CIRCULAR

Guiding the construction of safe schools for prevention and control of accidents and injuries in general education institutions and continuing education institutions

 

Pursuant to the Law on Education dated June 14, 2019;

Pursuant to the Law on Children dated April 5, 2016;

Pursuant to the Government’s Decree No. 86/2022/ND-CP dated October 24, 2022, on functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to the Government’s Decree No. 127/ND-CP dated September 21, 2018, on state management responsibilities for education;

Pursuant to the Government’s Decree No. 80/2017/ND-CP dated July 17, 2017, on a safe, healthy and friendly education environment which prevents and stops school violence;

At the proposal of the Director of the Physical Education Department;

The Minister of Education and Training promulgates a Circular guiding the construction of safe schools for prevention and control of accidents and injuries in general education institutions and continuing education institutions.

 

Chapter I

GENERAL PROVISIONS

 

Article 1. Scope of regulation and subjects of application

1. This Circular provides guidance on contents, methods, inspection and assessment of construction of safe schools for prevention and control of accidents and injuries in general education institutions and continuing education institutions as well as responsibilities of relevant agencies, organizations and individuals.

2. This Circular applies to general education institutions and continuing education institutions, including primary schools, lower secondary schools, upper secondary schools, multi-level general education schools; boarding general education schools for ethnic minority students and semi-boarding general education schools for ethnic minority students; schools for gifted students, schools for students with art and sport aptitudes, and schools for people with disabilities; continuing education centers, vocational education-continuing education centers (hereinafter referred to as schools) and relevant agencies, organizations and individuals.

Article 2. Interpretation of terms

In this Circular, the following terms are construed as follows:

1. Accidents and injuries refer to unexpected incidents or incidents caused by entities in an intentional manner, which result in physical and mental harm to such entities or other persons.

2. A safe school for prevention and control of accidents and injuries refers to a school where leaners, administrators, teachers, staff, and other persons coming to work are physically and mentally safe, do not suffer from school violence, and receive protection, fair and democratic treatment, love and respect; and a school where risks of occurrence of accidents and injuries are minimized.

Article 3. Principles for construction of safe schools for prevention and control of accidents and injuries

1. Being a key and regular task of each school that shall be prioritized for implementation in accordance with the demand for education development, actual conditions of the locality and school.

2. Mobilizing the participation of local authorities and communities; and promoting the active and effective participation of learners, administrators, teachers, staff and students’ parents.

3. Ensuring that the inspection and assessment are conducted on a regular, objective, truthful, prompt, public and transparent manner.

 

Chapter II

CONTENTS AND METHODS OF CONSTRUCTION OF SAFE SCHOOLS FOR PREVENTION AND CONTROL OF ACCIDENTS AND INJURIES

 

Article 4. Contents of construction of safe schools for prevention and control of accidents and injuries

1. Ensuring the safety of facilities, equipment, means, documents, and teaching materials in service of the school's educational activities.

2. Ensuring school security and order; preventing and controlling school violence, crime, and social evils; guiding learners to participate in a safe, healthy online environment in accordance with the law provisions.

3. Educating about knowledge and skills in prevention of drowning; traffic safety; fire protection and prevention; response to disasters and natural disasters; prevention of fall, collision, electrical injuries and other accidents and injuries that regularly occur.

4. Protecting and caring for learners' health: preventing and controlling school epidemics and diseases; ensuring food safety; preventing and controlling harmful effects of cigarettes and new tobacco products, alcohol, beer and other addictive substances.

5. Implementing the code of conduct and compliance with regulation on school democracy; providing mental health education; and carrying out psychological counseling for learners and social work in the school.

Article 5. Management of construction of safe schools for prevention and control of accidents and injuries

1. Promulgating and organizing the implementation of operation plans by each year and period in association with education and development plans of the school; determining specific resources and roadmap for fulfillment of criteria applicable to safe schools for prevention and control of accidents and injuries specified in the Appendix issued together with this Circular.

2. Developing and organizing the implementation of regulations on cooperation in construction of safe school for prevention and control of accidents and injuries among organizations under the school; between the school and parents, in which the responsibilities of each relevant individual and organization shall be clearly specified.

3. Developing prevention and settlement plans before, during and after accidents and injuries occur in the school and cooperating in settlement outside the school; making plans to meet requirements for safety, prevention and control of accidents and injuries for students when the school organizes or cooperates to organize educational activities outside the school.

4. Setting up a channel intended for receipt of information and a system used to record, monitor and supervise developments in construction of safe school for prevention and control of accidents and injuries.

5. Organizing regular and periodic inspections of construction of safe school for prevention and control of accidents and injuries and compliance with regulations applicable to leaners, administrators, teachers, and staff.

Article 6. Satisfaction of requirements for facilities, equipment, means, teaching documents and materials

1. Completing facilities, equipment, means, teaching documents and materials, clean water works, toilets, works and equipment serving sports, recreation and entertainment activities of leaners in accordance with the law provisions.

