Decision No. 42/2006/QD-NHNN dated August 28, 2006 of the State Bank on the amendment, supplement of several articles of the Regulation on the custody of valuable papers at the State Bank issued in conjunction with the Decision No. 1022/2004/QD-NHNN dated August 18, 2004 of the Governor of the State Bank

DECISION

ON THE AMENDMENT, SUPPLEMENT OF SEVERAL ARTICLES OF THE REGULATION ON THE CUSTODY OF VALUABLE PAPERS AT THE STATE BANK ISSUED IN CONJUNCTION WITH THE DECISION 1022/2004/QD-NHNN DATED 17/8/2004 OF THE GOVERNOR OF THE STATE BANK

THE GOVERNOR OF THE STATE BANK

- Pursuant to the Law on the State Bank of Vietnam in 1997 and the Law on the amendment, supplement of several Articles of the Law on the State Bank of Vietnam in 2003.

- Pursuant to the Law on the Credit Institutions in 1997 and the Law on the amendment, supplement of several articles of the Law on Credit Institutions in 2004;

- Pursuant to the Decree No. 52/2003/ND-CP dated 19 May 2003 of the Government providing for the function, assignment, authority and the organizational structure of the State Bank of Vietnam;

- Upon the proposal of the Director of Banking Operation Department,

DECIDES:

Article 1. To amend, supplement several articles of the Regulation on the custody of valuable papers at the State Bank issued in conjunction with the Decision No. 1022/2004/QD-NHNN dated 17 August 2004 of the Governor of the State Bank as follows:

1. To supplement article 4a as follows:

Article 4a. Fee for custody of valuable papers

Customers who carry out the custody of valuable papers shall be subject to the payment of custody fee. Level of custody fees shall be provided for by the State Bank.

2. Paragraph 2 Article 20 shall be amended, supplemented as follows:

2. Finance Accounting Department:

a. To provide guidance on the accounting of valuable papers custody and custody fees in accordance with provisions in this Regulation

b. To provide guidance on the procedures of the closing, opening of accounts valuable paper.

c. To set up a level of custody fees which is suitable to each period of time to submit to the Governor for issuance

Article 2. This Decision shall be effective after 15 days since its publication in the Official Gazette.

Article 3. Director of the Administrative Department, Director of Finance-Accounting Department, Director of Banking Informatics Technology Department, Heads of related units of the State Bank, General Managers of the State Bank branches in provinces, cities under the central Governments management, Chairperson of the Board of Directors, General Directors (Directors) of credit institutions shall be responsible for the implementation of this Decision.
