Decree No. 156/2016/ND-CP dated November 21, 2016 of the Government on amending the Decree No. 27/2007/ND-CP dated February 23, 2007 of the Government on e-transactions in financial activities

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 27/2007/ND-CP of February 23, 2007, on e-transactions in financial activities[1]

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the November 29, 2015 Law on E-Transactions;

At the proposal of the Minister of Finance;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 27/2007/ND-CP of February 23, 2007, on e-transactions in financial activities.

Article 1. To amend and supplement Article 14 of the Government’s Decree No. 27/2007/ND-CP of February 23, 2007, on e-transactions in financial activities, as follows:

“Article 14. Use of digital signatures

1. Digital certificates that are used in digital signatures in financial activities between organizations or individuals and financial agencies: Digital certificates issued by public digital-signature certification service providers; digital certificates issued by providers of certification service of digital signatures specialized for serving agencies of the political system; accredited foreign digital certificates; foreign digital certificates accepted in Vietnam; and foreign digital certificates accepted in international transactions.

The conditions, scope and subjects for using each type of digital certificates in financial activities must comply with the law on digital signatures and digital-signature certification services.

2. Finance agencies participating in e-transactions shall be legally bound by international treaty(ies) on digital signatures to which the Socialist Republic of Vietnam is a signatory.

3. The Ministry of Finance shall specify e-transactions in financial activities under its state management in which the use of digital signatures is compulsory.”

Article 2. Effect

1. This Decree takes effect on January 10, 2017.

2. To annul Clause 5 of Article 3, Article 13, and Points g and h, Clause 1 of Article 16, of Decree No. 27/2007/ND-CP.

3. Ministers, heads of ministerial-level agencies and government-attached agencies, chairpersons of provincial-level People’s Committees and related organizations and individuals shall implement this Decree.-
