DECISION

Promulgating the List of Objects subject to plant quarantine upon export, import, temporary import for re-export, temporary export for re-import, and transit through the territory of the Socialist Republic of Vietnam for the 1999-2000 period

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Government’s Decree No. 73/CP dated November 1, 1995, defining the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 92/CP dated November 27, 1993, guiding the implementation of the Ordinance on Plant Protection and Plant Quarantine;

At the proposal of the Director General of the Plant Protection Department,

HEREBY DECIDES:

Article 1. The List of Objects subject to plant quarantine upon export, import, temporary import for re-export, temporary export for re-import, and transit through the territory of the Socialist Republic of Vietnam comprises:

1/ Plants:

a) Planting materials of all kinds and plant parts used for propagation, including: seeds, grafting scions, buds for grafting, rhizomes, shoots, fruits, roots, tubers, and plant tissues cultured on artificial media.

b) Plants of all kinds and plant parts, including: buds, flowers, fruits, branches, stems, leaves, roots, tubers, seeds, bark, and other plant parts in various forms.

2/ Plant products: rice, broken rice, wheat flour, malt, bran, oil cakes; nuts and seeds, including cashew nuts, coffee beans, peanuts, beans, and peppercorns; chili powder, tea, jute fiber, cut tobacco, tobacco leaves, alcohol yeast, feed yeast; wood and wood products (wood products for export falling within the list prescribed in Article 2 of the Prime Minister’s Decision No. 65/1998/QD-TTg dated March 24, 1998, are exempt from plant quarantine upon export, except where plant quarantine is required under the commercial contract, letter of credit (L/C), or the provisions of treaties, international conventions, and agreements to which Vietnam is a party); rattan, cane, bamboo, reed bamboo, mats, sedge, straw, rice straw; medicinal herbs of all kinds; carpets woven from wool or fibers of plant origin; and raw cotton.

3/ Insects, pathogenic fungi, nematodes, bacteria, viruses (whether alive or dead), and specimens of plants and plant products.

4/ Soil and other articles capable of causing damage to, or carrying, plant pests.

5/ Means of transport carrying objects subject to plant quarantine.

Article 2. This Decision replaces the Minister of Agriculture and Rural Development’s Decision No. 1165-NN-BVTV/QD dated June 5, 1997, and takes effect 15 days after the date of its signing.

Article 3. The Chief of the Ministry Office, the Director General of the Plant Protection Department, and heads of relevant units and concerned individuals shall be responsible for the implementation of this Decision./.
