Decree 278/2026/ND-CP amend Decree 72/2025/ND-CP on mechanism and time frame for adjusting the average electricity retail price

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 72/2025/ND-CP dated March 28, 2025, providing regulations on the mechanism and time frame for adjusting the average electricity retail price

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Electricity Law No. 61/2024/QH15;

At the proposal of the Minister of Industry and Trade;

The Government hereby promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 72/2025/ND-CP dated March 28, 2025, providing regulations on the mechanism and time frame for adjusting the average electricity retail price.

Article 1. Amending and supplementing a number of articles of the Government’s Decree No. 72/2025/ND-CP dated March 28, 2025, providing regulations on the mechanism and time frame for adjusting the average electricity retail price

1. To amend and supplement Points a and b, Clause 1, Article 5 as follows:

“a) In case the calculated average electricity retail price decreases by less than 1% or increases by less than 2% as compared with the current average electricity retail price, Vietnam Electricity shall report to the Ministry of Industry and Trade on the non-adjustment of the average electricity retail price and make a dossier to be sent to the Ministry of Industry and Trade for inspection and supervision;

b) In case the calculated average electricity retail price decreases by 1% or more as compared with the current average electricity retail price, or the average electricity retail price needs to be adjusted upward by 2% to less than 5% as compared with the current average electricity retail price, Vietnam Electricity shall make a dossier on the average electricity retail price plan and report it to the Ministry of Industry and Trade for inspection, review, and comments. Within 15 working days from the date of receipt of the complete dossier on the average electricity retail price plan from Vietnam Electricity, the Ministry of Industry and Trade shall provide its written comments on the results of calculation of the electricity price. Vietnam Electricity shall decide on decrease of the average electricity retail price or increase of the average electricity retail price after the Ministry of Industry and Trade gives its written comments. Within 5 working days from the date of adjustment, Vietnam Electricity shall report to the Ministry of Industry and Trade for inspection and supervision;”.

2. To amend and supplement Points a and b, Clause 1, Article 6 as follows:

“a) In case the calculated average electricity retail price decreases by less than 1% or increases by less than 2% as compared with the current average electricity retail price, Vietnam Electricity shall report to the Ministry of Industry and Trade on the non-adjustment of the average electricity retail price and make a dossier to be sent to the Ministry of Industry and Trade for inspection and supervision;

b) In case the calculated average electricity retail price decreases by 1% or more as compared with the current average electricity retail price, or the average electricity retail price needs to be adjusted upward by 2% to less than 5% as compared with the current average electricity retail price, Vietnam Electricity shall make a dossier on the average electricity retail price plan and report it to the Ministry of Industry and Trade for inspection, review, and comments. Within 15 working days from the date of receipt of the complete dossier on the average electricity retail price plan from Vietnam Electricity, the Ministry of Industry and Trade shall provide its written comments on the results of calculation of the electricity price. Vietnam Electricity shall decide on decrease of the average electricity retail price or increase of the average electricity retail price after the Ministry of Industry and Trade gives its written comments. Within 5 working days from the date of adjustment, Vietnam Electricity shall report to the Ministry of Industry and Trade for inspection and supervision;”.

3. To amend and supplement Article 7 as follows:

“Article 7. Inspection of average electricity retail price

1. Inspection of average electricity retail price adjustment

a) If the average electricity retail price needs to be reduced but Vietnam Electricity fails to make such adjustment, the Ministry of Industry and Trade shall request Vietnam Electricity to reduce the average electricity retail price. Vietnam Electricity shall comply with the Ministry of Industry and Trade’s written request within 5 working days from the date of receiving the request;

b) In case an error in the results of calculation of the electricity price is detected during the Ministry of Industry and Trade’s inspection and review of the average electricity retail price plan prepared by Vietnam Electricity under Clause 2, Article 4, and reported under Clause 1, Article 5, and Clause 1, Article 6 of this Decree, the Ministry of Industry and Trade shall request Vietnam Electricity to update and adjust the average electricity retail price plan. Vietnam Electricity shall comply with the Ministry of Industry and Trade’s written request within 5 working days from the date of receiving the request.

2. Annual inspection of implementation of the components of the average electricity retail price

a) Before June 30 of year N, Vietnam Electricity shall report to the Ministry of Industry and Trade on the actual costs of implementation of the components of year N-1 specified in Clause 2, Article 4 of this Decree; the Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with the Ministry of Finance and relevant agencies in, inspecting the actual costs of implementation of the components of year N-1 by Vietnam Electricity. In case of necessity, the Ministry of Industry and Trade may hire an independent consultant to coordinate in conducting the inspection and verification of the actual costs of implementation of the components of year N-1 by Vietnam Electricity;

b) The Ministry of Industry and Trade shall publicly announce the results of inspection of the actual costs of implementation of the components of year N-1 on its web portal;

c) The Minister of Industry and Trade shall prescribe Clause 2 of this Article;

d) In case a competent state agency detects any error in the results of calculation of the average electricity retail price, Vietnam Electricity shall update and adjust the average electricity retail price plan in subsequent adjustments.”.

Article 2. Effect

This Decree takes effect from July 09, 2026.

Article 3. Implementation responsibility

Ministers, heads of ministerial-level agencies, chairpersons of People’s Committees of provinces and centrally-run cities, and related organizations and individuals shall implement this Decree.
