SUMMARY

13 decrees are annulled by the Government

The Decree No. 110/2021/ND-CP on annulling a number of legal documents of the Government is promulgated by the Government on December 09, 2021.

To be specific, some decrees related to the industrial property cease to be effective such as: Decree No. 63/CP dated October 24, 1996, detailing the industrial property; Decree No. 06/2001/ND-CP dated February 01, 2001, amending and supplementing a number of articles of Decree No. 63/CP dated October 24, 1996; Decree No. 42/2003/ND-CP dated May 02, 2003, on protection of industrial property rights for layout-designs of semiconductor integrated circuit; etc.

Regarding to the field of taxation, the Decree No. 92/2013/ND-CP dated August 13, 2013, detailing a number of articles, which take effect on July 01, 2013, of the Law Amending and Supplementing a Number of Articles of the Law on Enterprise Income Tax and the Law Amending and Supplementing a Number of Articles of the Law on Value-Added Tax is annulled.

Besides, to annul Decree No. 60/2000/ND-CP dated October 30, 2000, stipulating the execution of the non-custodial reform penalty; Decree No. 61/2000/ND-CP dated October 30, 2000, stipulating the execution of suspended sentences; Decree No. 53/2001/ND-CP dated August 23, 2001, guiding the enforcement of the residence prohibition and probation penalties; etc.

The Decree takes effect on December 15, 2021.

DECREE

Annulling a number of legal documents of the Government

___________

Pursuant to the Law on the Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

At the proposal of the Minister of Justice;

The Government promulgates the Decree annulling a number of legal documents of the Government.

 

Article 1. To annul a number of the Governments’ legal documents

To annul the following decrees:

1. The Government’s Decree No. 63/CP dated October 24, 1996, detailing the industrial property.

2. The Government’s Decree No. 06/2001/ND-CP dated February 01, 2001, amending and supplementing a number of articles of the Government’s Decree No. 63/CP dated October 24, 1996, detailing the industrial property.

3. The Government’s Decree No. 54/2000/ND-CP dated October 03, 2000, on the protection of industrial property rights for business secrets, geographical indications, trade names, and the protection of the rights to repression of unfair competition related to the industrial property.

4. The Government’s Decree No. 60/2000/ND-CP dated October 30, 2000, stipulating the execution of the non-custodial reform penalty.

5. The Government’s Decree No. 61/2000/ND-CP dated October 30, 2000, stipulating the execution of suspended sentences.

6. The Government’s Decree No. 72/2000/ND-CP dated December 05, 2000, on the overseas publication and dissemination of works.

7. The Government’s Decree No. 52/2001/ND-CP dated August 23, 2001, guiding the execution of judicial measure of sending to reformatory schools.

8. The Government’s Decree No. 53/2001/ND-CP dated August 23, 2001, guiding the enforcement of the residence prohibition and probation penalties.

9. The Government’s Decree No. 54/2001/ND-CP dated August 23, 2001, guiding the enforcement of the expulsion penalty.

10. The Government’s Decree No. 42/2003/ND-CP dated May 02, 2003, on protection of industrial property rights for layout-designs of semiconductor integrated circuit.

11. The Government’s Decree No. 140/2006/ND-CP dated November 22, 2006, providing for the environmental protection at stages of elaboration, evaluation, approval and implementation of development strategies, planning, plans, programs and projects.

12. The Government’s Decree No. 10/2012/ND-CP dated February 17, 2012, detailing the implementation of judicial measures on education in communes, wards and townships for minor offenders.

13. The Government’s Decree No. 92/2013/ND-CP dated August 13, 2013, detailing a number of articles, which take effect on July 01, 2013, of the Law Amending and Supplementing a Number of Articles of the Law on Enterprise Income Tax and the Law Amending and Supplementing a Number of Articles of the Law on Value-Added Tax.

Article 2. Implementation provisions

1. This Decree takes effect on December 15, 2021.

2. Ministers, heads of ministerial-level agencies, heads of government- attached agencies, and chairpersons of People’s Committees of provinces and centrally run cities and related agencies and units shall be responsible for implementing this Decree.
