DECREE
Prescribing early childhood education development policies[1]
Pursuant to the June 19, 2015 Law on Organization of the Government;
Pursuant to the April 5, 2016 Law on Children;
Pursuant to the June 14, 2019 Education Law;
At the proposal of the Minister of Education and Training;
The Government promulgates the Decree prescribing early childhood education development polices.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation, subjects of application
1. Scope of regulation
This Decree prescribes early childhood education development policies specified in Clauses 1 and 2, Article 27 and Clause 2, Article 81 of the Education Law.
2. Subjects of application
This Decree applies to nurseries, independent childcare groups; pre-primary schools, independent pre-primary classes; early childhood schools and independent early childhood classes (below collectively referred to as early childhood education institutions); and related organizations and individuals.
Article 2. Interpretation of terms
In this Decree, the terms below are construed as follows:
1. Early childhood education institution in an area where industrial parks exist means an early childhood education institution located in a district-level geographical area where exists an industrial park that has been granted an establishment license by a competent agency in accordance with the law on industrial parks and providing care and education to children of industrial park workers.
2. Independent early childhood education institutions mean other education institutions under the national education system, including independent childcare groups, independent pre-primary classes and independent early childhood classes that have been granted establishment licenses in accordance with law.
3. Semi-boarding service means direct services for children who have lunch and nap at early childhood education institutions.
4. Outside school hours early childhood education service means extra-curricular care, nurturing and education services for early childhood children prescribed by law.
5. Pick-up and drop-off service means the services of transporting early childhood children from home to early childhood education institutions and vice versa.
Chapter II
POLICIES ON INVESTMENT IN AND PRIORITIES FOR DEVELOPMENT OF EARLY CHILDHOOD EDUCATION
Article 3. Policies on investment in development of the network of early childhood education schools and classes
1. To increase central and local budget sources for investment in physical foundations under programs and projects on solidification of early childhood education schools and classes in order to have 1 room/group or class by 2025; to invest in building and adding work items reaching the standards for physical foundations serving early childhood education.
2. To encourage the attraction of social resources for investment in developing physical foundations serving early childhood education in all forms in accordance with law.
3. To reserve land for building early childhood education institutions under local land use plans; to consolidate and develop the network of early childhood education schools and classes in conformity with local socio-economic conditions toward standardization, modernization, socialization and international integration; to universalize early childhood education for five-year-old children.
Article 4. Policies to prioritize development of early childhood education in communes with extremely difficult socio-economic conditions and communes in difficult areas
1. To prioritize central and local funds under programs and projects for building public early childhood education institutions in communes with extremely difficult socio-economic conditions as prescribed by the Prime Minister in order to have 1 room/group or class and meet the requirements of solidification of schools by 2025.
2. Public early childhood education institutions in communes with extremely difficult socio-economic conditions or communes with extreme difficulties in coastal alluvial areas, islands and communes in difficult areas as prescribed by the Prime Minister may receive support from the state budget for cooking meals for children as specified in Clause 3 of this Article.
3. Provision of funding support for cooking meals for children
a/ Funding support for cooking meals for early childhood children shall be calculated based on the number of children provided with meals at the level of at least VND 2,400,000/month/45 children; in case the number of children is indivisible by 45, an additional amount equaling the applicable support level will be provided if the remainder is 20 or higher. An early childhood education institution shall be entitled to a support amount of at most 5 times the above-stated support level per month for at most 9 months per school year.
b/ Method of implementation
Every year, at the time of formulation of state budget estimates, public early childhood education institutions specified in Clause 2 of this Article shall, based on the current number of children, make funding estimates according to regulations and send them to district-level Divisions of Education and Training for summarization and sending to finance agencies of the same level for the latter to appraise and submit them to competent agencies for approval of funds in accordance with the Law on the State Budget.
Article 5. Policies toward people-founded and private independent early childhood education institutions in areas having industrial parks or accommodating a large number of workers
1. Policy beneficiaries
People-founded and private independent early childhood education institutions in areas having industrial parks that have been granted establishment licenses by competent authorities according to regulations and have at least 30% of their children being offspring of industrial park workers.
