Decree 54/2022/ND-CP amend Decree 78/2016/ND-CP and Decree 08/2021/ND-CP

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 78/2016/ND-CP dated July 01, 2016 prescribing the conditions for provision of training for crewmen and steersmen of inland waterway vessels and the Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 defining the management of inland waterway operations

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Inland Waterway Navigation dated June 15, 2004; Law on Amending and Supplementing a Number of Articles of the Law on Inland Waterway Navigation dated June 17, 2014;

At the proposal of the Minister of Transport;

The Government promulgates the Decree on amending and supplementing a number of articles of the Government’s Decree No. 78/2016/ND-CP dated July 01, 2016 prescribing the conditions for provision of training for crewmen and steersmen of inland waterway vessels and the Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 defining the management of inland waterway operations.

Article 1. To repeal Clause 2 Article 11 of the Government’s Decree No. 78/2016/ND-CP dated July 01, 2016 prescribing the conditions for provision of training for crewmen and steersmen of inland waterway vessels.

Article 2. To amend and supplement a number of articles of the Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 defining the management of inland waterway operations as follows:

1. To amend and supplement Clause 2 Article 65 as follows:

“2. Port authorities under the Vietnam Inland Waterway Administration shall perform the function of specialized state management at inland waterway ports or landing stages (except for cross-river passenger landing stages), anchorage areas that have been announced and licensed to operate on national inland waterways, exclusive inland waterways connected to national inland waterways; inland waterway ports or landing stages, anchorage areas with land areas and water areas both on national inland waterways and local inland waterways; inland waterway ports or landing stages, anchorage areas in seaport waters that are assigned by the Ministry of Transport.”

2. To amend and supplement Clause 3 Article 65 as follows:

“3. Port authorities under provincial-level Departments of Transport, or agencies or units assigned by provincial-level People’s Committees for localities without inland waterway port authorities under provincial-level Departments of Transport shall perform the function of specialized state management at inland waterway ports or landing stages (except for cross-river passenger landing stages), anchorage areas that have been announced and licensed to operate on local inland waterways, exclusive inland waterways connected to local inland waterways; inland waterway ports or landing stages, anchorage areas in seaport waters in administrative boundaries that are assigned by the Ministry of Transport; inland waterway ports or landing stages, anchorage areas specified in Clause 2 of this Article that are decentralized by the Ministry of Transport in accordance with regulations.”

Article 3. Effect and organization of implementation

1. This Decree takes effect on November 01, 2022.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces, centrally-run cities shall be responsible for guiding and implementing this Decree.
