Registration of vehicles confiscated in accordance with law

a/ For a vehicle confiscated in accordance with law, its original dossier is not required but its proofs of origin must comply with Point c, Clause 1, Article 11 of this Circular;

b/ In case the confiscation decision does not clearly state vehicle characteristics, there must be a confiscation minutes signed by a person with the confiscation competence, clearly stating all vehicle characteristics specified at Point c, Clause 1, Article 11 of this Circular;

c/ In case the confiscation decision or confiscation minutes does not fully state vehicle characteristics, or the vehicle is not complete or its complete engine and chassis parts do not have the same technical parameters, the vehicle may not be registered;

d/ For a confiscated vehicle that has been registered and granted a license plate, after registering such vehicle, the vehicle registry office shall send a notice of vehicle registration to the agency managing such vehicle for disposal of the vehicle dossier.

16. Registration of title transfer or movement of vehicles of the Army and military enterprises

a/ For vehicles of the Army or military enterprises that have been registered at public security agencies and are now moved to the Ministry of National Defense’s Vehicle and Machinery Department, revocation dossiers must comply with Clause 2, Article 24 of this Circular and decisions on vehicle movement for registration at the Ministry of National Defense shall be signed by the Minister of National Defense. After carrying out procedures, vehicle owners shall be granted vehicle registration certificates and license plates and original dossier revocation certificates;

b/ For vehicles of military enterprises that have been registered at public security agencies and are now undergoing title transfer and subject to further registration at public security agencies, vehicle title transfer registration dossiers and procedures must comply with Articles 14 and 15 of this Circular;

c/ For vehicles of the Army and military enterprises already registered at military offices and are now transferred for civil use, vehicle registration dossiers shall be made under Article 8 of this Circular and enclosed with vehicle registration certificates and vehicle dossiers registered by such military offices.

17. For temporarily imported vehicles, vehicles of uncompleted projects, and vehicles transferred in Vietnam:

a/ Vehicle owners shall carry out procedures for revocation of vehicle registration certificates and license plates at vehicle registry offices under Article 25 of this Circular, and then come to customs offices for carrying out procedures for transfer and duty payment under regulations and return transfer dossiers and registration fee receipts to vehicle registry offices for completion of vehicle title transfer procedures under regulations;

b/ Vehicles that are subject to retrospective duty collection by customs offices or are not subject to retrospective duty collection as notified by the Ministry of Finance’s functional agencies may be registered for vehicle title transfer and such notices shall be filed in vehicle dossiers.

18. Vehicles imported free of duty for use in Vietnam of which the import duty calculation value is 0% as specified by law; vehicles which are moved as personal belongings of overseas Vietnamese having registered for permanent residence in Vietnam and arrived at Vietnamese ports before April 1, 2014, may be registered for title transfer under this Circular.

Vehicles of such overseas Vietnamese which have arrived at Vietnamese ports since April 1, 2014, must be registered before transfer. Upon the vehicle transfer, duty receipts under regulations are required for vehicle title transfer registration under this Circular.

19. For unregistered vehicles of which all or some of vehicle documents are lost (vehicle title transfer documents, registration fee receipts and proofs of origin), vehicle registry officers shall guide vehicle owners in contacting agencies that have issued such documents for requesting re-grant of copies thereof. Particularly for domestically manufactured or assembled vehicles, manufacturing or assembling establishments shall re-grant ex-works quality inspection papers (in case  e-data are unavailable).

Article 33. Grant of control badges for automobiles bearing license plates of economic zones under the Government’s regulations to operate in the inland

1. Dossier and procedures:

a/ Vehicle registration certificate of the vehicle bearing a license plate of the economic zone;

b/ The imported automobile’s proof of origin.

2. Agencies that grant control badges (traffic police divisions) shall check and collate declared information against lists of vehicles under their management, and record such information in monitoring books, and grant control badges on the same day.

3. A control badge is valid for up to 30 days from the date of grant. Badges shall be stuck inside on the top right corner of the windshield.

4. Papers on grant of vehicle control badges and books for monitoring vehicles entering inland Vietnam for operation shall be numbered, starting from 01, bound into volumes and managed under the Ministry of Public Security’s regulations on filing.

 

Chapter III

FORMS AND VALIDITY DURATION OF VEHICLE REGISTRATION CERTIFICATES, DETERMINATION OF MANUFACTURE YEARS OF VEHICLES, AND VEHICLE LICENSE PLATES

Article 34. Appendices and forms used in vehicle registration

1. To promulgate together with this Circular:

a/ Appendix 01: Agencies and units carrying out automobile registration at the Traffic Police Department;

b/ Appendix 02: Signs of license plates of domestic automobiles and motorcycles;

c/ Appendix 03: Signs of license plates of automobiles and motorcycles of foreign organizations and individuals;

d/ Appendix 04: Regulations on dimensions of license plates, letters and numbers on license plates of automobiles, motorcycles, tractors, trailers and semi-trailers of domestic and foreign organizations and individuals.

