CIRCULAR

Amending and supplementing a number of articles of the Circular No. 41/2020/TT-BGDDT dated November 03, 2020 of the Minister of Education and Training on repealing a number of education-related legal documents issued by the Minister of Education and Training

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; the Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016 detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents; the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020 amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 86/2022/ND-CP dated October 24, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of Legal Department;

The Minister of Education and Training promulgates the Circular amending and supplementing a number of articles of the Circular No. 41/2020/TT-BGDDT dated November 03, 2020 of the Minister of Education and Training on repealing a number of education-related legal documents issued by the Minister of Education and Training.

Article 1. To add Article 1a to the Circular No. 41/2020/TT-BGDDT dated November 03, 2020 of the Minister of Education and Training on repealing a number of education-related legal documents issued by the Minister of Education and Training as follows:

“Article 1a. Transitional provisions

For early childhood education institutions and general education institutions that are subject to transformation in accordance with Circular No. 11/2009/TT-BGDDT dated May 8, 2009 of the Minister of Education and Training, on prescribing the order and procedures for transformation from semi-public and people-founded early childhood and general education institutions to private early childhood and general education institutions; semi-public early childhood education institutions to people-founded early childhood education institutions; semi-public early childhood and general education institutions to public early childhood and general education institutions (Circular No. 11/2009/TT-BGDDT), in case the transformation has not been carried out, it must be completed under the Circular No. 11/2009/TT-BGDDT before June 30, 2025”.

Article 2. Effect

1. This Circular takes effect on November 20, 2023.

2. The Chief of Office, Director of Legal Department, Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally-run cities; Directors of provincial-level Departments of Education and Training and relevant organizations and individuals shall be responsible for implementing this Circular./.
