THE GOVERNMENT

Decree No.  106/2013/ND-CP dated September 17, 2013 of the Government on amending and supplementing a number of articles in the Decree No. 05/1999/ND-CP dated February 3, 1999 of the Government on People’s identity card, which was already amended and supplemented in the Government’s Decree No. 170/2007/ND-CP dated November 19, 2007

Pursuant to the Law on organization of Government dated December 25, 2001;

At the proposal of Minister of Public Security;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 05/1999/ND-CP dated February 03, 1999, on the people’s identity card, which was already amended and supplemented by the Government’s Decree No. 170/2007/ND-CP dated November 19, 2007

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 05/1999/ND-CP dated February 03, 1999, on the people’s identity card, which was already amended and supplemented by the Government’s Decree No. 170/2007/ND-CP dated November 19, 2007

1. Amending and supplementing Article 2 of the Government’s Decree No. 05/1999/ND-CP dated February 03, 1999 on the people’s identity card, which was already amended and supplemented by the Government’s Decree No. 170/2007/ND-CP dated November 19, 2007, as follows:

a) To add phrase "Independence - Freedom - Happiness”  under the phrase “the Socialist Republic of Vietnam” in the front side of the people’s identity card.

b) To remove phrases “full name of father”, and “full name of mother” in the back side of the people’s identity card.

2. Amending and supplementing Clause 2 Article 6 of the Government’s Decree No. 05/1999/ND-CP dated February 03, 1999 on the people’s identity card, as follows:

“After fully receiving the valid papers and finishing the procedures as prescribed in Points a and b above, the police office shall have to finish the granting process of people’s identity cards to citizens within the shortest time-limit, which must not exceed 07 working days for case of new grant, renewal,  and 15 working days for case of re-grant in cities, provincial capitals; the time limit does not exceed 20 working days for all cases in rural districts of mountainous, high, border areas and islands; and not exceed 15 working days for grant of the people’s identity cards for remaining areas.

3. Revising words:

a) Phrase of “Law on handling of administrative violations” will supersede phrase of “Ordinance on handling of administrative violations”.

b) Phrase of “compulsory educational facilities” will supersede phrase of “educational facilities”.

c) Phrase of “compulsory detoxification facilities” will supersede phrase of “medical treatment facilities”.

Article 2. Effect and transitional provisions

1. The Decree takes effect on November 02, 2013.

2. People’s identity cards already granted according to the Government’s Decree No. 170/2007/ND-CP dated November 19, 2007 will remain valid till the expired date prescribed by regulations.

Article 3. Responsibilities for implementation

1. The Minister of Public Security shall detail, direct, supervise and speed up the implementation of this Decree.

2. The Ministers, the Heads of the ministerial-level agencies, the Heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and municipalities shall implement this Decree.