2. Policy contents
The subjects specified in Clause 1 of this Article may receive one-time support for physical foundations, including utensils, toys, and teaching aids according to the list issued by Ministry of Education and Training, and support for renovatation of physical foundations in direct service of child care, nurturing and education activities. The minimum support level is VND 20 (twenty) million/independent early childhood education institution.
3. Methods of implementation
Based on Clause 2 of this Article, the capacity of local budgets and the number of independent early childhood education institutions in the localities eligible for support, provincial-level People’s Committees shall formulate support plans and schemes, and schemes to inspect the provision and use of funds by such institutions for submission to provincial-people People’s Councils for approval so as to organize the implementation and ensure that the provision of support for independent early childhood education institutions shall be completed before June 30 every year.
Article 6. Policies to encourage organizations and individuals to invest in development of early childhood education
1. Those investing in early childhood education are entitled to preferential land, tax and credit policies and socialization promotion policies as prescribed by law.
2. Those investing in early childhood education are entitled to policies on investment in construction of early childhood education institutions in the form of public-private partnership as prescribed by the law on investment.
3. Public early childhood education institutions may provide a number of off-budget public non-business services, including semi-boarding service, outside school hours early childhood education service and pick-up and drop-off service.
Provincial-level People’s Committees shall, based on local socio-economic conditions, make a list of services, formulate techno-economic norms, and prescribe price brackets and specific service charges for submission to provincial-level People’s Councils for decision and use as basis for implementation.
Chapter III
POLICIES TOWARD EARLY CHILDHOOD CHILDREN
Article 7. Policies to support lunches for pre-primary children
1. Policy beneficiaries
Pre-primary children (except children of small ethnic minority groups specified in the Government’s Decree No. 57/2017/ND-CP of May 9, 2017, prescribing policies on enrollment priorities and learning support for small ethnic minority groups’ pre-primary children, pupils and students) who are learning at pre-primary classes of early childhood education institutions and fall into one of the following cases:
a/ Having one of their parents or caregivers residing or residing permanently in extremely difficult villages, communes with extremely difficult socio-economic conditions or communes with extreme difficulties in coastal alluvial areas or islands as prescribed by the Prime Minister.
b/ Having no nurturing sources prescribed in Clause 1, Article 5 of the Government’s Decree No. 136/2013/ND-CP of October 21, 2013, prescribing social assistance policies for social protection beneficiaries.
c/ Being members of poor families or families living just above the poverty line as prescribed by the Prime Minister.
d/ Being offspring of fallen heroes, heroes of the people’s armed forces, war invalids, those entitled to social policies like war invalids, and diseased soldiers; or other social beneficiaries prescribed in the Ordinance on Preferential Treatment toward People with Meritorious Services to the Revolution (if any).
dd/ Being children with disabilities participating in inclusive education.
2. Policy contents
The children specified in Clause 1 of this Article are entitled to a lunch support amount of VND 160,000/child/month. The support entitlement period shall be calculated based on the number of months of actual attendance, which must not exceed 9 months/school year.
3. Dossier
a/ The parents or caregiver or nurturer of a child specified at Point a, Clause 1 of this Article shall submit one of the following papers:
- A copy, enclosed with the original for comparison, or a certified copy of the household registration book or information on personal identification number of the child or his/her parent or caregiver or nurturer;
- A written certification by a public security office on the registration of permanent residence for the child (in case the household registration book is lost).
b/ The parents or caregiver or nurturer of a child specified at Point b, Clause 1 of this Article shall submit one of the following papers:
- A copy, enclosed with the original for comparison, or a certified copy of the decision on social welfare benefits issued by the chairperson of a district-level People’s Committee;
- A copy, enclosed with the original for comparison, or a certified copy of a written certification by a commune-level People’s Committee or social protection establishment on the child’s status of orphanhood or being abandoned or falling into other cases specified in Clause 1, Article 5 of the Government’s Decree No. 136/2013/ND-CP of October 21, 2013, prescribing social assistance policies for social protection beneficiaries;
- A copy, enclosed with the original for comparison, or a certified copy of the certificate of child adoption, for orphans, abandoned children or children falling in other cases specified in Clause 1, Article 5 of the Government’s Decree No. 136/2013/ND-CP of October 21, 2013, prescribing social assistance policies for social protection beneficiaries.
