DECISION
PROMULGATING THE REGULATION ON STANDARDS, INSPECTION, APPRAISAL AND RECOGNITION OF JUNIOR SECONDARY EDUCATION UNIVERSALIZATION
THE MINISTER OF EDUCATION AND TRAINING
Pursuant to the Government’s Decree No. 29/CP of March 30, 1994 on the tasks, powers and organizational structure of the Ministry of Education and Training;
Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to Resolution No. 41/2000/QH10 of December 9, 2000 of the Xth National Assembly, 8th session;
At the proposal of the director of the Senior Secondary Education Department,
DECIDES:
Article 1.- To promulgate together with this Decision the Regulation on standards, inspection, appraisal and recognition of junior secondary education universalization.
Article 2.- This Decision takes effect 15 days after its signing.
Article 3.- The presidents of the People’s Committees of the provinces and centrally-run cities, the director of the Ministry’s Office, the director of the Organization and Personnel Department, the director of the Planning and Finance Department, the director of the Secondary Education Department, the director of the Continued Education Department and the concerned departments, and directors of the provincial/municipal Education and Training Services shall have to implement this Decision.

REGULATION
ON STANDARDS, INSPECTION, APPRAISAL AND RECOGNITION OF JUNIOR SECONDARY EDUCATION UNIVERSALIZATION
(Promulgated together with Decision No. 26/2001/QD-BGDDT of July 5, 2001 of the Minister of Education and Training)
Chapter I
JUNIOR SECONDARY EDUCATION UNIVERSALIZATION STANDARDS
Article 1.- Subjects of the junior secondary education universalization
Subject to the junior secondary education universalization are youngsters and juveniles aged between 11 and full 18 years, who have graduated from primary schools but not yet graduated from junior secondary schools, and have permanent residence or long-term temporary residence registrations in localities.
Article 2.- Programs of the junior secondary education universalization
The junior secondary education universalization shall be materialized through either one of the following two programs:
The junior secondary education program or the complementary junior secondary education program promulgated by the Ministry of Education and Training.
Article 3.- Standards for recognizing junior secondary education universalization
1. For individuals:
Youngsters and juveniles, who are recognized as reaching the junior secondary education universalization standard, must possess junior secondary education graduation certificates or complementary junior secondary education graduation certificates before attaining full 18 years.
2. For grassroots units (communes, wards, district townships):
Grassroots units, which are recognized as reaching the junior secondary education universalization standard, must attain both the following criteria:
a/ Criterion 1:
- Having attained and sustained the national standards on junior secondary education universalization and anti-illiteracy. Having mobilized 90% or more of 6-year-old children to go to grade 1; at least 80% of children aged between 11 and 14 years have graduated from primary schools while the rest of them are studying at primary schools. For communes meeting with difficult socio-economic conditions and particularly difficult socio-economic conditions, having mobilized 80% or more of 6-year-old children to go to grade 1 and at least 70% of children aged between 11 and 14 years have graduated from primary schools while the rest of them are studying at primary schools.
- Mobilizing 95% or more of pupils who graduate from primary schools every year into 6th grade of junior secondary education and complementary junior secondary education. For communes meeting with difficult socio-economic conditions and particularly difficult socio-economic conditions, mobilizing 80% or more.
- Educational establishments must ensure the conditions of material foundations for teaching all the study subjects of the programs specified in Article 2 of this Regulation.
b/ Criterion 2:
- 90% or more of pupils graduate from junior secondary schools every year; for communes meeting with difficult or particularly difficult socio-economic conditions: 75% or more.
- 80% or more of youngsters and juveniles aged between 15 and full 18 years obtain certificates of graduation from junior secondary schools or complementary junior secondary schools; for communes meeting with difficult or particularly difficult socio-economic conditions: 70% or more. These are called the rate of attaining the junior secondary education universalization standard and calculated as follows:
Total number of people aged between 15 and full 18 years having graduated from junior secondary schools or complementary junior secondary schools
Total number of people aged between 15 and full 18 years who are subject to the junior secondary education universalization
3. For rural districts, urban districts and provincial capitals and towns:
Rural districts, urban districts and provincial capitals and towns, which are recognized as reaching the junior secondary education universalization standard must meet the following two criteria:
a) Having attained and sustained the national standards on junior secondary education universalization and anti-illiteracy.
b) 90% or more of grassroots units (communes, wards and district townships) are recognized as reaching the prescribed standard at the time of inspection.
4. For the provinces and centrally-run cities:
100% of rural districts, urban districts, provincial capitals and towns reach the junior secondary education universalization standard at the time of inspection.
Chapter II
INSPECTION, APPRAISAL AND RECOGNITION
Article 4.- Inspection
Basing themselves on the above-said criteria, the grassroots units shall inspect and appraise themselves and finalize dossiers as prescribed, then make reports requesting the superior managing authorities to directly conduct the inspection and recognition.
The inspection and recognition of units as reaching the junior secondary education universalization standard shall be made according to the following order:
1. The district-level People’s Committees shall inspect and issue recognition decisions to grassroots units (communes, wards and district townships).
2. The provincial/municipal People’s Committees shall inspect and issue recognition decisions to rural districts, urban districts, provincial capitals and towns.
3. The Ministry of Education and Training shall inspect and issue recognition decisions to the provinces and centrally-run cities.
Article 5.- Dossiers for recognizing the attainment of junior secondary education universalization standard
1. Dossier for recognition of grassroots units comprises:
a) Book for monitoring primary education universalization and book for monitoring the junior secondary education universalization.
b) Table of names of pupils who have graduated from primary schools and their graduation marks and table of names of pupils who have graduated from junior secondary schools or complementary junior secondary schools and their graduation marks of the three previous school years.
c) Table of general statistics on pupils of the age bracket subject to the junior secondary education universalization and the results thereof.
d) Report on the process of directing the junior secondary education universalization and the results thereof.
2. Dossier for recognition of district and provincial units comprises:
a) Table of general statistics on pupils of the age bracket subject to the junior secondary education universalization and the results thereof achieved by the inspected units.
b) Written record on inspection and recognition of attached units.
c) The locality�s written instructions on junior secondary education universalization.
d) Report on the situation and result of junior secondary education universalization in the locality.
e) Decision recognizing attached units standard attainment.
