SUMMARY

Ordinary duties on imports applied for many products

On September 01, 2016, the Prime Minister issued the Decision No. 36/2016/QD-TTg dated September 01, 2016 of the Prime Minister on application of ordinary import duties according to Point c Clause 3 Article 5 of the Law on Export and import duties.

Accordingly, ordinary import duty of 5% shall be applied for many kinds of products such as: smart cards; Answer phones; Vacuum; Uninterruptible Power Supply; automatic payment machines; electronic computers; Laundry machines; offset printers; laser printers….

For ordinary duties on imports that are not listed in the Appendix enclosed herewith and are not eligible for concessional duties or special concessional duties specified in Clause a and b Article 5 of the Law on Export and import duties No. 107/2016/QH13 shall be equal to 150% of the concessional duty rates on corresponding articles specified in Appendix II of Decree No. 122/2016/ND-CP dated September 01, 2016.

THE PRIME MINISTER

Decision No. 36/2016/QD-TTg dated September 01, 2016 of the Prime Minister on application of ordinary import duties

Pursuant to the Law on Government organization dated June 19, 2015;

Pursuant to the Law on Export and import duties No. 107/2016/QH dated April 06, 2016;

At the request of the Minister of Finance,

The Prime Minister promulgates a Decision on application of ordinary import duties.

Article 1. Scope of adjustment

This Decision provides for application of ordinary import duties according to Point c Clause 3 Article 5 of the Law on Export and import duties.

Article 2. Subject of application

1. Owners of exports and imports.

2. Organizations and individuals involved in export and import of goods.

3. Customs authorities and customs officials.

4. Other organizations and individuals implementing the Law on Export and import duties.

Article 3. Application of ordinary import duties

1. The ordinary import duty schedule promulgated together with this Decision comprises:

a) A list (descriptions and 8-digit codes) of articles to which 0% import duty is applied as specified in Section I and II of the Government's Decree No. 122/2016/ND-CP.

b) Ordinary rate of import duty on each article in the schedule.

2. Ordinary duties on imports that are not listed in the Appendix enclosed herewith and are not eligible for concessional duties or special concessional duties specified in Clause a and b Article 5 of the Law on Export and import duties No. 107/2016/QH13 shall be equal to 150% of the concessional duty rates on corresponding articles specified in Appendix II of Decree No. 122/2016/ND-CP.

Article 4. Implementation provision

1. This Decision takes effect on September 01, 2016.

2. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People’s Committees of provinces are responsible for the implementation of this Decision./.
