SUMMARY

Sectoral land-using master plans shall be completed before August 15

This is one of directions of the Prime Minister in the Directive No. 22/CT-TTg dated August 11, 2021, on intensification of formulation of land use master plans and plans at all levels

Accordingly, the Prime Minister request ministries and sectors expeditiously complete the formulation of sectoral land-using master plans; review, determine and propose land use demands, and propose their land-using construction works and projects of their sectors and fields in provincial-level administrative units for reporting to the Ministry of Natural Resources and Environment in the course of formulation of the national land use master plan for the 2021-2030 period, with a vision toward 2050 and the five-year (2021-2025) national land use plan, which must be completed before August 15, 2021.

For provincial-level People’s Committees, it is necessary to focus on directing the formulation of five-year (2021-2025) provincial-level land use plans under regulations for sending to the Ministry of Natural Resources and Environment for appraisal and submission to the Prime Minister before December 01, 2021. Concurrently, speed up the formulation, appraisal and approval of district-level land use master plans for the 2021-2030 period.

In addition, the Ministry of Natural Resources and Environment shall proactively coordinate with the National Assembly’s Committee for Economic Affairs in promptly submitting to the National Assembly the national land use master plan for the 2021-2030 period, with a vision toward 2050, and the five-year (2021-2025) national land use plan, etc.

DIRECTIVE

On intensification of formulation of land use master plans and plans at all levels

Over the past time, in implementation of provisions of the laws on master plans and land, ministries, ministerial-level agencies and provincial-level People’s Committees have been formulating master plans in the national system of master plans for the 2021-2030 period, with a vision toward 2050, including also land use master plans and plans at all levels, in order to meet land use demands of sectors, fields and localities and serve the country’s socio-economic development.

However, in the course of implementation of such master plans and plans, there still exist problems and shortcomings such as behind-schedule formulation and implementation of land use master plans and plans; inadequate review and adjustment of sectoral land-using master plans and plans to be conformable with land use master plans and plans; and impractical forecasting of land use demands of sectors and fields.

In order to promptly meet demands for land use to achieve socio-economic development and national defense and security targets in the new situation, ensuring economical and efficient land use, and address land use conflicts and overlaps between sectors, fields and localities, the Prime Minister requests provincial-level People’s Committees, the Ministry of Natural Resources and Environment, and related ministries and sectors to expeditiously formulate land use master plans for the 2021-2030 period and land use plans at all levels, performing the following major tasks:

1. For provincial-level People’s Committees

a/ To intensify the formulation of provincial master plans, focusing on plans on land distribution and zoning under Clause 6, Article 1 of the Government’s Decree No. 148/2020/ND-CP of December 18, 2020, amending and supplementing a number of decrees detailing the implementation of the Land Law for submission to the Ministry of Natural Resources and Environment for opinions under Clause 7, Article 1 of the Government’s Decree No. 148/2020/ND-CP before incorporating them in provincial master plans for sending to the Ministry of Natural Resources and Environment for opinions before December 1, 2021.

b/ To focus on directing the formulation of five-year (2021-2025) provincial-level land use plans under regulations for sending to the Ministry of Natural Resources and Environmental for appraisal and submission to the Prime Minister before December 1, 2021.

c/ To speed up the formulation, appraisal and approval of district-level land use master plans for the 2021-2030 period in accordance with the Law Amending and Supplementing a Number of Articles of Thirty-Seven Laws Concerning Planning; Article 1 of the National Assembly Standing Committee’s Resolution No. 751/2019/UBTVQH14 of August 16, 2019, explaining a number of articles of the Planning Law; and Clauses 3, 4 and 9, Article 1 of the Government’s Decree No. 148/2020/ND-CP of December 18, 2020, for completion thereof before September 1, 2021.

d/ To direct and carry out the formulation, appraisal, and approval of district-level annual land use plans in accordance with law to serve as a basis for land recovery, allocation and lease, and change of land use purposes to meet  requirements of local socio-economic development; to clearly identify funding sources for implementation of construction works and projects, ensuring economical and efficient land use and high feasibility of such works and projects, and preventing the situation of suspended projects that may affect people’s lives.

In case district-level land use master plans for the 2021-2030 period have not been approved, while land use norms in the land use master plans through 2020 have not been used up, provincial-level People’s Committees shall direct further implementation of Clause 4, Article 49 of the Land Law (which was amended under Clause 1, Article 6 of the Law Amending and Supplementing a Number of Articles of Thirty-Seven Laws Concerning Planning); and concurrently direct the updating of the implementation thereof to annual district-level land use plans.

2. For ministries and sectors

a/ Ministries and sectors shall expeditiously complete the formulation of sectoral land-using master plans; review, determine and propose land use demands, and propose their land-using construction works and projects of their sectors and fields in provincial-level administrative units for reporting to the Ministry of Natural Resources and Environment in the course of formulation of the national land use master plan for the 2021-2030 period, with a vision toward 2050 and the five-year (2021-2025) national land use plan, which must be completed before August 15, 2021.

b/ The Ministry of Natural Resources and Environment shall:

- Assume the prime responsibility for, and coordinate with related ministries, sectors and provincial-level People’s Committees in, formulating the national land use master plan for the 2021-2030 period, with a vision toward 2050 and the five-year (2021-2025) national land use plan for submission to the National Council for Appraisal of Master Plans and the Government for subsequent reporting to the National Assembly at the 2021 year-end session; to examine and urge ministries, sectors and localities to comply with relevant regulations and promptly report to the Prime Minister problems arising in the course of implementation of this Directive.

- Proactively coordinate with the National Assembly’s Committee for Economic Affairs in promptly submitting to the National Assembly the national land use master plan for the 2021-2030 period, with a vision toward 2050, and the five-year (2021-2025) national land use plan.

3. Organization of implementation

a/ The Minister of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with related ministries and sectors and provincial-level People’s Committees in monitoring, urging and summarizing the implementation of the tasks set forth in this Directive and promptly reporting to the Prime Minister problems arising in the course of implementation.

b/ Chairpersons of provincial-level People’s Committees shall take full responsibility before the Prime Minister for directing the formulation and approval of land use master plans and plans of their localities, ensuring accuracy of figures, quality and high feasibility of such master plans and plans in accordance with law; and regularly examine, urge and promptly remove difficulties arising in the implementation thereof.

The Prime Minister requests ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees to strictly implement this Directive and periodically report the implementation thereof to the Prime Minister.-
