Decree 67/2022/ND-CP formulation of master plans on conservation of historical-cultural relics

DECREE

Amending and supplementing Article 4 of the Government’s Decree No. 166/2018/ND-CP of December 25, 2018, providing the competence, order and procedures for formulation, appraisal and approval of master plans and projects on preservation, embellishment and restoration of historical-cultural relics and scenic spots^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 29, 2001 Law on Cultural Heritage; and the June 18, 2009 Law Amending and Supplementing a Number of Articles of the Law on Cultural Heritage;

Pursuant to the June 25, 2015 Law on the State Budget;

Pursuant to the November 24, 2017 Planning Law;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates the Decree amending and supplementing Article 4 of the Government’s Decree No. 166/2018/ND-CP of December 25, 2018, providing the competence, order and procedures for formulation, appraisal and approval of master plans and projects on preservation, embellishment and restoration of historical-cultural relics and scenic spots. 

Article 1. To amend and supplement Article 4 of the Government’s Decree No. 166/2018/ND-CP of December 25, 2018, providing the competence, order and procedures for formulation, appraisal and approval of master plans and projects on preservation, embellishment and restoration of historical-cultural relics and scenic spots, as follows:

“Article 4. Expenses for formulation, appraisal, approval, announcement, adjustment and evaluation of master plans on relics

 Expenses for formulation, appraisal, approval, announcement, adjustment and evaluation of master plans on relics shall be covered by funds reserved for recurrent expenditures in accordance with the law on the state budget”. 

Article 2. Responsibility for organization of implementation

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of all levels, and related organizations and individuals shall implement this Decree.

Article 3. Implementation provisions

1. This Decree takes effect on the date of its signing.

2. Transition provision:

For the tasks of formulating master plans on relics and the master plans on relics that have been approved before the effective date of this Decree, expenses for formulation, appraisal, approval, announcement, adjustment and evaluation of master plans on preservation, embellishment and restoration of relics must continue to comply with Article 9 of the Planning Law.-
