Decision No. 921/QD-TTg of June 12, 2013, on transfer of the responsibility for monitoring the promulgation of documents detailing the implementation of laws and ordinances.

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the Government’s Decrees: No. 24/2009/ND-CP, detailing and providing measures for the implementation of the Law on Promulgation of Legal Documents; No. 59/2012/ND-CP on  monitoring law implementation; and No. 22/2013/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Justice;

At the proposal of the Minister-Chairperson of the Government Office and the Minister of Justice;

DECIDES:

Article 1. To transfer the responsibility for monitoring the promulgation of documents detailing the implementation of laws and ordinances from the Government Office to the Ministry of Justice on July 1, 2013.

Article 2. Organization of implementation

1. Responsibilities of the Ministry of Justice

a/ To advise the Government and the Prime Minister on policies and solutions to ensure  the quality and progress of promulgating documents detailing the implementation of laws and ordinances; to remedy the late promulgation of documents;

b/ To assume the prime responsibility for, and coordinate with the Government Office in, constantly monitoring, urging, examining and assessing the drafting and promulgation of documents of the Government, the Prime Minister, ministers and heads of ministerial-level agencies detailing the implementation of laws and ordinances; to make monthly, biannual and annual reports at the Government’s regular meetings, and irregular reports to the Prime Minister about the late promulgation of documents detailing the implementation of laws and ordinances which have taken effect;

c/ To assume the prime responsibility for, and coordinate with the Government Office and related ministries and sectors in, assisting the Government and the Prime Minister in preparing explanation reports to the National Assembly, the National Assembly Standing Committee, the Ethnic Minorities Council and the Committees of the National Assembly; to assist the Prime Minister in preparing responses to questions of National Assembly deputies on the promulgation of documents detailing the implementation of laws and ordinances;

d/ In 2013, to promulgate a circular on the process and measures to perform the tasks, powers and responsibilities for monitoring the promulgation of documents detailing the implementation of laws and ordinances.

2. The Government Office shall further assume the prime responsibility for, and coordinate with the Ministry of Justice and related ministries and sectors in, drawing up and submitting to the Prime Minister for promulgation a list of documents detailing the implementation of laws and ordinances, which fall under the promulgating competence of the Government and the Prime Minister.

3. Before July 1, 2013, the Government Office shall complete the handover of dossiers, records and documents related to the monitoring of the promulgation of documents detailing the implementation of laws and ordinances to the Ministry of Justice.

Article 3. This Decision takes effect on the date of its signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
