DECISION
PROMULGATING THE LIST OF CONSTRUCTION SUPPLIES WHICH CAN BE PRODUCED AT HOME
THE MINISTER OF PLANNING AND INVESTMENT
Pursuant to the Government’s Decree No.75/CP of November 1st, 1995 defining the functions, tasks and powers of the Ministry of Planning and Investment;
Pursuant to the Government’s Decree No.15/2000/ND-CP of May 9, 2000 assigning the Ministry of Planning and Investment to promulgate the list of construction supplies of types which can be produced at home;
After consulting the concerned ministries and branches,
Pursuant to the Government’s Decree No.15/2000/ND-CP of May 9, 2000 assigning the Ministry of Planning and Investment to promulgate the list of construction supplies of types which can be produced at home;
After consulting the concerned ministries and branches,
DECIDES:
Article 1.- To promulgate together with this Decision the List of construction supplies which can be produced at home, serving as basis for effecting the non-application of value added tax on import of construction supplies which cannot be produced at home according to provisions of Clause 1, Article 1 of the Government’s Decree No.15/2000/ND-CP of May 9, 2000.
Article 2.- Construction supplies are input raw materials and materials (excluding machinery, technological equipment and production supplies) for construction of projects to form assets of enterprises according to investment licenses, investment projects or investment reports prescribed in the Government’s Decrees No.14/2000/ND-CP of July 31, 2000 and No.52/1999/ND-CP of July 8, 1999.
Article 3.- In cases where a number of types of raw materials and materials, which can be produced at home as specified in Decision No.230/2000/QD-BKH of May 4, 2000, are used for purpose of constructing projects to form assets of enterprises according to provisions of Article 2 of this Decision, Decision No.230/2000/QD-BKH shall also serve as basis for distinguishing types of supplies which cannot be produced at home and are not subject to value added tax when imported.
Article 4.- In the course of using the list, should any divergence of opinions between the customs office and enterprises arise, the customs office shall coordinate with the provincial/municipal Planning and Investment Services in considering and settling it. In cases where there still exist problems, the General Customs Department shall propose the Ministry of Planning and Investment to consider and make decisions or amend and supplement the list.
Article 5.- This Decision takes effect 15 days after its signing and shall also apply to written declarations of imported raw materials, materials and semi-finished products subject to this Decision as from the effective date of the Government’s Decree No.15/2000/ND-CP of May 9, 2000.
