SUMMARY

Roadmap for application of exhaust emission standards to motor vehicles

The Prime Minister issued the Decision No. 49/2011/QD-TTg dated September 1, 2011 providing the roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new cars and motorbikes.

Accordingly, manufactured, assembled and imported brand-new cars are subject to level-4 exhaust emission standard from January 1, 2017; level-5 exhaust emission standard from January 1, 2022; manufactured, assembled and imported brand-new motorbikes are subject to level-3 exhaust emission standard from January 1, 2017.

Level-3, -4 and -5 exhaust emission standards are standards on the testing and limits of pollutants in exhaust gases applicable to manufactured, assembled and imported brand-new motor vehicles and equivalent to Euro 3. Euro 4 and Euro 5 limits provided in United Nations Economic Commission for Europe's technical regulations on motor vehicle exhaust emission or European Union directives.

Also according to this Decision, the Ministry of Transport shall be responsible for elaborating, promulgating and publicizing national technical regulations on level-3, -4 and -5 motor vehicle exhaust emission, assuring their effect according to the roadmap.

The Ministry of Science and Technology shall study and elaborate, promulgate and publicize as soon as possible national technical regulations on petrol, diesel oil and bio-fuel of a quality up to level-3 exhaust emission standard. National technical regulations on petrol, diesel oil and bio-fuel of a quality up to level-4 or level-5 exhaust emission standards, assuring their effect from January 1, 2016, or January 1, 2021, respectively.

This Decision takes effect on October 18, 2011.

THE PRIME MINISTER

Decision No.  49/2011/QD-TTg dated September 1, 2011 of the Prime Minister providing the roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new cars and motorbikes

Pursuant to the December 25, 2011 Law on Organization of the Government;

Pursuant to the November 29, 2005 Law on Environmental Protection;

Pursuant to the November 13, 2008 Law on Road Traffic;

At the proposal of the Minister of Transport,

DECIDES:

Article 1. Scope of regulation This Decision provides the roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new cars and motorbikes which are fitted with combustion engines.

Article 2. Subjects of application

This Decision applies to related state management agencies and organizations and individuals manufacturing, assembling or importing cars or motorbikes, except special-type motor vehicles used for defense or security purposes by the army or public security force, which are specified by the Ministry of National Defense or the Ministry of Public Security.

Article 3. Interpretation of terms

Level-3, -4 and -5 exhaust emission standards are standards on the testing and limits of pollutants in exhaust gases applicable to manufactured, assembled and imported brand-new motor vehicles and equivalent to Euro 3. Euro 4 and Euro 5 limits provided in United Nations Economic Commission for Europe's technical regulations on motor vehicle exhaust emission or European Union directives.

Article 4. Roadmap for application of exhaust emission standards

1. Manufactured, assembled and imported brand-new cars are subject to:

a/ Level-4 exhaust emission standard from January 1, 2017.

b/ Level-5 exhaust emission standard from January 1, 2022.

2. Manufactured, assembled and imported brand-new motorbikes are subject to level-3 exhaust emission standard from January 1, 2017.

Article 5. Organization of implementation

1. The Ministry of Transport shall:

a/ Elaborate, promulgate and publicize national technical regulations on level-3, -4 and -5 motor vehicle exhaust emission, assuring their effect according to the roadmap provided in Article 4 of this Decision.

b/ Direct its professional agencies to improve their technical capabilities, physical foundation and equipment to serve the inspection and control of exhaust emission of manufactured, assembled and imported brand-new motor vehicles according to the roadmap for application of level-3, -4 and -5 exhaust emission standards.

c/ Organize the implementation of this Decision and, based on the practical situation, study and elaborate regulations to raise motor vehicle exhaust emission standards for submission to the Prime Minister for promulgation.

d/ Join with the Ministry of Finance in elaborating and promulgating a charge tariff for exhaust emission testing according to level-3, -4 and 5-exhaust emission standards.

2. The Ministry of Science and Technology shall:

a/ Study and elaborate, promulgate and publicize as soon as possible national technical regulations on petrol, diesel oil and bio-fuel of a quality up to level-3 exhaust emission standard.

b/ Elaborate, promulgate and publicize national technical regulations on petrol, diesel oil and bio-fuel of a quality up to level-4 or level-5 exhaust emission standards, assuring their effect from January 1, 2016, or January 1, 2021, respectively.

c/ Announce the roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new cars and motorbikes to the World Trade Organization.

3. The Ministry of Industry and Trade shall assume the prime responsibility for. and coordinate with related ministries and sectors in. assuring the production, import and supply of motor vehicle fuel of a quality up to national technical regulations under the roadmap publicized by the Ministry of Science and Technology under Points a and b, Clause 2 of this Article.

4. The Ministry of Finance shall:

a/ Elaborate and promulgate a charge tariff for testing of exhaust emission of cars and motorbikes according to level-3. -4 and -5 exhaust emission standards.

b/ Assume the prime responsibility for elaborating and promulgating according to its competence or for submitting to competent authorities for promulgation mechanisms on financial supports for petrol and oil producers and traders so as to assure sufficient fuel supply according to the roadmap for application of exhaust emission standards and encourage the manufacture and use of environmentally friendly motor vehicles.

5. Related ministries, sectors and provincial-level People's Committees shall:

a/ Conduct communication about the roadmap for application of exhaust emission standards to manufactured, assembled or imported brand-new cars and motorbikes.

b/ Direct their professional units to coordinate with the Ministry of Science and Technology in controlling the quality of fuels circulated on the market.

6. Provincial-level People's Committees shall assume the prime responsibility for and coordinate with related ministries and sectors in, organizing the application of exhaust emission standards earlier than the roadmap specified in Article 4 of this Decision.

Article 6. Effect and implementation responsibility

1. This Decision takes effect on October 18, 2011.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People's Committees and related organizations and individuals shall implement this Decision.-
