Approving the electricity generation price bracket for 2023
 

THE MINISTER OF INDUSTRY AND TRADE 

Pursuant to the December 3, 2004 Electricity Law, and the November 20, 2012 Law Amending and Supplementing a Number of Articles of the Electricity Law;

Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 137/2013/ND-CP of October 21, 2013, detailing a number of articles of the Electricity Law and the Law Amending and Supplementing a Number of Articles of the Electricity Law;

Pursuant to the Minister of Industry and Trade’s Circular No. 57/2014/TT-BCT of December 19, 2014, providing methods of, and procedures for, formulation and promulgation of the electricity generation price bracket; Circular No. 31/2022/TT-BCT of November 8, 2022, amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 57/2014/TT-BCT of December 19, 2014providing methods of, and procedures for, formulation and promulgation of the electricity generation price bracket; and Circular No. 57/2020/TT-BCT of December 31, 2020, providing methods of determining electricity generation prices and electricity purchase and sale contracts;

At the proposal of the Director of the Electricity Regulatory Authority of Vietnam.

DECIDES:

Article 1. To promulgate the electricity generation price bracket for 2023

The electricity generation price bracket for 2023 applicable to the negotiation on electricity purchase and sale contract prices of power plants specified at Point a, Clause 2, Article 1 of the Minister of Industry and Trade’s Circular No. 57/2014/TT-BCT of December 19, 2014, providing methods of, and procedures for, formulation and promulgation of the electricity generation price bracket is provided as follows:

1. The electricity generation price bracket applicable to coal-fired power plants: Between 0 and 1,559.7 VND/kWh (exclusive of value-added tax). Of which:

The ceiling price of the electricity generation price bracket applicable to coal-fired power plants (exclusive of value-added tax) is determined as follows:

Parameters used for calculating the ceiling price of the electricity generation price bracket applicable to coal-fired power plants in 2023 include:

- Net capacity: 2 x 600 MW.

- Net heat-consuming rate at 85% load: 2,411.39 kcal/kWh.

- Higher heating value (HHV) of coal: 5,280 kcal/kg.

- Coal price (exclusive of value-added tax and transportation cost): 1,808 VND/ton.

- Exchange rate: 24,885 VND/USD.

2. The electricity generation price bracket applicable to hydroelectric plants: Between 0 and 1,110 VND/kWh (exclusive of water resource royalty, forest environmental service charge, charge for the grant of the water resource exploitation right, and value-added tax).

Article 2. Organization of implementation

Based on the electricity generation price bracket specified in Article 1 of this Decision, the Vietnam Electricity Group shall negotiate with electricity-generating units on electricity purchase and sale prices in accordance with the Ministry of Industry and Trade’s regulations on methods of determining electricity generation prices, and manage construction investment costs in accordance with the construction law.

Article 3. Implementation provisions

1. This Decision takes effect on the date of its signing.

2. The Chief of the Office, Director of the Electricity Regulatory Authority of Vietnam, Director of the Department of Legislation, Chief Inspector, heads of units of the Ministry of Industry and Trade, the General Director of the Vietnam Electricity Group, and heads of related power-generating units shall implement this Decision.-
