DECISION
ON EXEMPTION FROM LAND RENTS FOR PROJECTS ON CONSTRUCTION OF WAREHOUSES TO STORE 4 MILLION TONS OF RICE OR MAIZE, REFRIGERATED WAREHOUSES FOR PRESERVATION OF FISHERY PRODUCTS, VEGETABLES AND FRUITS AND COFFEE TEMPORARY RESERVE WAREHOUSES UNDER PLANNING
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 26, 2003 Land Law;
Pursuant to the Government s Resolution No. 48/NQ-CP of September 23, 2009, on mechanisms and policies on reduction of post-harvest losses for agricultural and aquatic products;
Pursuant to the Government s Decree No. I42/2005/ND-CP of November 14, 2005, on collection of land rents and water surface rents;
At the proposal of the Minister of Finance,
DECIDES:
Article 1.Enterprises of all economic sectors that invest in projects on construction of warehouses to store 4 million tons of rice or maize, refrigerated warehouses for preservation of fishery products, vegetables and fruits and coffee temporary reserve warehouses under approved planning are exempt from land rents for land areas of those projects within 5 years. from the dale, of project commissioning.
In case above-mentioned projects are carried out in localities eligible for investment incentives and enjoy land rent exemption at levels different from those provided in this Decision, enterprises may choose the highest incentive level of land rent exemption.
For land areas not used for above-mentioned purposes (if any), enterprises shall pay land rents under current regulations.
Article 2.The order, procedures and competence to decide on land rent exemption comply with the Government s current regulations and the Finance Ministry s guidance on collection of land rents.
Article 3.In case enterprises no longer need to use land or use rented land areas not for constructing warehouses to store 4 million tons of rice or maize, refrigerated warehouses for preservation of fishery products, vegetables and fruits and coffee temporary reserve warehouses, the State shall recover these land areas and handle land-attached assets already invested by these enterprises under the Land Law.
Article 4.Implementation provision
This Decision takes effect on November 10. 2010.
Article 5.Organization of implementation
Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of provincial-level People s Committees shall implement this Decision.-
