DECREE

Providing the Lists of chemicals specified by the Law on Chemicals

Pursuant to Law No. 63/2025/QH15 on Organization of the Government;

Pursuant to Law No. 69/2025/QH15 on Chemicals;

Pursuant to Law No. 73/2021/QH15 on Drug Prevention and Control;

At the proposal of the Minister of Industry and Trade;

The Government promulgates the Decree providing the Lists of chemicals specified by the Law on Chemicals.

Article 1. Scope of regulation

This Decree provides the Lists of chemicals specified by the Law on Chemicals regarding the development of the chemical industry, chemical activities, and safety and security in chemical activities, specifically Clause 2, Article 6; Point a, Clause 1, Article 9; Point a, Clause 2, Article 9; and Clause 2, Article 37.

Article 2. Subjects of application

Domestic agencies, organizations and individuals and foreign organizations and individuals shall carry out activities relating to the development of the chemical industry, chemical activities, and safety and security in chemical activities within the territory of Vietnam.

Article 3. Lists specified by the Law on Chemicals

To provide the Lists of chemicals specified by the Law on Chemicals in the Appendices to this Decree, including the List of basic chemicals in the key chemical industry sectors (Appendix I); the List of chemicals subject to conditional production and trading (Appendix II); the List of chemicals subject to special control (Appendix III); the List of chemicals requiring the formulation of prevention and response plans for events of chemical hazards (Appendix IV).

Article 4. Effect

This Decree takes effect on the date of its signing.

Article 5. Organization of implementation

1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.

2. Before June 30 every year, ministries and ministerial-level agencies shall, within the ambit of their functions and tasks, review, propose for modification of, and update the Lists of chemicals promulgated together with this Decree, and send them to the Ministry of Industry and Trade. The Ministry of Industry and Trade shall organize impact assessment, summarize and report them to the Government for consideration and decision.

3. Ministries and ministerial-level agencies shall manage chemical activities in the sectors and fields under their management.-