2. To promulgate together with this Circular the following forms:

a/ Motorcycle/motorbike registration certificate (Form DKX01);

b/ Automobile registration certificate (Form DKX02);

c/ Trailer/semi-trailer registration certificate (Form DKX03);

d/ Temporary vehicle registration certificate (electronic form) (Form DKX04);

dd/ Temporary vehicle registration certificate (Form DKX05);

e/ Tractor registration certificate (Form DKX06);

g/ Vehicle registration certificate and number plate revocation certificate (Form DKX07);

h/ Vehicle registration certificate and license plate revocation decision (Form DKX08);

i/ Vehicle engine and chassis number embossing decision (Form DKX09);

k/ Paper on grant of vehicle control badge (Form DKX10);

l/ Book for monitoring automobiles of economic zones which are temporarily imported for re-export (Form DKX11);

m/ Vehicle registration declaration form (Form DKX12);

n/ Vehicle registration certificate and license plate revocation declaration form (Form DKX13);

o/ Dossier instruction sheet (Form DK X14).

For vehicles the structure of which is similar to that of a certain vehicle type, the form of vehicle registration certificate for such type may be used.

Article 35. Validity duration of vehicle registration certificates

1. The validity duration inscribed in registration certificates of trucks, passenger cars and converted vehicles must correspond to these vehicles’ use duration in accordance with law.

2. The validity duration inscribed in registration certificates of automobiles and motorcycles of foreign staff members of diplomatic missions, consulates and representative offices of international organizations must correspond to the validity duration of their diplomatic identity cards, official identity cards, consular identity cards, honorable consular identity cards or (ordinary) identity cards. For vehicles of foreigners residing and working in Vietnam, the validity duration inscribed in the registration certificates must correspond to those of their permanent residence cards or temporary residence cards.

3. The initial validity duration inscribed in registration certificates of automobiles and motorcycles of diplomatic missions, consulate and representative offices of international organizations is 5 years and may be extended with each extension lasting for 3 years.

Article 36. Determination of vehicles’ manufacture year

Owners of imported vehicles and vehicles manufactured or assembled from imported automobile chassis or complete automobiles shall produce certificates of quality or notices of exemption from technical safety and environmental protection quality inspection for imported motor vehicles issued by functional agencies so as to serve the determination of vehicles’ manufacture year. For other vehicles, the manufacture year shall be determined based on the 10th character of their engine and chassis numbers according to relevant current standards.

Article 37. Vehicle license plates

1. Material of license plates: License plates shall be made of metal materials with reflective sheeting and must bear the Public Security forces’ confidentiality signs imprinted according to the Ministry of Public Security’s technical standards of motor vehicle license plates. License plates of temporarily registered vehicles specified in Appendix 02 to this Circular shall be printed on paper.

2. Signs, registration series, and font sizes of letters and digits on license  plates of vehicles of all types must comply with Appendices 02, 03 and 04 to this Circular.

3. An automobile must bear 2 license plates, including one of 165 mm in height and 330 mm in length and the other of 110 mm in height and 520 mm in length.

a/ Letters and digits on an automobile license plate of a domestic agency, organization or individual shall be arranged as follows: The group composing the first two digits indicates the locality where the vehicle is registered, followed by the registration serial code (letter); the second digit group indicates the ordinal number of the registered vehicle, consisting of 5 digits, from 000.01 to 999.99; 

b/ Letters and digits on an automobile license plate of a foreign agency, organization or individual shall be arranged as follows: The group composing the first two digits indicates the locality where the vehicle is registered, followed by the second group consisting of 3 digits denoting the name of the country, territory or international organization, followed by the third group being the license plate series indicating the vehicle owner being a foreign agency, organization or individual, and followed by the fourth group indicating the ordinal number of the registered vehicle, consisting of 2 digits from 01 to 99; 

c/ A tractor, trailer or semi-trailer shall bear 1 rear license plate of 165  mm in height and 330 mm in length. The arrangement of letters and digits on this license plate is the same as those on license plates of domestic automobiles.

