ISSUING THE REGULATION ON GENERAL TECHNICAL REQUIREMENTS FOR THE TECHNOLOGY PROCESS IN ASSEMBLING MOTORBIKES IN IKD FORM
THE MINISTER OF INDUSTRY
Pursuant to Decree No.74/CP of November 1st, 1995 of the Government on the function, tasks, powers and organizational structure of the Ministry of Industry;
Pursuant to the guiding opinion of the Prime Minister in Official Dispatch No. 631/CP-KTTH of June 19, 1999 on the situation in the production and the need in motorbikes;
Basing himself on the agreement of the Ministry of Science, Technology and Environment, the Ministry of Communications and Transport and the Ministry of Trade;
At the proposals of the Head of the Department for Technology and Product Quality Management and the Head of the Planning and Investment Department,
DECIDES:
Article 1.- To issue together with this Decision the "Regulation on General Technical Requirements for the technology process in assembling motorbikes in IKD form".
Article 2.- The Regulation takes effect after its signing.
The Director of the Ministry Office, the Chief Inspector of the Ministry, the department heads and the Head of the Department for specialized State management under the Ministry and the enterprises equipped with processes of assembling of motorbikes in IKD form shall have to implement this Decision.

REGULATION
ON GENERAL TECHNICAL REQUIREMENTS FOR THE TECHNOLOGY PROCESS IN ASSEMBLING MOTORBIKES IN IKD FORM
(issued together with Decision No. 60/1999/QD-BCN of September 8, 1999 of the Minister of Industry )
1. Objects under regulation
This Regulation applies to all enterprises of all economic sectors set up under Vietnamese law and lays down the common technical requirements for the technology process in assembling motorbikes from imported brand-new parts and components to parts and components manufactured in the country in IKD form of production and assembly.
This Regulation does not apply to the enterprises with foreign investments.
2. General provision
2.1. The criteria of the forms of production and assembly of motorbikes mentioned in this Regulation shall be applied according to Decision No. 648/1999/QD-BKHCNMT of April 17, 1999 of the Ministry of Science, Technology and Environment.
2.2. The method of calculating the rate of localization for motorbikes shall uniformly apply under Joint Circular No. 176/1998/TTLT-BTC-BCN-TCHQ of December 25,1998 of the Ministry of Finance, the Ministry of Industry, the General Customs Department; Circular No. 01/1999/TT-BCN of March 12, 1999 of the Ministry of Industry guiding the registration and recognition of the conditions for application of the rate of import tax based on the rate of localization.
3. Main requirements for technology process in the assembly of motorbikes
3.1. The establishment must have a technology process in assembling and inspecting motorbikes corresponding with the approved investment project and not contrary to this Regulation. The plan of the technology floor of the assembly workshop must be rationally arranged according to the sectors: group assembly, overall assembly and final inspection.
3.2. The main equipment, tools and devices which are necessarily invested in the assembly comprise:
- The assembly process in accordance with the registered technology process,
- The system of compressed air supply, including the air compressor and the air dispenser,
- The hydraulic lift,
- The compressed air bolt and screw driver,
- The rim rounder,
- The platform for engine fitting,
- The tyre fixer,
- Specialized pushcarts of all kinds,
- Lighting and ventilating system,
- Technology devices: fork assembler, frame and engine assembling set, headgear, petrol tank, front fork, device for general assembly and final check, etc.
- Auxiliary equipment and tools in service of repairs, such as vice, stone grinder, hand-drill, table for fitter�s work, table for electric soldering, tool-kit, various kinds of supports, trays for tools and machine parts, etc.
The specific quantity and the main technical features of each kind of main equipment of the assembly process must correspond with the volume already approved in the investment plan and shall be declared by the enterprise itself according to the form in Appendix 1 attached to Official Dispatch No. 479 /BKHCNMT-TDC of February 25, 1999 of the Ministry of Science, Technology and Environment.
