CIRCULAR
Amending and supplementing a number of articles of the Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017 of the Minister of Labor, Invalids and Social Affairs on professional standards of vocational education teachers

Pursuant to the Law on Vocational Education dated November 27, 2014;
Pursuant to the Decree No. 14/2017/ND-CP dated February 17, 2017 of the Government on functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to the Decree No. 15/2019/ND-CP dated February 1, 2019 of the Government on detailing a number of articles of, and providing measures to implement, the Law on Vocational Education;
At the proposal of the Director General of the Directorate of Vocational Education and Training;
The Minister of Labor, Invalids and Social Affairs issues the Circular amending and supplementing a number of articles of the Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017 of the Minister of Labor, Invalids and Social Affairs on professional standards of vocational education teachers.
Article 1. Amending and supplementing a number of articles of the Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017 of the Minister of Labor, Invalids and Social Affairs on professional standards of vocational education teachers
1. Amend and supplement Clause 2 and Clause 4, Article 1 as follows:
a) Amend and supplement Clause 2 as follows:
“2. This Circular applies to the vocational education teachers educating in public, private, or foreign-invested colleges, intermediate schools, vocational education centers; continuing education - vocational education centers and enterprises that have registered for vocational education operation (hereinafter referred to as institutions engaged in vocational education activities); related agencies, organizations and individuals.”
b) Amend and supplement Clause 4 as follows:
“4. This Circular does not apply to teachers in the group of teacher training disciplines falling under the state management by the Ministry of Education and Training; teachers at colleges and intermediate schools under the state management by the Ministry of Public Security.”
2. Amend Article 4 as follows:
“Article 4. Standard 2 in foreign language
Have the ability to use foreign languages in performing the duties of a teacher in the primary-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
3. Amend Article 5 as follows:
“Article 5. Standard 3 in informatics
Have the ability to apply information technology in performing the duties of a teacher in the primary-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
4. Amend and supplement a number of clauses of Article 17 as follows:
a) Amend and supplement Point a, Clause 1 as follows:
“a) Have a bachelor's degree or equivalent degree or higher, suitable for the teaching sectors and occupations;”
b) Amend and supplement Point a, Clause 3 as follows:
“a) Obtain at least the bachelor’s diploma or diplomas of equivalent levels in line with the teaching sectors and occupations as assigned and obtain one of the following vocational skills certificates in line with the teaching sectors and occupations for teaching intermediate-level practice: at least a national occupational skill certificate of level 2, or a worker’s certification of level 4/7, 3/6, or a certification of meritorious artisan, meritorious artist, or meritorious doctor, or a certificate of vocational practice at vocational college level or vocational college's degree or college's degree or equivalent;”
5. Amend Article 18 as follows:
“Article 18. Standard 2 in foreign language
Have the ability to use foreign languages in performing the duties of a teacher in the intermediate-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
6. Amend Article 19 as follows:
“Article 19. Standard 3 in informatics
Have the ability to apply information technology in performing the duties of a teacher in the intermediate-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
7. Amend and supplement a number of clauses of Article 32 as follows:
a) Amend and supplement Point a, Clause 1 as follows:
“a) Have a bachelor's degree or equivalent degree or higher, suitable for the teaching sectors and occupations;”
b) Amend and supplement Point a, Clause 2 as follows:
“a) Obtain one of the following vocational skills certificates in line with the teaching sectors and occupations for teaching college-level practice: at least a national occupational skill certificate of level 3, or a worker’s certification of level 5/7, 4/6, or a certification of meritorious artisan, meritorious artist, or meritorious doctor, or a vocation college's degree or certificate of vocational practice at vocational college level or equivalent;”
c) Amend and supplement Point a, Clause 3 as follows:
“a) Obtain at least the bachelor’s diploma or diplomas of equivalent levels in line with the teaching sectors and occupations as assigned and obtain one of the following vocational skills certificates in line with the teaching sectors and occupations for teaching college-level practice: at least a national occupational skill certificate of level 3, or a worker’s certification of level 5/7, 4/6, or a certification of meritorious artisan, meritorious artist, or meritorious doctor, or a vocation college's degree or certificate of vocational practice at vocational college level or equivalent;”
8. Amend Article 33 as follows:
“Article 33. Standard 2 in foreign language
Have the ability to use foreign languages in performing the duties of a teacher in the college-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
9. Amend Article 34 as follows:
“Article 34. Standard 3 in informatics
Have the ability to apply information technology in performing the duties of a teacher in the college-degree training according to the working position requirements specified by the head of the institutions engaged in vocational education activities.”
10. Amend and supplement Article 47 as follows:
“Article 47. Bases for evaluating and grading teachers
1. For a teacher of elementary level: 03 criteria, 14 standards, 35 indicators. These indicators are specified in Article 4, Article 5; Clauses of Article 3 and Clauses of Articles 6 through 16 of this Circular.
2. For a theoretical or practical teacher at intermediate level or college level: 03 criteria, 15 standards, 41 indicators. These indicators are specified in Article 18, Article 19, Article 33, Article 34; Points of Clauses 1, 2 Article 17; Points of Clauses 1, 2 Article 32; Clauses of Articles 20 through 31; Clauses of Articles 35 through 46 of this Circular.
3. For an integrated teacher at college or intermediate level: 03 criteria, 15 standards, 43 indicators. These indicators are specified in Article 18, Article 19, Article 33, Article 34; Points of Clause 3 Article 17; Points of Clause 3 Article 32; Clauses of Articles 20 through 31; Clauses of Articles 35 through 46 of this Circular.”
11. Amend and supplement Clause 3, Article 48 as follows:
“3. The total maximum score of a teacher is total maximum score of standards for him/her. The total maximum score for a teacher of elementary level is 70; for a theoretical teacher or practical teacher of intermediate or college level is 82; for an integrated teacher of intermediate or college level is 86.”
12. Supplement Clause 3, Article 51 as follows:
“3. Guide the institutions engaged in vocational education activities, based on the actual situation, to carry out professional standardization for vocational education teachers in accordance with this Circular.”
13. Amend and supplement Clause 1 and Clause 2, Article 54 as follows:
“1. Conduct annual evaluation and grading of teachers at the end of the academic year as prescribed in this Circular, ensure that such evaluation and grading is conducted in truthful, objective, comprehensive, scientific, democratic and fair manner, correctly reflect the professional capacity of teachers in particular conditions of the institutions engaged in vocational education activities through evidence consistent with the criteria and standards specified in the Chapter II of this Circular.
2. Confirm the teacher's training expertise according to the requirements of the working position, in accordance with the teaching sectors and occupations as assigned, and the teacher's ability to use foreign languages and apply information technology in performing their duties.”
12. Amend Article 55 as follows:
“Article 55. Transitional provisions
1. For sectors and occupations of which exam questions, tests, and assessments for granting national occupational skill certificates or certificates of vocational practice to vocational education teachers have been issued before the effective date of this Circular, the teachers must complete them to meet the standards for national occupational skill certificates, certificates of vocational practice specified in this Circular within 12 months from the effective date of this Circular.
2. For sectors and occupations of which exam questions, tests, and assessments for granting national occupational skill certificates or certificates of vocational practice to vocational education teachers have been issued from the effective date of this Circular, the teachers must complete them to meet the standards for national occupational skill certificates, certificates of vocational practice specified in this Circular within 12 months from the date of issuance of exam questions, tests, and assessments for granting national occupational skill certificates or certificates of vocational practice to vocational education teachers.”
Article 2. Effect
1. This Circular take effects from March 10, 2021.
2. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Labor, Invalids and Social Affairs for guidance./.