2. Regularly inspecting and reviewing the quality of facilities, equipment, means, teaching documents and materials, clean water works, toilets, works and equipment serving sports, recreation and entertainment activities of leaners to overcome the risks of causing accidents and injuries or report to the competent authority for settlement.

Article 7. Organization of communication activities

1. Exploiting and using communication documents on construction of safe schools for prevention and control of accidents and injuries; standardizing contents and diversifying forms and methods of communication with a focus on the application of information technology and appropriate use of social networks and other means of communications.

2. Carrying out communication according to topics and peak periods; regularly giving warning about risks and adopting methods of prevention and control of accidents and injuries that commonly occur, including drowning, traffic accidents, violence and other injuries.

3. Establishing and effectively using information channels, including suggestion boxes, hotline numbers and other appropriate channels, to collect information, give warnings and prevent risks of occurrence of accidents and injuries; diversifying forms of information exchange with parents, agencies, unions and local organizations on dissemination and cooperation in education about prevention and control of accidents and injuries for learners.

4. Strengthening organization of dissemination of information about good examples, experiences and good models of construction of safe schools for prevention and control of accidents and injuries.

5. Promoting the exemplary role of school administrators, teachers, and staff in compliance with codes of conduct and democratic regulations at the grassroots level on prevention of school violence.

Article 8. Professional training and retraining for administrators, teachers and staff

1. Assessing awareness of, knowledge about, and skills in education about prevention and control of accidents and injuries of administrators, teachers, and school staff to develop training and retraining plans suitable for each subject.

2. Organizing training to improve first aid skills and professional capacity of administrators, teachers, and school staff on construction of safe schools for prevention and control of accidents and injuries with a focus on medical staff, physical education teachers, homeroom teachers, and teachers in charge of psychological counseling, social work and Youth Union work.

3. Organizing teacher training on integrated educational contents and methods, and integrating educational contents on safe schools for prevention and control of accidents and injuries in educational subjects and activities.

Article 9. Education of knowledge and skills to ensure safety, prevent and control accidents and injuries for learners

1. Implementing integrated education, integrating contents on safe schools for prevention and control of accidents and injuries in educational subjects and activities.

2. Educating about knowledge and skills in assurance of school safety and security; prevention and control of school violence, crimes and social evils in the school, in the community or the online environment.

3. Educating about knowledge and skills in drowning prevention with a focus on those in swimming and assurance about safety in the water environment; cooperating with families, authorities, agencies, organizations and individuals in managing and organizing safe swimming lessons in order to help leaners prevent drowning in the community.

4. Educating about knowledge and skills in traffic safety and cooperating with families in supervising compliance with regulations on traffic safety by leaners in the community.

5. Educating about knowledge and skills in fire safety and fighting, environmental protection, response to disasters and natural disasters, prevention and control of other injuries, including fall, collision, electric injury, burns, poisoning, and animal attacks. 

6. Establishing groups, teams and clubs to help students to proactively carry out a number of activities and deal with topics with a view to practicing skills in prevention and control of accidents and injuries in the school and give mutual support on the way to school and in families and in the community.

Article 10. Coordination with agencies, organizations and individuals

1. Proposing direction, promulgation and organization of cooperation mechanisms between schools, authorities and mass organizations in construction of safe schools for prevention and control of accidents and injuries for leaners within their areas and cooperation in management of and education to leaners in the residential community during holidays or summer vacations to the Communist Party committees and local authorities.

2. Cooperating in organizing inspection, giving warnings, preventing and eliminating risks of occurrence of drowning, traffic accidents, violence and other injuries to students in the community.

3. Strengthening the mobilization of resources and participation of agencies, organizations and individuals in educating knowledge and skills to ensure safety and prevent accidents and injuries for learners and providing training on expertise and professional skills for teachers.

 

Chapter III

INSPECTION AND ASSESSMENT OF CONSTRUCTION OF SAFE SCHOOLS FOR PREVENTION AND CONTROL OF ACCIDENTS AND INJURIES

 

Article 11. Criteria for assessment of construction of safe schools for prevention and control of accidents and injuries

1. The school shall organize the implementation and self-assessment of criteria for construction of safe schools for prevention and control of accidents and injuries in the Appendix issued together with this Circular.

2. The construction of safe schools for prevention and control of accidents and injuries shall be assessed as follows:

a) "Passed": At least 80% of criteria are assessed as "Passed", including 100% of mandatory criteria assessed as "Passed".

b) "Not Passed": The school does not satisfy regulations at Point a of this Clause.

3. The result of assessment of safe schools for prevention and control of accidents and injuries is used as one of the criteria for assessment and recognition of schools as those that meet education quality accreditation/national standards in accordance with regulations of the Ministry of Education and Training.