3.3. Main equipment and instruments for inspection.
3.3.1. The assembly establishment must have all the necessary equipment for inspecting the quality criteria of outgoing products of the kinds of vehicle already registered. Investment must be made to inspect at least the following quality criteria of inspection equipment:
- Indents of wheel imprints,
- Effectiveness of brakes,
- Speedometer,
- Headlight (intensity, coordinate of light focus),
- Density of exhaust (CO and HC),
- Noise level.
For the establishments producing and assembling engines, electric gear, bike frame, front and rear shock absorbers, they must necessarily be equipped with specialized equipment for checking the quality of these groups of components. In addition, they must be equipped with all the necessary tools for inspection such as force wrench, meter for measuring tyre pressure, micrometers, calipers;
The list of equipment and tools for inspection work shall be declared by the enterprise itself according to the form in Appendix 2 attached to Official Dispatch No. 479/BKHCNMT-TDC of February 25, 1999.
3.3.2. The method of inspecting and evaluating the quality criteria of the outgoing motorbikes shall be applied according to the guidance of the supplier of the measurement equipment and must conform with the current criteria of the State.
3.3.3. Requirements for assembly and operation of inspection equipment
For the quality inspection equipment for outgoing motorbikes which are produced in the country, only the establishments which are issued with operating permits and quality certificates can manufacture and supply the measurement and inspection equipment.
All measurement and inspection equipment must be so assembled as to ensure credibility, accurancy and safety according to the design and guidance of the supplier. The examination and adjustment of the measurement equipment must be made according to current prescriptions of the State.
3.4. Other regulations
3.4.1. The workshops, storing yards and offices must meet the following requirements on labor safety and environmental hygiene:
- They must be equipped with a ventilating and lighting system suited to the criteria on industrial hygiene and labor safety stipulated in the corresponding Vietnam Criteria (TCVN 3288-79 Ventilating System, TCVN 3743-83 Lighting, TCVN 3985-85 Noise, TCVN 5738-93 Fire warning - Technical requirements).
- They must take measures to drive waste gas out of the workshops.
- They must supply the laborers with labor protection gear such as clothes, helmets, medical chests, instruments to prevent fires and explosions.
3.4.2. The assembly establishments must have enough personnel and technical workers to meet the management activities and the work in different phases of assembly and inspection. During work-hours the officials and personnel of the workshop must wear uniforms and badges bearing their names and positions.
3.4.3. The motorbike assembly enterprises must set up their networks to monitor the product quality and carry out post-sale warranty.
3.5. The evaluation of technology capacity and the general technical requirements for the assembly process of the motorbikes shall proceed by the expertise method and according to the stipulations in Clause 4.2 hereunder.
4. Implementation provisions
4.1.The enterprises meeting all the conditions listed in Clause 2 and Clause 3 and which have been accepted in principle by the leadership of the Ministry of Industry before the publication of Official Dispatch No. 631/CP-KTTH of June 19, 1999 may send their dossiers attached to the registration proposal to the Ministry of Science, Technology and Environment (the General Department of Criteria of Quality Measurement), the Ministry of Industry (the Department of Technology and Product Quality Management) and the Ministry of Communications and Transport (the Vietnam Transport Registration Department) to propose the acknowledgment of the capacity of the process of motorbike assembly technology in IKD form). The contents of the dossier of registration are stipulated in Official Dispatch No. 479/BKHCNMT of February 25, 1999.
4.2. The Ministry of Science, Technology and Environment shall assume the main responsibility and coordinate with the Ministry of Industry and the Ministry of Communications and Transport to organize the inspection and inform the enterprises of the acknowledgement of the capacity of technology process in motorbike assembly in IKD form according to the criteria stipulated in this Regulation.
4.3. The enterprises equipped with assembly process of motorbike in IKD form which have been inspected and evaluated by the Ministry of Science, Technology and Environment, the Ministry of Industry and the Ministry of Communications and Transport before the promulgation of this Regulation shall have to make supplements to complete their equipment of the assembly process and carry out the technical requirements in conformity with this Regulation.