4. A motorcycle shall bear 1 rear license plate of 140 mm in height and 190 mm in length.

a/ Letters and digits on a motorcycle number plate of a domestic agency, organization or individual shall be arranged as follows: The first group of characters  indicates the locality where the vehicle is registered and the registration serial code; and the second group consisting of 5 digits from 000.01 to 999.99  indicates the ordinal number of the registered vehicle;

b/ Letters and digits on a motorcycle number plate of a foreign organization or individual shall be arranged as follows: The first group of digits indicates the locality where the vehicle is registered; the second group indicates the name of the country, territory or international organization of the vehicle owner; the third group is the registration serial code; and the fourth group consisting of 3 digits from 001 to 999 is the ordinal number of the registered vehicle.

5. Colors and  alphanumeric series of vehicle license plates of domestic agencies, organizations and individuals:

a/ For automobiles of Party agencies; the Presidential Office; the Office and agencies of the National Assembly; offices of National Assembly deputies’  delegations and People’s Councils at all levels; central steering committees; People’s Public Security forces, People’s Courts, and People’s Procuracies; ministries, ministerial-level agencies, and government-attached agencies; the National Traffic Safety Committee; People’s Committees at all levels and specialized agencies of provincial- and district-level People’s Committees; socio-political organizations (the Vietnam Fatherland Front, Vietnam Trade Union, Ho Chi Minh Communist Youth Union, Vietnam Women’s Union, Vietnam Veterans’ Association, and Vietnam Peasants’ Association);  public non-business units, excluding public driver-training and -testing centers; and project management units with the state management function: License plates with white letters and digits on a blue background and serial code being one of the 11 letters of A, B, C, D, E, F, G, H, K, L, and M in succession;

b/ For motorcycles of the subjects specified at Point a of this Clause: License plates with white letters and digits on a blue background and serial code  being one of the 11 letters of A, B, C, D, E, F, G, H, K, L, and M in succession, combined with one digit from 1 to 9;

c/ For automobiles of domestic organizations and individuals other than those specified at Point a of this Clause: License plates with black letters and digits on a white background and serial code being one of the 20 letters of A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y and Z in succession;

d/ For motorcycles of  domestic organizations and individuals other than those specified at Point a of this Clause: License plates with black letters and digits on a white background and serial code being one of the 20 letters of A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y and Z in succession, combined with one of the 20 letters of A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y and Z;

dd/ For automobiles used for transportation business activities: License plates with black letters and digits on a yellow background and a serial code  being one of the 20 letters of A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y and Z in succession;

e/ For an automobile or a motorcycle of an economic zone: License plate with red letters and digits on a yellow background and signs indicating the locality where the vehicle is registered and two-letter symbol indicating the economic zone under the Government’s regulations;

g/ Some cases with separate serial codes:

License plates with “CD” code shall be granted for special-use automobiles, including also special-use vehicles and machinery of the People’s Public Security forces used for security purposes;

License plates with “KT” code shall be granted for vehicles of military enterprises at the request of the Ministry of National Defense’s Vehicle and Machinery Department.

License plates with “RM” code shall be granted for trailers and semi-trailers;

License plates with “MK” symbol shall be granted for tractors.

License number plates with “TD” code shall be granted for domestically manufactured or assembled vehicles that are permitted by the Prime Minister for pilot operation, including 4-wheeled motorized passenger automobiles and 4-wheeled motorized cargo trucks.

License plates with “HC” code shall be granted for automobiles with limited scope of operation;

Vehicles the structure of which is similar to that of a certain vehicle type shall be granted with license plates for such type.

License plate colors of various series must comply with Points a and c, Clause 5 of this Article.

6. Colors and alphanumeric series of license plates of vehicles of foreign agencies, organizations and individuals

a/ License plates with red letters, black digits and red-colored “NG” serial code on a white background shall be granted for vehicles of foreign diplomatic missions and consulates and their foreign staff members holding diplomatic identity cards. Particularly, for vehicles of ambassadors and consuls general, license plates shall bear the registration ordinal number 01 with a red stripe crossing the groups of digits indicating the nationality and registration ordinal number (license plates with the registration ordinal number 01 shall be re-granted upon registration of new vehicles);

b/ License plates with red letters, black digits and red-colored “QT” serial code on a white background shall be granted for vehicles of representative offices of international organizations and their foreign staff members holding diplomatic identity cards. Particularly, for vehicles of heads of representative offices of United Nations organizations, license plates shall also bear a red stripe crossing the groups of digits indicating the nationality and registration ordinal number;

c/ License plates with black letters and digits and “CV” serial code on a white background shall be granted for vehicles of administrative and technical staff members holding official identity cards of diplomatic missions, consulates and international organizations;

d/ License plates with black letters and digits and “NN” serial code a white background shall be granted for vehicles of foreign organizations, representative offices and individuals other than those specified at Points a, b and c of this Clause.

