DECISION

AMENDING AND SUPPLEMENTING THE FINANCE MINISTER’S DECISION No. 77/2006/QD-BTC OF DECEMBER 29, 2006, PROMULGATING THE LIST OF COMMODITY ITEMS AND THEIR IMPORT DUTY RATES FOR THE APPLICATION OF DUTY QUOTAS

THE MINISTER OF FINANCE

Pursuant to June 14, 2005 Law No. 45/2005/QH11, on Import Duty and Export Duty;
Pursuant to Article 11 of the Government’s Decree No. 149/2005/ND-CP of December 8, 2005, detailing the implementation of the Law on Import Duty and Export Duty; and the Government’s Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding international goods sale and purchase and purchase and goods sale, purchase, processing and transit agency activities with foreign countries;
Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002, defining the functions, competent, authorities and organizational structures of ministries and ministerial-level agencies; and the Government’s Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, competent, authorities and organizational structure of the Ministry of Finance;
After consulting the Ministry of Trade, the Ministry of Industry and the Ministry of Agriculture and Rural Development; and at the proposal of the director of the Tax Policy Department,

DECIDES:

Article 1.- To amend and supplement Article 2 of the Finance Minister’s Decision No. 77/2006/QD-BTC of December 29, 2006, promulgating the list of commodity items and their import duty rates for application of duty quotas as follows:

“Article 2.- Good imported within duty quotas are liable to the preferential import duty (MFN) rates in the current Preferential Import Rate Schedule or the CEPT particularly preferential import duty rates specified in Decision No. 25/2007/QD-BTC of April 16, 2007, amending and supplementing the Finance Minister’s Decision No. 09/2006/QD-BTC of February 28, 2006, promulgating Vietnam’s list of commodity items and their particularly preferential import duty rates for implementation of the ASEAN Agreement on Common Effective Preferential Tariff (CEPT) in the 2006-2013 period and satisfy requirements for application of CEPT duty rates according to the Finance Ministry’s Circular No. 45/2007/TT-BTC of May 7, 2007, guiding the implementation of particularly preferential import duty rates and Decision No. 25/2007/QD-BTC.

Commodity items imported in excess of quotas prescribed by the Trade Ministry are liable to import duty rates applicable to extra-quota imported goods specified in Article 1 of the Finance Minister’s Decision No. 77/2006/QD-BTC of December 29, 2006.”

Article 2.- To annual Article 3 of the Finance Minister’s Decision No.77/2006/QD-BTC of December 29, 2006, promulgating of the list of commodity items and their import duty rates for application of duty quotas.

Article 3.- This Decision takes effect and applies to customs declarations of imported goods registered with customs offices 15 days after its publication in “CONG BAO.”