c/ The parents or caregiver or nurturer of a child specified at Point c, Clause 1 of this Article shall submit a copy, enclosed with the original for comparison, or a certified copy of the certificate or written certification of poor household or household living just above the poverty line issued by a commune-level People’s Committee.
d/ The parents or caregiver or nurturer of a child specified at Point d, Clause 1 of this Article shall submit copies, enclosed with the originals for comparison, or certified copies of the written certification issued by the agency managing people with meritorious services to the revolution specified at Point d, Clause 1 of this Article and the child’s birth certificate.
dd/ The parents or caregiver or nurturer of a child specified at Point dd, Clause 1 of this Article shall submit a copy, enclosed with the original for comparison, or a certified copy of the written certification of disability issued by a commune-level People’s Committee or the decision on the grant of social assistance issued by the chairperson of a district-level People’s Committee.
4. Order and time of implementation
In August every year, early childhood education institutions shall widely disseminate and guide parents, caregivers or nurturers of children entitled to lunch support policies to submit dossiers of request for lunch support;
Within 15 working days after being informed by an early childhood education institution, the child’s parent, caregiver or nurturer shall send directly or by post or online 1 set of the dossier specified in Clause 3 of this Article to the early childhood education institution. One applicant shall submit 1 set of dossier for the first-time request for support for the entire period of learning at the institution. Particularly the subjects specified at Point c, Clause 1 of this Article shall submit the certificate of poor household or household living just above the poverty line for each school year;
The early childhood education institution shall receive and examine the dossier. If the dossier contains a copy not yet certified by a competent authority, the dossier recipient shall compare the copy with the original, sign in the copy for certification and include it in the dossier or request dossier supplementation if the dossier is incomplete or invalid. After receiving a complete and valid dossier, the early childhood education institution shall give a dossier receipt to the child’s parent or caregiver. If finding the dossier which is sent by post or online invalid, within 5 working days, the early childhood education institution shall send a notice of refusal to receive the dossier, stating the reason thereof to the child parent, caregiver or nurturer;
Within 10 working days from the deadline for dossier receipt, the early childhood education institution shall make a list of pre-primary children eligible for lunch support (Form No. 1 provided in the Appendix to this Decree) and send such list, together with the dossiers specified in Clause 3 of this Article, to its managing district-level Division of Education and Training for consideration and summarization;
Within 7 working days after receiving a dossier from the early childhood education institution, the district-level Division of Education and Training shall appraise the dossier and summarize the list of children eligible for lunch support (Form No. 02 provided in the Appendix to this Decree) and send it to the same-level finance agency for submission to the concerned district-level People’s Committee for issuance of an approval decision under the Law on the State Budget;
Within 7 working days after receiving a dossier from the district-level Division of Education and Training, the district-level People’s Committee shall approve the list of eligible children and notify the results to the early childhood education institution;
After obtaining approval of the list of children eligible for such support from the competent authority, the early childhood education institution shall publicize and organize the provision of lunch support.
5. Method of implementation
a/ Payment of lunch support funding shall be made twice in a school year with the first time for full four months of the school year in November or December every year and the second time for the remaining months of the school year in March or April every year.
b/ Leaders of early childhood education institutions shall, based on the management and lunch provision methods they are applying, reach agreement with parent representative boards to select either of the following methods:
- Method 1: Early childhood education institutions shall retain support funding for organizing lunches for children (for early childhood education institutions that cook lunches for children);
- Method 2: Early childhood education institutions shall directly pay funding in cash to children’s parents, caregivers or nurturers as specified at Point a, Clause 5 of this Article.
Early childhood education institutions shall receive lunch support funding and make payments. Leaders of early childhood education institutions shall, based on the management and lunch provision methods they are applying, reach agreement with parent representative boards to decide to select either of the above methods.
c/ Children’s parents, caregivers or nurturers who have not received lunch support funding within the time limit specified at Point a, Clause 5 of this Article shall receive retrospective payment of such funding in the subsequent payment term.
d/ In case a child is transferred to another school, his/her early childhood education institution shall return the dossier of request for lunch support to his/her parent, caregiver or nurturer. The early childhood education institution which will receive the child shall report such case to the concerned district-level Division of Education and Training for the latter to propose the chairperson of the district-level People’s Committee to issue a decision on transfer of funding or grant of additional funding to the former to make payment of lunch support funding as prescribed at Point a, Clause 5 of this Article.
dd/ In case a child drops out of school, his/her early childhood education institution shall report such to the concerned district-level Division of Education and Training for the latter to propose the district-level People’s Committee to cease the payment.
