Decision No. 40/2002/QD-TTg dated March 18, 2002 of the Prime Minister on the competence to sign for promulgation legal documents for exercising the state management over the branches and fields managed by the agencies attached to the Government

DECISION

ON THE COMPETENCE TO SIGN FOR PROMULGATION LEGAL DOCUMENTS FOR EXERCISING THE STATE MANAGEMENT OVER THE BRANCHES AND FIELDS MANAGED BY THE AGENCIES ATTACHED TO THE GOVERNMENT

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of December 25, 2001;

Pursuant to the National Assembly Standing Committee’s Resolution No. 287/2002/NQ-UBTVQH10 prescribing the implementation of a number of points of the Resolution on the amendment and supplementation of a number of articles of the 1992 Constitution;

At the proposals of the Minister-Director of the Government’s Commission for Organization and Personnel and the Minister-Director of the Government’s Office,

DECIDES:

Article 1.-To assign the Minister-Director of the Government’s Office to sign for promulgation legal documents (which formerly fell under the promulgating competence of the heads of the agencies attached to the Government) in order to exercise the State management over the branches and fields managed by the agencies attached to the Government.

Article 2.-The heads of the agencies attached to the Government shall direct the study and compilation of legal documents in service of the work of State management over the branches and fields under their respective management.

For bills, draft ordinances, resolutions, decrees of the Government; or decisions and directives of the Prime Minister, the heads of the agencies attached to the Government shall submit them to the Government or the Prime Minister according to the current law provisions so that the latter examine and submit them to the National Assembly or the National Assembly Standing Committee for promulgation, or promulgate them according to their respective competence.

For the draft legal documents prescribed in Article 1 of this Decision, they shall be submitted to the Minister-Director of the Government’s Office for signing for promulgation.

Article 3.-This Decision takes implementation effect after its signing.

In the course of implementation of this Decision, if problems arise among the ministries, ministerial-level agencies and agencies attached to the Government, the Minister-Director of the Government’s Office shall promptly report them to the Prime Minister for consideration and decision.

The Minister-Director of the Government’s Office, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decision.
