Decision No. 89/2005/QD-BTC dated December 08, 2005 of the Ministry of Finance amending and supplementing maritime safety maintenance charge rates specified in the Finance Minister's Decision No. 88/2004/QD-BTC dated November 19, 2004, promulgating maritime charge and fee rates

DECISION

AMENDING AND SUPPLEMENTING MARITIME SAFETY MAINTENANCE CHARGE RATES SPECIFIED IN THE FINANCE MINISTER'S DECISION No. 88/2004/QD-BTC OF NOVEMBER 19, 2004, PROMULGATING MARITIME CHARGE AND FEE RATES

THE MINISTER OF FINANCE

Pursuant to the Vietnam Maritime Code;

Pursuant to August 28, 2001 Ordinance No. 38/2001/PL-UBTVQH10 on Charges and Fees;

Pursuant to the Government's Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Pursuant to the Government's Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;

At the proposal of the Ministry of Transport in Official Letter No. 6669/BGTVT-TC of October 25, 2005,

DECIDES:

Article 1.- To amend and supplement a number of points in the Finance Minister's Decision No. 88/2004/QD-BTC of November 19, 2004, promulgating maritime charge and fee rates, as follows:

1. Point 1-II, Section B, Part II is amended and supplemented as follows:

For ships entering or leaving seaports or specialized oil and gas ports for transit to Cambodia, maritime safety maintenance charges shall be paid as follows:

From January 1, 2006 to December 31, 2006, maritime safety maintenance charge rates shall be equal to 90% of the rates set in this Table.

From January 1, 2007, maritime safety maintenance charge rates shall be equal to 75% of the rates set in this Table.

2. Item 1.2, Point 1-III of Part III is amended and supplemented as follows: The pilotage rate applicable to Binh Tri-Hon Chong region is VND 40/GT-HL, the minimum rate is VND 500,000/ship/entry or leaving.

Article 2.- This Decision takes effect 15 days after its publication in "CONG BAO." Maritime charge and fee-payers and -collecting agencies and organizations, and concerned units shall have to implement this Decision.
