SUMMARY

From July 15, low-efficiency rice cookers are not allowed to manufactured

On May 24, 2023, the Prime Minister issues Decision No. 14/2023/QD-TTg providing for the lists of, and roadmaps for eliminating, energy-consuming devices and equipment subject to elimination, and low-efficient power generation units banned from construction.

1. 3 groups of low-efficiency energy-consuming devices and equipment subject to elimination include:

- Household appliances: Compact fluorescent lamps, electronic ballasts for fluorescent lamps, electromagnetic ballasts for fluorescent lamps, linear tubular fluorescent lamps, storage water heaters, infrared hobs, induction hubs, LED lamps, non-ducted air conditioners, clothes washing machines for household use, television sets, rice cookers, electric fans, refrigerator, refrigerator-freezer, and freezer.

- Office and commercial equipment: Computer monitors, copiers, printers, notebook computers, desktop computers, and commercial refrigerated cabinets.

- Industrial equipment: Three-phase asynchronous squirrel cage electrical motors, distribution transformers, LED road and street lighting luminaires, and industrial boilers.

2. Low-efficiency coal-fired and gas-fired generating sets in thermal power plants are banned from construction, in which:

- The policies for investment in coal-fired or gas-fired generating sets whose efficiency fails to satisfy the minimum energy efficiency standards are disapproved.

- Coal-fired and gas-fired generating sets with efficiency at the time of starting commercial operation lower than the specified efficiency corresponding to each power range of the unit are banned from operation.

This Decision takes effect on July 15, 2023.

DECISION

Providing for the lists of, and roadmaps for eliminating, energy-consuming devices and equipment subject to elimination, and low-efficient power generation units banned from construction[1]

 

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 28, 2010 Law on Economical and Efficient Use of Energy;

Pursuant to the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing, and providing for measures to implement, the Law on Economical and Efficient Use of Energy;

At the proposal of the Minister of Science and Technology;

The Prime Minister promulgates the Decision providing for the lists of, and roadmaps for eliminating, energy-consuming devices and equipment subject to elimination, and low-efficient power generation units banned from construction.

Article 1. Scope of regulation

1. This Decision provides for the lists of, and roadmaps for eliminating, low-efficient energy-consuming devices and equipment subject to elimination (banned from import and production and trading in the country) and low-efficient power generation units banned from construction.

2. This Decision does not apply to devices and equipment that are temporarily imported for re-export or used in service of repair, replacement, or inspection of energy efficiency levels.

Article 2. Subjects of application

This Decision applies to state agencies, enterprises, organizations and individuals engaged in the import, production and trading of the goods specified in Article 3 of this Decision.

Article 3. The lists of, and roadmaps for eliminating, low-efficient energy-consuming devices and equipment subject to elimination and low-efficient power generation units banned from construction

1. The list of, and roadmap for eliminating, low-efficient energy-consuming devices and equipment subject to elimination are provided in Appendix I to this Decision, covering:

a/ Group of household appliances: compact fluorescent lamps, electronic ballasts for fluorescent lamps, electromagnetic ballasts for fluorescent lamps, linear tubular fluorescent lamps, storage water heaters, infrared hobs, induction hobs, LED lamps, non-ducted air conditioners, clothe washing machines for household use, television sets, rice cookers, electric fans, refrigerators, refrigerator-freezers, and freezers.

b/ Group of office and commercial equipment: computer monitors, copiers, printers, notebook computers, desktop computers, and commercial refrigerated cabinets.

c/ Group of industrial equipment: three-phase asynchronous squirrel cage electrical motors, distribution transformers, LED road and street lighting luminaires, and industrial boilers.

2. The list of, and roadmap for eliminating, low-efficient coal or gas-powered generation units in thermal power plants banned from construction are provided in Appendix II to this Decision:

a/ Not to approve investment policy for coal- or gas-powered thermal power plants whose efficiency is lower than the efficiency corresponding to the capacity range of the power generation units provided in Appendix II to this Decision.

b/ Not to license the operation of coal- or gas-powered generation units whose efficiency at the time of commercial operation is lower than the efficiency corresponding to capacity range of the power generation units provided in Appendix II to this Decision.

Article 4. Organization of implementation

1. The Ministry of Science and Technology shall:

a/ Assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees in, taking solutions to support the elimination of energy-consuming devices and equipment subject to elimination and low-efficient power generation units banned from construction specified in this Decision.

b/ Assume the prime responsibility for, and coordinate with related ministries and sectors in, formulating national standards on energy efficiency and minimum energy efficiency levels of energy-consuming devices and equipment.

c/ Based on the socio-economic development and state management requirements, assume the prime responsibility for, and coordinate with line ministries and sectors in, reviewing, and proposing the Prime Minister to decide to modify, supplement or replace, the lists of energy-consuming devices and equipment subject to elimination and power generation units banned from construction.

2. The Ministry of Industry and Trade shall:

a/ Assume the prime responsibility for, and coordinate with the Ministry of Science and Technology in, examining and inspecting the compliance with regulations on elimination of low-efficient energy-consuming equipment and low-efficient power generation units banned from construction as specified in this Decision.

b/ Assume the prime responsibility for, and coordinate with related ministries and sectors in, guiding and checking the import and export of goods in compliance with regulations on elimination of energy-consuming equipment subject to elimination and low-efficient power generation units banned from construction as specified in this Decision.

c/ Coordinate with the Ministry of Science and Technology in formulating and reviewing national standards on energy efficiency and minimum energy efficiency levels of energy-consuming devices and equipment.

3. Ministries, sectors and localities shall, based on their functions, tasks and management competence, assume the prime responsibility for eliminating energy-consuming devices and equipment and low-efficient power generation units banned from construction.

Article 5. Implementation provisions

1. This Decision takes effect on July 15, 2023.

The Prime Minister’s Decision No. 24/2018/QD-TTg of May 18, 2018, promulgating the lists of, and roadmaps for eliminating, energy-consuming devices and equipment subject to elimination and low-efficient power generation units banned from construction, ceases to be effective on the effective date of this Decision.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, heads of agencies, units, and concerned organizations and individuals shall implement this Decision.-
