DECISION
PROVISIONALLY PROVIDING FOR THE COLLECTION, REMITTANCE, MANAGEMENT AND USE OF CHARGES FOR THE APPROVAL OF SHIP SECURITY PLANS, THE ASSESSMENT AND GRANT OF SHIP SECURITY CERTIFICATES UNDER THE INTERNATIONAL CODE FOR THE SECURITY OF SHIPS AND OF PORT FACILITIES
THE MINISTER OF FINANCE
Pursuant to the 2002 amendments to the International Convention for the Safety of Life at Sea, enclosed with the International Code for the Security of Ships and of Port Facilities;
Pursuant to Resolution No. 5 of December 12, 2002, on promoting technical cooperation and assistance, of the International Conference for the Safety of Life at Sea;
Pursuant to the August 28, 2001 Ordinance on Charges and Fees and the Government's Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;
Pursuant to the Government's Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, duties, powers and organizational structure of the Ministry of Finance;
After obtaining the Transport Ministry's opinions (in Official Letter No. 3643/GTVT-TC of July 19, 2004);
At the proposal of the director of the Tax Policy Department,
DECIDES:
Article 1.- To promulgate the rates of charges for the approval of ship security plans, the assessment and grant of ship security certificates under the International Code for the Security of Ships and of Port Facilities as follows:

Of which:
- Class-I ships include cargo ships of 500 GT or more.
- Class-II ships include passenger ships, chemical-transporting ships, oil-transporting ships, liquefied gas-transporting ships, offshore mobile drilling rigs.
2. The charge rates for the approval of ship security plans and the assessment and grant of ship security certificates defined in Clause 1 of this Article are inclusive of value added tax.
Article 2.- Shipping companies that own ships employed for international transportation, when applying for the approval of ship security plans or the assessment and grant of ship security certificates under the International Code for the Safety of Ships and of Port Facilities, the Transport Minister's Decision No. 170/2004/QD-BGTVT of January 16, 2004, on the implementation of the 2002 amendments to the International Convention for the Safety of Life at Sea (SOLAS 74), enclosed with the International Code for the Security of Ships and of Port Facilities, must pay charges therefor at the rates set in Article 1 of this Decision.
Article 3.- Vietnam Register and units assigned by the Transport Ministry to approve ship security plans and assess or grant ship security certificates shall collect charges therefor according to the provisions of this Decision.
Article 4.- The collected amount of charges for the approval of ship security plans and the assessment or grant of ship security certificates constitutes a revenue of registry activities, which shall be managed and used by Vietnam Register according to current financial regulations applicable to registry activities.
Article 5.- This Decision takes effect 15 days after its publication in "CONG BAO."
Article 6.- Charge payers, charge-collecting agencies and concerned agencies shall have to implement this Decision.