Article 8. Allowance policies toward early childhood children being offspring of industrial park workers
1. Policy beneficiaries
Children who are learning in people-founded and private early childhood education institutions that have been granted establishment licenses by competent agencies and are operating under regulations and whose parents, caregivers or nurturers are industrial park workers working under labor contracts signed with enterprises under regulations.
2. Policy contents
The children specified in Clause 1 of this Article shall be provided with a minimum support amount of VND 160,000/child/month. The support entitlement period shall be calculated based on the number of months of actual learning but must not exceed 9 months/school year.
The support level shall be formulated by provincial-level People’s Committees in conformity with local budgets’ capacity and submitted to the same-level People’s Councils for consideration and decision.
3. A dossier must comprise:
a/ A written request for allowances for early childhood children being offspring of industrial park workers (Form No. 3 provided in the Appendix to this Decree), certified by the employer of the child’s parent, caregiver or nurturer;
b/ The birth certificate or household registration book or written certification of temporary residence of the child (copy enclosed with the original for comparison or certified copy).
4. Order, time and methods of implementation
a/ Order and time of implementation
In August every year, early childhood education institutions shall widely disseminate and guide parents, caregivers or nurturers of children who are policy beneficiaries to submit dossiers of request for allowance;
Within 15 working days after being informed by an early childhood education institution, the child’s parent, caregiver or nurturer shall send directly or by post or online 1 set of dossier specified in Clause 3 of this Article to the early childhood education institution.
The early childhood education institution shall receive and examine the dossier. If the dossier contains a copy not yet certified by a competent authority, the dossier recipient shall compare the copy with the original, sign in the copy for certification and include it in the dossier or request dossier supplementation if the dossier is incomplete or invalid. After receiving a dossier, the early childhood education institution shall give a dossier receipt to the child’s parent, caregiver or nurturer. If finding the dossier sent by post or online invalid, within 5 working days, the early childhood education institution shall make a notice of refusal to receive the dossier, stating the reason thereof to the child’s parent, caregiver or nurturer;
Within 10 working days from the deadline for dossier receipt, the early childhood education institution shall make a list of children eligible for allowances and send it, together with the dossiers specified in Clause 3 of this Article, to its managing district-level Division of Education and Training for consideration and summarization; the at-law representative of the people-founded or private early childhood education institution shall be fully responsible for the list of eligible children;
Within 7 working days after receiving a dossier from an early childhood education institution, the concerned district-level Division of Education and Training shall appraise the dossier and summarize the list of children eligible for allowances and send them to the same-level finance agency for submission to the district-level People’s Committee for issuance of an approval decision as prescribed in the Law on the State Budget;
Within 7 working days after receiving a dossier from the district-level Division of Education and Training, the district-level People’s Committee shall approve the list of eligible children and notify the results to the early childhood education institution;
After obtaining approval of from the competent authority, the early childhood education institution shall publicize the list of eligible children.
b/ Method of implementation
Early childhood education institutions shall receive funds and pay allowances in cash directly to children’s parents, caregivers or nurturers;
Payment of allowances shall be made twice in a school year with the first time for full four months of the school year in November or December every year and the second time for the remaining months of the school year in March or April every year;
Children’s parents, caregivers or nurturers having not received education allowances within the prescribed time limit shall receive retrospective payment of such allowances in the subsequent payment term;
In case a child drops out of school, his/her early childhood education institution shall report such to the district-level Division of Education and Training for the latter to propose the district-level People’s Committee to cease payment of allowances.
Chapter IV
POLICIES TOWARD EARLY CHILDHOOD TEACHERS
Article 9. Policies toward early childhood teachers teaching combined classes or Vietnamese language intensification classes for ethnic minority children
1. Policy beneficiaries
Early childhood teachers teaching in separate places of public early childhood education institutions in extremely difficult villages, communes with extremely difficult socio-economic conditions, communes with extreme difficulties in coastal alluvial areas or islands or communes in difficult areas as prescribed by the Prime Minister and meeting one of the following conditions:
a/ Directly teaching 2 sessions/day at childcare groups or pre-primary classes combining two or more age groups.
b/ Directly teaching to intensify Vietnamese language for childcare groups or pre-primary classes of ethnic minority children.
