DECISION
ON THE ESTABLISHMENT OF CAI MEP INDUSTRIAL PARK, BA RIA-VUNG TAU PROVINCE, AND APPROVAL OF THE INVESTMENT PROJECT ON CONSTRUCTION AND COMMERCIAL OPERATION OF TECHNICAL INFRASTRUCTURE THEREIN
THE PRIME MINISTER
Pursuant to the Law on Organization of the Government of December 25, 2001;
Pursuant to the Regulation on Industrial Parks, Export-Processing Zones and Hi-Tech Parks, issued together with the Government’s Decree No. 36/CP of April 24, 1997;
Pursuant to the Investment and Construction Management Regulation issued together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999 and Decree No. 12/2000/ND-CP of May 5, 2000;
At the proposal of the president of the People’s Committee of Ba Ria-Vung Tau province (Document No. 820/UB-VP of March 8, 2002), the proposal of the president of the People’s Committee of Ho Chi Minh city (Document No. 4374/UB-DA of December 3, 2001) and the evaluation opinions of the Minister of Planning and Investment (Document No. 3766 BKH/VPTD of June 7, 2001),
Pursuant to the Regulation on Industrial Parks, Export-Processing Zones and Hi-Tech Parks, issued together with the Government’s Decree No. 36/CP of April 24, 1997;
Pursuant to the Investment and Construction Management Regulation issued together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999 and Decree No. 12/2000/ND-CP of May 5, 2000;
At the proposal of the president of the People’s Committee of Ba Ria-Vung Tau province (Document No. 820/UB-VP of March 8, 2002), the proposal of the president of the People’s Committee of Ho Chi Minh city (Document No. 4374/UB-DA of December 3, 2001) and the evaluation opinions of the Minister of Planning and Investment (Document No. 3766 BKH/VPTD of June 7, 2001),
DECIDES:
Article 1.- To establish Cai Mep Industrial Park, Ba Ria-Vung Tau province.
Cai Mep Industrial Park is organized and operates under the Regulation on Industrial Parks, Export-Processing Zones and Hi-Tech Parks, issued together with the Government’s Decree No. 36/CP of April 24, 1997, and is subject to the direct management of Ba Ria-Vung Tau province’s Industrial Parks Managing Board.
Article 2.- To approve the investment project on construction and commercial operation of the technical infrastructure in Cai Mep Industrial Park, Ba Ria-Vung Tau province with the following contents:
1. The project’s name: Investment project on construction and commercial operation of the technical infrastructure in Cai Mep Industrial Park, Ba Ria-Vung Tau province.
2. Investor: Sai Gon Construction Corporation, which is headquartered at 141 Hai Ba Trung street, District 3, Ho Chi Minh City.
3. The project’s objectives: To invest in construction of the industrial park’s technical infrastructure: traffic road; electricity supply; water supply and drainage; waste treatment, information and communication systems and commercial operation of technical infrastructure already created.
4. Construction location: Phuoc Hoa commune, Tan Thanh district, Ba Ria-Vung Tau province.
5. The industrial park’s area: 670 ha, which shall be accurately re-determined when the land-lease procedures are carried out according to the provisions of the Land Law.
6. Total investment capital: Vietnam dong 849.5 billion.
7. Capital sources: Own capital, capital advanced by investors, and borrowed capital.
8. Operation duration: 50 years as from the date the investment decision is issued.
9. Construction duration: 5 years as from the date the land-lease decision is issued. In the course of construction investment, the investor must carry out all necessary procedures according to the provisions of the Regulation on Investment and Construction Management.
Article 3.- Sai Gon Construction Corporation shall be entitled to the preferences under the Law on Domestic Investment Promotion.
Article 4.- The president of the People’s Committee of Ba Ria-Vung Tau province and the president of the People’s Committee of Ho Chi Minh city shall have to direct the investor in implementing the project according to the current regulations; elaborate the general scheme on development of outside-the-fence infrastructure works in compatibility with inside the fence, ones ensuring the efficient operation of the industrial park.
Article 5.- This Decision takes effect after its signing.
Article 6.- The president of the People’s Committee of Ba Ria-Vung Tau province, the president of the People’s Committee of Ho Chi Minh city; the ministers of Planning and Investment; Finance; Construction; Defense; Industry; and Science, Technology and Environment; the General Director of Land Administration; the Governor of Vietnam State Bank; the head of Ba Ria-Vung Tau province’s Industrial Parks Managing Board, the general director of Sai Gon Construction Corporation and the heads of the concerned agencies shall, within their respective functions and powers, have to implement this Decision.