Article 12. Organization of assessment and reporting

1. At the end of each school year, the school shall self-assess and report the results, enclosed with recommendations, to the direct education management agency. For the "Not Passes" criteria, there should be plans and measures to self-correct or propose to the competent authority to promptly correct the problem before the new school year.

2. The school shall publicly announce the results of self-assessment of safe schools for prevention and control of accidents and injuries on its website bulletin board and in other appropriate forms to administrators, teachers, staff, students’ parents, leaners and the community for supervision.

3. The district-level Division of Education and Training shall produce statistics and synthesize assessment results with respect to schools under its management and schools under the management of the district-level People's Committee; and report to the district-level People's Committee and the provincial-level Department of Education and Training.

4. The provincial-level Department of Education and Training shall produce statistics and synthesize assessment results with respect to schools under its management; and report to the provincial-level People's Committee and the Ministry of Education and Training.

Article 13. Inspection of assessment results

1. The provincial-level Department of Education and Training or the district-level Division of Education and Training shall develop a plan to inspect results of assessment of construction of safe schools for prevention and control of accidents and injuries with respect to schools under its management by each school year.  The inspection shall be conducted on a separate topic or integrated with other topics during the school year with records and notification of inspection results.

2. The provincial-level Department of Education and Training or the district-level Division of Education and Training shall assume the prime responsibility for or cooperate in establishment of interdisciplinary inspection and assessment teams upon request of the competent authority.

3. The Ministry of Education and Training shall organize inspection or cooperate with central authorities to organize interdisciplinary inspection within its competence.

 

Chapter IV

RESPONSIBILITIES OF AGENCIES AND ORGANIZATIONS

 

Article 14. Responsibilities of schools

1. Organizing the implementation of contents, measures, self-assessment and report on results of construction of safe schools for prevention and control of accidents and injuries in accordance with this Circular.

2. Heads of schools shall be responsible to the superior education authority and the law for organizing construction of safe schools for prevention and control of accidents and injuries.

Article 15. Responsibilities of provincial-level Departments of Education and Training, district-level Divisions of Education and Training

1. The provincial-level Department of Education and Training shall direct, provide guidance for and inspect the district-level Divisions of Education and Training and schools under its management when they implement this Circular.

2. Reviewing and making a list of "Passed" and "Not passed" schools for prevention and control of accidents and injuries, giving clear reasons why criteria have not been met or request the competent authority to direct remediation.

3. Organizing training and retraining for administrators, teachers, and staff in construction of schools for prevention and control of accidents and injuries every year.

4. The district-level Divisions of Education and Training shall finally review and report results of construction of safe schools for prevention and control of accidents and injuries to the provincial-level Department of Education and Training, and the provincial-level Departments of Education and Training shall review and report results of construction to the Ministry of Education at the same time of the school year summary according to regulations.  Giving commendation to and imposing discipline on agencies, organizations and individuals within their competence.

Article 16. Responsibilities of People's Committees at all levels

1. Directing the implementation, giving priority to investment in, and taking the responsibility for construction of safe schools for prevention and control of accidents and injuries for schools under its management.

2. Directing and organizing regular coordination among government forces, local organizations and schools in inspection, supervision, warning, prevention and elimination of risks causing accidents and injuries that commonly occur, including drowning, traffic accidents, violence and other injuries.

 

Chapter V

IMPLEMENTATION PROVISIONS

 

Article 17. Effect

This Circular takes effect on December 12, 2023.

Article 18. Responsibilities for implementation

The Chief of Office, Director of Physical Education Department, heads of relevant units under the Ministry of Education and Training; chairpersons of People's Committees of province and centrally-run cities, directors of provincial-level Departments of Education and Training, heads of schools, relevant agencies, organizations and individuals shall implement this Circular.

Porches, railings, stairs

Porches, railings, stairs meet the prescribed standards; Desks, chairs and other objects are not left in the porch and railing areas. Elevators and food transport elevators (if any) have doors and locks to ensure safety.

Kitchens, dining rooms, canteens (if any)

Be separate from the functional rooms and classrooms, and installed with fire-fighting equipment to ensure good operation.

Fully and seriously implement food safety regulations, avoiding food poisoning when organizing meals, canteen services in the school or in out-of-school educational activities organized by the school.

Have documents and organizations for communication and education to prevent harmful effects of tobacco, new tobacco products, alcohol, beer and other addictive substances.

Do not sell, advertise or market tobacco, alcohol, beer, foods harmful to health, violent toys of unknown origin on school grounds.

Implementing codes of conduct and democratic regulations in the school; mental health education and psychological counseling and social work for learners

Promulgate and well implement the Codes of Conduct and Democratic Regulations in the school (have regulations appropriate to the school's practical conditions; and organize serious and effective implementation with annual inspection and assessment).

There are organized groups/teams/clubs for learners to proactively and assume the responsibility for a number of activities and topics to practice skills in accident and injury prevention and support each other on the way to school, in the community and family.