2. Policy contents
Early childhood teachers falling into the cases specified in Clause 1 of this Article are entitled to an additional support amount of VND 450,000/month (four hundred and fifty thousand Vietnam dong per month). A teacher’s support entitlement period shall be calculated based on the number of his/her months of actual teaching but must not exceed 9 months/school year.
The support amount shall be paid together with teachers’ monthly salary and not be included in amounts used for calculation of social insurance, health insurance and unemployment insurance benefits.
3. Method of implementation
Every year, at the time of formulation of state budget estimates, early childhood education institutions shall make a list of teachers eligible for support policy (Form No. 4 provided in the Appendix to this Decree) and send it to the district-level Division of Education and Training for summarization and sending to the same-level finance agency for the latter to appraise and submit them to the competent authority for approval of funds for implementation in accordance with the Law on the State Budget.
For an early childhood education institution under a provimcial-level Department of Education and Training or another agency, its principal shall submit a list of teachers eligible for support policy to the school’s direct superior managing agency and concurrently to the district-level Division of Education and Training of the locality where the school is located for monitoring and summarization.
Article 10. Policies toward early childhood teachers teaching at people-founded and private early childhood education institutions in areas where exist industrial parks
1. Policy beneficiaries
Early childhood teachers teaching at people-founded and private early childhood education institutions that have been granted establishment licensed by competent agencies and are operating under regulations in areas where exist industrial parks and meet the following conditions:
- Possessing the early childhood teacher title training qualification as prescribed;
- Having signed labor contracts with at-law representatives of people-founded or private early childhood education institutions;
- Being directly engaged in provision of care and education to children of childcare groups/pre-primary classes with 30% or more of children being offspring of industrial park workers.
2. Policy contents
Early childhood teachers meeting the conditions specified in Clause 1 of this Article are entitled to a minimum support amount of VND 800,000/month (eight hundred thousand Vietnam dong per month).
The number of teachers of people-founded and private early childhood education institutions shall be calculated based on current norms applicable to public early childhood education institutions.
The support entitlement period for a teacher shall be calculated based on the number of his/her months of actual teaching in a school year. The support amount shall be neither included in the wage level already agreed between the owner of a people-founded or private early childhood education institution and the teacher nor used for calculation of social insurance, health insurance and unemployment insurance benefits.
The support level shall be formulated by provincial-level People’s Committees in conformity with local budget capacity and submitted to People’s Councils of the same level for consideration and decision.
3. Dossiers and order for implementation
a/ A dossier must comprise:
- The list of policy beneficiaries (Form No. 05 provided in the Appendix to this Decree);
- Copies, enclosed with the originals for comparison, or certified copies of the policy beneficiaries’ labor contracts.
b/ Order of implementation
In August every year, an at-law representative of a people-founded or private early childhood education institution shall send 1 set of dossier specified at Point a, Clause 3 of this Article directly or by post or online to the district-level Division of Education and Training;
Within 10 working days after receiving a dossier from an early childhood education institution, the district-level Division of Education and Training shall appraise the dossier, summarize the list of policy beneficiaries and sent it to the finance agency of the same level for appraisal, and report to the competent agency for approval in accordance with the Law on the State Budget.
Within 7 working days after receiving a dossier from the district-level Division of Education and Training, the district-level People’s Committee shall approve the list of policy beneficiaries and notify the results to the early childhood education institution;
After obtaining approval from the competent authority, the early childhood education institution shall publicize the list of policy beneficiaries.
c/ Method of implementation
Early childhood education institutions shall receive funds and pay support in cash directly to teachers or transfer to the latter’s accounts.
The payment shall be made twice in a school year with the first time in December every year and the second time for the remaining months of the school year in May every year.
Teachers who have not received support funding in the prescribed time limit shall have their support funding retrospectively paid in the next payment period;
In case a teacher quits his/her job, the concerned early childhood education institution shall report such to the district-level Division of Education and Training for the latter to propose the district-level People’s Committee to cease the payment of support to the teacher.
