THE GOVERNMENT

Decree No. 96/2013/ND-CP dated  August 27, 2013 of the Government on amending and supplementing some articles of the Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding a number of articles of the Ordinance on the Vietnam Marine Police

Pursuant to the Law dated December 25, 2001 on Government Organizations;

Pursuant to the Ordinance dated January 26, 2006 on the Vietnam Marine Police;

At the proposal of the Minister of National Defense;

The Government promulgates the Decree on amending and supplementing some articles of the Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding a number of articles of the Ordinance on the Vietnam Marine Police,

Article 1. To amend and supplement some articles of the Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding a number of articles of the Ordinance on the Vietnam Marine Police

1. To amend and supplement Clause 2 and Clause 3 Article 3 as follows:

"Article 3.Organization and operation of the Vietnam Marine Police

2. The Vietnam Marine Police is specialized force of State, operates in accordance with Vietnam s laws; respecting and complying with treaties to which the Socialist Republic of Vietnam is a contracting party.

3. The Minister of National Defense shall be responsible before the Prime Minister, National Assembly for state management over the Vietnam Marine Police, and personally direct operations of the Vietnam Marine Police.”

2. To amend and supplement Article 4 as follows:

“Article 4.International transaction name

Its English name used in international relations is Vietnam Marine Police.”

3. To amend and supplement Article 6 as follows:

“Article 6.The Command of Marine Police

1. The Command of Marine Police has the legal entity status, account, and seal with national emblem, is allowed to open account at State Treasury, and has headquarter located in Hanoi; its operational fund is allocated from the state budget and recorded separately in item of total operational funds of the Ministry of National Defense.

2. The Prime Minister shall appoint the commander, political commissar, deputy political commissar, and deputy commanders of Marine Police at the proposal of the Minister of National Defense.”

4. To amend Article 11 as follows:

"Article 11.Vietnam Marine Police’s uniforms

Police badges, straps, insignias, uniforms and ceremonial uniforms of the Vietnam Marine Police comply with the Prime Minister s regulations.”

5. To amend Clause 1 Article 21 as follows:

"Article 21. Implementation organization

1. Annually, the Ministry of National Defense shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance in estimating funds to ensure regular operation of the Vietnam Marine Police.”

Article 2. Change of terms

1. To change phrase “Marine Police Department” into “The Command of Marine Police” at Clause 2 Article 5.

Change phrase “Vietnam Marine Police” in to "Vietnam Marine Police" at Clause 3, and Clause 4 Article 9.

2. To change phrase “Director of Marine Police Department” into “The Commander of Marine Police” at Article 22.

Article 3. Effect and implementation responsibilities

1. This Decree takes effect on October 12, 2013.

2. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, chairpersons of People’s Committees of provinces and central affiliated cities and the Commander of Marine Police shall implement this Decree.
