DIRECTIVE
ON THE WORK OF URBAN PLANNING AND CONSTRUCTION MANAGEMENT
Over the recent years, the work of urban planning and construction management has seen positive changes, but revealed numerous shortcomings and weaknesses: detailed plannings are insufficient, failing to meet the investment requirements of urban development and management; the quality of planned projects is generally low; the management of urban construction is far below the urban development; administrative procedures remain troublesome; the construction is unplanned, unpermitted or illegal; cultural or historical relics and scenic places are infringed upon; urban environment is polluted; infrastructure remain insufficient and non-synchronous; the order in urban architecture and construction has not yet been established .
In order to put an end to the above situation, the Prime Minister hereby instructs the ministries, branches, the People’s Committees of the provinces and centrally-run cities and urban authorities at each level to perform the following tasks:
1. The presidents of the People’s Committees of the provinces and centrally-run cities and urban authorities at each level shall familiarize cadres and people with the viewpoints, objectives and guidelines on urban development in the industrialization and modernization period and mobilize them to actively take part in campaigns for building green, clean and beautiful cities and preserving the civilized lifestyle.
The Ministry of Construction shall assume the prime responsibility and coordinate with the ministries, branches and localities launching the emulation movement for "urban construction and sustainable development" with a view to developing more typical and advance city models for implementation nationwide.
2. The Ministry of Construction shall gather opinions from the concerned ministries and branches to finalize and promulgate in 1999 the framework program on the implementation of overall planning orientations for the development of Vietnam’s urban centers till the year 2020, which was already approved by the Prime Minister; thereby to elaborate the master plan for construction of urban system in key regions and urbanized areas and submit it to the Prime Minister for approval, which shall serve as basis for elaborating implementation programs and plans suitable to each development period.
The People’s Committees of the provinces and centrally-run cities shall base themselves on the master plan for socio-economic development and the overall planning orientations for urban development throughout the country till 2020 to direct the elaboration and approval of the overall plannings for urban centers and rural population quarters in their respective provinces and cities after getting the consents of the Ministry of Construction, the Ministry of Planning and Investment and the concerned ministries and branches.
The Ministry of Construction and the Government Commission for Organization and Personnel shall study the compilation of a Decree on urban classification and urban management assignment; amend, supplement and finalize the criteria for assessment, classification of urban centers and urban management assignment and submit them to the Government for consideration and decision, which shall serve as basis for directing the arrangement of urban systems in the whole country.
3. Basing themselves on the master plan on regional socio-economic development and the overall planning orientations for urban development throughout the country till 2020, the Ministry of Construction, the Peoples Committees of the provinces and centrally-run cities shall revise and readjust construction planning blueprints till 2020 in the spirit of the Prime Minister’s Directive No. 32/1998/CT-TTg of September 23, 1998.
The Ministry of Planning and Investment and the Ministry of Construction shall coordinate with the concerned ministries and branches in guiding localities to elaborate annual and 5-year plans for survey and design of construction plannings so as to ensure the practicality and efficiency of the planning work.
The Ministry of Planning and Investment shall assume the prime responsibility and coordinate with the Ministry of Finance in drawing up plans to provide annual funding for the planning work, and together with the Ministry of Construction to study mechanisms which generate capital for the planning work; speed up the elaboration, ratification of detailed plannings and specialized construction plannings.
The Ministry of Construction shall assume the prime responsibility and coordinate with the concerned ministries and branches in studying the further renewal of the elaboration, ratification of construction plannings with a view to raising the quality of construction plannings blueprints, meeting the socio-economic development requirements, protecting environment, preventing and combating natural calamities, including floods in combination with the maintenance of security and national defense.
4. In furtherance of the Government’s 1999 working program and the Xth National Assembly’s legislative program for its whole term, the ministries, branches and localities shall revise, amend, supplement and draft legal documents as well as policies on urban management and development. The Ministry of Justice shall have to inspect and guide the implementation of this work.
5. In order to take initiative in mobilizing investment capital for urban development, the Ministry of Planning and Investment and the Ministry of Construction shall coordinate with the ministries, branches and localities in elaborating the program on investment in urban infrastructure development till 2005 and beyond, including the projects for investment in construction of production infrastructure, technical infrastructure, social infrastructure and the projects for urban environment protection and sanitation, and submit it to the Prime Minister for approval, which shall serve as basis for attracting investment capital sources and directing the effective implementation of urban construction projects.
The Ministry of Planning and Investment shall assume the prime responsibility and coordinate with the Ministry of Finance in revising and supplementing policies and mechanisms for investment promotion and preference.
The Ministry of Finance shall elaborate mechanisms and policies for mobilizing capital sources, especially sources from people; formulating urban development funds; increasing sources of revenues from urban services; effectively using housing and land funds so as to generate capital for investment in urban transformation and development.
6. In performance of the tasks of re-establishing order in urban architecture and construction, actively controlling the urban development according to the plannings, plans and law, the Ministry of Construction, the People’s Committees of the provinces and centrally-run cities shall promptly issue the Regulation on construction management according the approved plannings. The Ministry of Construction shall submit in the fourth quarter of 2000, the orientations for Vietnam’s architectural development till the year 2020 to the Prime Minister for approval.
The Ministry of Communications and Transport and the Ministry of Construction shall direct and guide the elaboration of plannings, determine the traffic safety corridors and take effective measures for enhancing the management of construction along the water and land traffic lines; putting an end to the unplanned construction which causes traffic jams and unsafety and to the illegal use of agricultural land.
The General Land Administration shall assume the prime responsibility and coordinate with the Ministry of Construction in concentrating on the direction of the management of urban land use; speeding up the measurement, registration, granting of residential land use right and house ownership certificates.
The People’s Committees of the provinces and centrally-run cities and urban authorities at each level, according to their respective competence and responsibilities, shall have to regularly inspect, supervise and take resolute measures for handling acts of violating law and plannings; soon restore the urban architecture, construction and traffic order.
7. In order to raise the effectiveness of State management in urban centers, the Government Commission for Organization and Personnel shall assume the prime responsibility and coordinate with the concerned ministries and branches in studying the assignment of responsibilities, and powers to and the organizational structure of the urban administration apparatus, along the direction of enhancing the powers and responsibilities for urban administration at each level in deciding matters related to urban management, especially the plannings, plans for investment in the public sector; infrastructure management and use; budget revenue-expenditures; organization and personnel; improvement of administrative procedures; settlement of complaints and denunciations, litigations and handling of relevant administrative cases.
The Prime Minister requests the ministers, the heads of the ministerial-level agencies and agencies attached to the Government, and the presidents of the People’s Committees of the provinces and centrally-run cities to pay due attention to and draw up plans for strict implementation of this Directive.
The Ministry of Construction shall assume the prime responsibility and coordinate with the ministries, branches, People’s Committees of the provinces and centrally-run cities in monitoring, guiding and periodically reporting on the implementation of this Directive to the Prime Minister.
