DECISION

ON USING OF THE GUIDELINES FOR THE CONDUCT OF TESTS FOR DISTINCTNESS, UNIFORMITY AND STABILITY OF PLANT VARIETIES

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Based on the Decree No. 86/2003/ND-CP dated on 18th July, 2003 of the Government on stipulation of functions, duties and organizational bodies of Ministry of Agriculture and rural development;

Based on the Intellectual Property Law No. 50/2005/QH11 on 29^th November, 2005;

Based on the actual situations of Globalization;

Pursuant to the proposal of the Director of Department of Crop Production..

DECISION:

Article 1. Guidelines for the conduct of Tests for Distinctness, Uniformity and Stability (DUS Test) of the Plant Varieties those have been issued by International Union for the Protection of New Varieties of Plant (UPOV) are used for testing of plant variety of correlative guidelines in Vietnam.

Article 2. Department of Crop Production is responsible for collecting, translation and dissemination of those UPOV’s Guidelines to the relevant persons. For the species which UPOV have not yet issued, Department of Crop Production propose to Ministry of Agriculture and Rural Development (MARD) establish Professional Committee to draft National Guidelines.

Article 3. During the implementation, in case of there is any trouble, Department of Crop Production must report to the MARD and propose the solutions for the trouble.

Article 4. This Decision enter into force from signing date.

Article 5. Head of the Office of MARD, Director of Department of Crop Production, Director of Department of Science and Technology, Chief of Plant Variety Protection Office, Head Office of relevant offices and individual are responsible to implementation of this Decision./.
