THE GOVERNMENT
Decree No. 72/2011/ND-CP dated August 23, 2011 of the amending and supplementing a number of articles of the Government's Decree No. 111/ 2005/ND-CP of August 26, 2005, detailing and guiding a number of articles of the Publication Law, which was amended and supplemented under the Government's Decree No. 11/2009/ND-CP of February 10, 2009, and Decree No. 105/2007/ND-CP of June 21, 2007, on printing of non-publication products
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the December 3, 2004
Publication Law which was amended and supplemented under the June 3, 2008 Law Amending and Supplementing a Number of Articles of the Publication Law;
Pursuant to the Government's Resolution No. 71/NQ-CP of December 27, 2010, on simplification of administrative procedures under the management of the Ministry of Information and Communications:
At the proposal of the Minister of Information and Communications,
DECREES:
Article 1. To amend and supplement a number of articles of the Government's Decree No. 111/2005/ND-CP of August 26, 2005, detailing and guiding a number of articles of the Publication Law, which was amended and supplemented under the Government's Decree No. 11/2009/ND-CP of February 10, 2009
1. Clause 2, Article 8 is amended and supplemented as follows:
"2. Other organizations licensed to establish publishing houses, including:
a/ Central political-social-professional organizations directly creating and publicizing works;
b/ Central public non-business units and socio-professional organizations directly creating and publicizing works, which are licensed to establish publishing houses by the Ministry of Information and Communications after obtaining the Prime Minister's consent."
2. To add the following Clause 3 to Article 14:
"3. A dossier of application for a publication printing permit specified in Clause 2, Article 31 of the Publication Law shall be made in 1 (one) set and sent by post or delivery services or directly to the licensing agency specified in Article 15 of this Decree.
The Ministry of Information and Communications shall promulgate the form of the application for a publication printing permit."
3. To add the following Clause 4 to Article 17:
"4. A dossier of application for a permit for printing publications for foreign partiers specified in Clause I, Article 34 of the Publication Law shall be made in 1 (one) set and sent by post or delivery services or directly to the licensing agency specified in Clause 1 of this Article."
Article 2. To amend and supplement a number of articles of the Government's Decree No. 105/2007/ND-CP of June 21, 2007, on printing of non-publication products
1. Article 6 is amended and supplemented as follows:
"Article 6. Method and dossier of application for printing permit
1. Before printing press products or anti-counterfeit stamps, a printing establishment shall compile one (1) set of dossier of application for a printing permit and send it directly or by post or delivery services to the state management agency specified in Clause 1, Article 7 of this Decree.
2. A dossier of application for a printing permit comprises:
a/ An application for a permit (made according to the form promulgated by the Ministry of Information and Communications);
b/ A curriculum vitae of the director or owner of the printing establishment;
c/ Certified copies or copies enclosed with originals of diplomas and certificates, if any, of the director or owner of the printing establishment, for comparison;
d/ Documents proving the availability of the production site; and a list of main printing equipment;
e/ A certified copy or a copy enclosed with the original of any of the following papers: business registration certificate, enterprise registration certificate, investment certificate or printing establishment formation decision issued by the managing agency, for comparison;
f/ A certified copy or a copy enclosed with the original of the certificate of satisfaction of security and order conditions granted by a competent public security agency, for comparison."
2. Clause 1, Article 10 is amended and supplemented as follows:
"1. Printing establishments which receive foreign orders for printing foreign products, including votive paper, newspapers, savings book, passport, identity card, diploma, certificate and anti-counterfeit stamp, shall compile and send dossiers of application for permits to print products for foreign parties by post or delivery service or directly to the competent state management agency specified in Clause 2 of this Article. A dossier shall be made in 1 (one) set, comprising:
a/ An application for a permit (made according to the form promulgated by the Ministry of Information and Communications):
b/ Two copies of the samples of products to be printed under orders:
c/ A certified copy or a copy enclosed with the original of the printing permit or any of the following papers: business registration certificate, enterprise registration certificate, investment certificate or printing establishment formation decision issued by the managing agency, for comparison."
3. Clause 3, Article 11 is amended and supplemented as follows:
"3. Within 5 (five) working days after receiving a complete and valid dossier, the Authority of Publication shall grant a permit; in case of refusal, it shall issue a written reply clearly stating the reason."
4. To replace the phrases "the Ministry of Culture and Information" and "provincial-level Information and Culture Departments" as follows:
a/ To replace the phrase "the Ministry of Culture and Information" in Clause 1, Article 7; Clause 1, Article 9; Clause 2, Article 10; Clause 1, Article 11; Clause 1, Article 14; and Clause 2, Article 20 of Decree No. 105/2007/ND-CP with the phrase "the Ministry of Information and Communications."
b/ To replace the phrase "provincial-level Culture and Information Departments" in Clause 2, Article 5; Clause 1. Article 7; Clauses 2 and 3, Article 10: Clauses 1 and 2, Article 12; and Clause 2. Article 14 of Decree No. 105/2007/ND-CP with the phrase "provincial-level Information and Communications Departments."
Article 3. Effect and implementation responsibility
1. This Decree takes effect on October 10, 2011.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of provincial-level People's Committees shall implement this Decree.-