7. License plate alphanumeric series of vehicles shall be issued by local Public Security agencies based on license plate signs in ascending order; all 20 serial codes of each license plate sign shall be used in succession and they must be used up before a new sign is used.

8. Automobile owners must paint or stick license plate numbers to the rear and on both sides of the vehicles (except automobiles of up to 9 seats); and write their names, cargo tonnage and weight and vehicle net weight automobiles painted on both doors (except personal automobiles).

9. License plates shall be manufactured at the Ministry of Public Security’s license plate-manufacturing enterprises and establishments. Vehicle license plates shall be manufactured and provided at the request of vehicle registry offices. Initial sample license plate products (their dimensions, quality and confidential measures) shall be managed and tested before acceptance by the Traffic Police Department before permitted to be manufactured and provided to vehicle registry offices. During the process of manufacturing and provision of vehicle license plates, license plate-manufacturing enterprises and establishments shall make statistics on, and update, connect and share, data with the vehicle registration and management system.

 

Chapter IV

IMPLEMENTATION PROVISIONS

Article 38. Effect

1. This Circular takes effect on August 15, 2023.

2. This Circular replaces the Minister of Public Security’s Circular No. 58/2020/TT-BCA of June 16, 2020, specifying procedures for grant and revocation of road motor vehicle registration certificates and license plates (which has been partially annulled under the Minister of Public Security’s Circular No. 65/2022/TT-BCA of December 30, 2022, which wholly or partially annuls a number of legal documents).

3. This Circular annuls Article 3, and Clauses 2 thru 10, Article 7 of the Minister of Public Security’s Circular No. 15/2022/TT-BCA of April 6, 2022, amending and supplementing a number of articles of the Minister of Public Security’s Circular No. 43/2017/TT-BCA of October 20, 2017, specifying procedures for grant and revocation of certificates of full satisfaction of security and order conditions and testing and grant of security profession certificates; Circular No. 45/2017/TT-BCA of October 20, 2017, specifying procedures for registration of seal specimens, revocation and destruction of seals, invalidation of seals, and examination of the seal management and use; Circular No. 58/2020/TT-BCA of June 16, 2020, specifying procedures for grant and revocation of road motor vehicle registration certificates and license plates; Circular No. 65/2020/TT-BCA of June 19, 2020, defining tasks and powers of, and specifying forms, contents of, and procedures for, patrol, control and handling of administrative violations in road traffic by, the traffic police force; Circular No. 68/2020/TT-BCA of June 19, 2020, specifying procedures for patrol, control and handling of administrative violations by the waterway traffic police; and Circular No. 73/2021/TT-BCA of June 29, 2021, providing passport and laissez-passer forms and relevant forms.

Article 39. Transitional provisions

1. For vehicles with their 5-digit license plates registered before the effective date of this Circular and not yet undergoing procedures for revocation of such license plates, such license plates shall be identified as ID-based license plates of vehicle owners.

2. For vehicles with registered 5-digit license plates, if vehicle owners have carried out procedures for revocation of such license plates before the effective date of this Circular, such license plate numbers shall be transferred into the license plate store for grant to others under regulations.

3. Vehicles with their registered 5-digit license plates bearing “LD”, “DA”, “MD” or “R” sign may continue to join traffic, even when such license plates are renewed or re-granted, unless vehicle owners wish to be granted license plates under this Circular.

4. For vehicles with their registered 3-digit or 4-digit license plates may continue to joint traffic, unless their owners wish to be granted ID-based license  plates or carry out procedures for renewal or re-grant of vehicle registration certificates or license plates or registration of vehicle title transfer or movement under this Circular, such 3-digit or 4-digit license plates shall be revoked and changed into ID-based license plates under regulations.

5. Commune-level Public security agencies that are empowered to carry out motorcycle registration before the effective date of this Circular may continue doing so under this Circular.

6. The form of vehicle registration certificate issued together with the Minister of Public Security’s Circular No. 58/2014/TT-BCA, and license plates of automobiles, trailers, semi-trailers and motorcycles with 5-digit license plates manufactured before the effective date of this Circular may be further used.

Article 40. Implementation responsibility

1. The Director of the Traffic Police Department shall direct, urge, examine and guide Public security agencies of units and localities in implementing this Circular.

2. Heads of units of the Ministry of Public Security, directors of provincial-level Public Security Departments, and related agencies and units shall implement this Circular.

3. Any difficulties or problems arising in the course of implementation of this Circular should be reported by public security agencies of units and localities to the Ministry of Public Security (through the Traffic Police Department) for timely guidance.-