Article 11. Policy on provision of support in terms of documents and training costs for teachers of people-founded and private early childhood education institutions
1. Policy beneficiaries
Early childhood teachers (including also principals, vice principals, heads of groups and persons in charge of professional operations) who are working at people-founded and private early childhood education institutions that have been granted establishment licenses by competent agencies and are operating under regulations.
2. Policy contents
Early childhood teachers specified in Clause 1 of this Article are entitled to the State’s support in terms of documents and training costs upon the former’s participation in training and refresher training courses to improve their professional qualifications. The budget support level shall be made based on the support level for teachers of public education institutions who have the same qualifications and take part in professional training and refresher training courses.
Every year, based on the district-level Division of Education and Training’s training and refresher training plan, people-founded and private early childhood education institutions shall make lists of teachers who will take part in training and refresher training courses and send them to the district-level Division of Education and Training. The district-level Division of Education and Training shall summarize, formulate and submit the estimates to competent authorities for approval and implementation under regulations.
Chapter V
ORGANIZATION OF IMPLEMENTATION
Article 12. Funding sources and management of funds
1. Funds for implementation of the policies specified in this Decree comprise:
a/ The state budget, including local budgets and central budget supports for localities in accordance with the Law on the State Budget and the Law on Public Investment and current guiding documents.
- Local budgets shall be used for implementation of the policies specified in Articles 5, 8, 10 and 11 of this Decree.
- The central budget supports for local budgets shall be used for implementation of the policies specified in Articles 4, 7 and 9 of this Decree.
b/ Funds mobilized from the society for education and other lawfully mobilized sources.
2. The estimation, management, use and finalization of funds must comply with current provisions of the Law on the State Budget, the Accounting Law, and the Law on Public Investment and current guiding documents.
Article 13. Responsibilities of ministries and branches
1. The Ministry of Education and Training shall
a/ Assume the prime responsibility for, and coordinate with related ministries and sectors in, directing localities to implement this Decree;
b/ Inspect and evaluate the implementation of this Decree under regulations.
2. The Ministry of Finance shall ensure funds for the implementation of the policies specified in this Decree according to current budget decentralization regulations.
3. The Ministry of Planning and Investment shall assume the prime responsibility for summing up and submitting to the Government and Prime Minister medium-term and annual public investment plans for implementation of programs and projects on consolidation of physical foundations of early childhood education institutions approved by competent agencies under the Law on Public Investment and guiding documents.
4. Related ministries and sectors shall, within the ambit of their assigned functions and tasks, coordinate with the Ministry of Education and Training in directing localities to implement this Decree.
5. The Vietnam Fatherland Front Central Committee and its member organizations shall coordinate in disseminating, mobilizing, urging, supervising and proposing the implementation of the policies in accordance with this Decree on the basis of their assigned functions and tasks.
Article 14. Responsibilities of provincial-level People’s Committees
1. To direct and guide the implementation of these policies in their localities in accordance with this Decree; to inspect and supervise the implementation and report the implementation results on an annual basis to the Ministry of Education and Training and related ministries and sectors.
2. To ensure funds for the implementation of these policies in accordance with this Decree.
3. To formulate annual budget estimates, report to provincial-level People’s Councils for decision solutions to balance financial resources for the implementation of these policies in their localities; to organize inspection and audit of the execution of budget estimates and budget finalization by their affiliated budget-estimating units in accordance with the Law on the State Budget, and the Law on Public Investment and current guiding documents.
Chapter VI
IMPLEMENTATION PROVISIONS
Article 15. Effect
1. This Decree takes effect on November 1, 2020.
2. The Government’s Decree No. 06/2018 of January 5, 2018, prescribing lunch support policy for pre-primary children and policies for early childhood teachers, ceases to be effective on the effective date of this Decree.
3. Policies for early childhood teachers specified in Clause 1, Article 7 and Clause 1, Article 8 of the Government’s Decree No. 06/2018 of January 5, 2018, prescribing lunch support policy for pre-primary children and policies for early childhood teachers, shall be implemented until the end of 2021.
Article 16. Implementation responsibility
1. The Minister of Education and Training shall organize the implementation of the policies specified in this Decree.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related organizations and individuals shall implement this Decree.-
