DECISION
APPROVING THE SCHEME ON JOB-TRAINING FOR LABORERS GOING TO WORK OVERSEAS UP TO 2015
THE PRIME MINSTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the June 23, 1994 Labor Code and the April 2, 2002 Law Amending and Supplementing a Number of Articles of the Labor Code;
Pursuant to the June 14, 2005 Education Law;
Pursuant to the Government's Decree No. 81/2003/ND-CP of July 17, 2003, detailing and guiding the implementation of the Labor Code regarding Vietnamese laborers working overseas;
At the proposal of the Minister of Labor, War Invalids and Social Affairs,
DECIDES:
Article 1.- To approve the scheme on job-training for laborers going to work overseas up to 2015, with the following principal contents:
1. Objectives:
a/ General objectives:
To develop a sufficient, high-quality and well-structured labor source, meeting the demands of overseas labor markets, thus contributing to creating jobs, raising incomes and improving the life of laborers.
b/ Specific targets:
- To form some key job-training schools in order to provide job-training, foreign language teaching and orientation education for laborers going to work overseas so as to attain the target of sending every year over 100,000 trained laborers to work overseas;
- By 2010, trained laborers shall account for 70% of total number of laborers going to work overseas, of whom 30% shall be skilled laborers and highly skilled laborers. By 2015, 100% of laborers going to work overseas shall be skilled workers, of whom 40% shall be highly skilled technical laborers.
- Laborers going to work overseas shall be trained so as to reach set standards on foreign languages and orientation education.
2. Tasks:
a/ To assign capable job-training establishments to train and prepare technical labor sources for export;
b/ To standardize programs and teaching manuals for job-training, foreign language teaching and orientation education for laborers going to work overseas;
c/ To foster and raise the qualifications of teachers and administrators engaged in job-training, foreign language teaching and orientation education for laborers going to work overseas;
d/ To evaluate the quality of job-training for laborers going to work overseas;
e/ To build a system providing information on overseas labor markets to job-training establishments, labor export enterprises, state management agencies and laborers.
3. Major solutions
a/ To develop a network of establishments providing job-training for laborers going to work overseas:
- To encourage job-training establishments, including those of labor export enterprises and those of all economic sectors, to invest in the training of technical majors in need of human resources in overseas markets;
- To select among key job-training schools, which have been invested by the State with domestic and foreign capital, ten schools to serve as the core in training highly skilled technical laborers, teaching foreign languages and providing orientation education for laborers going to work overseas.
b/ To improve the quality of job-training for laborers going to work overseas:
- To elaborate and promulgate module-based job-training programs and teaching manuals which are flexible and suitable to each labor contract; to spare more time for foreign language teaching and orientation education, especially training in a sense of observance of labor discipline and industrial working style;
- To change job-training methodologies, apply advanced teaching technologies, combining school training with practical activities in domestic production establishments so as to meet requirements of overseas markets receiving Vietnamese laborers;
- To create conditions for teachers directly engaged in job-training, foreign language teaching and orientation education for laborers going to work overseas to field visits to labor-receiving countries.
c/ Policies and mechanisms:
- To encourage enterprises of all economic sectors to invest in raising their laborers' professional skills in order to supply technical laborers for overseas labor markets and receive such laborers back to their enterprises when they return home after completing their contracts;
- Establishments providing job-training of laborers going to work overseas shall enjoy preferential policies regarding land use taxes and credits according to the provisions of law and be entitled to collect tuition fees under competent authorities' regulations;
- On the basis of quotas and budgets allocated annually for job-training, the State shall reserve certain quotas for pilot job-training for laborers going to work overseas in order to take initiative in preparing labor sources for overseas labor markets;
- Labor export enterprises may train laborers by themselves or in cooperation with domestic and foreign job-training establishments skilled labor sources so as to properly perform contracts on sending laborers to work overseas.
d/ To build a network of information on overseas labor markets
The network of information on overseas labor markets shall be set up under the Ministry of Labor, War Invalids and Social Affairs and connected with 10 key job-training schools, labor export enterprises, diplomatic agencies, and representative offices in charge of managing Vietnamese laborers in foreign countries. With this information network, job-training establishments, labor export enterprises, and laborers shall get access to updated information on overseas labor market demands, labor supply capacities, information on job-training establishments and contents of job-training programs for laborers going to work overseas.
e/ International cooperation:
- To extend cooperation relations with foreign countries and international organizations in the domain of training, fostering and raising the qualifications of administrators and teachers directly engaged in training of laborers going to work overseas.
f/ To enhance examination, inspection and evaluation of the quality of job-training for laborers going to work overseas.
Article 2.- Implementation schedule
1. From now to 2010:
- To select ten job-training schools to act as the core in formulating models, methods and curricula for job-training, foreign language teaching and orientation education for laborers going to work overseas;
- To elaborate a regulation on evaluation of the quality of job-training for laborers going to work overseas;
- To elaborate programs on job skill training and fostering, foreign language teaching and orientation education for laborers going to work overseas; to organize refresher courses for administrators and teachers engaged in job-training for laborers going to work overseas;
- To build a network of information on overseas labor markets.
2. The 2011-2015 period
- To perfect the models of job-training for laborers going to work overseas in 10 key schools and widely apply them within the system of job-training schools.
- To renovate the contents and programs and organize refresher courses for administrators and teachers engaged in job-training for laborers going to work overseas so as to improve their qualifications.
Article 3.- Organization of implementation
1. The Ministry of Planning and Investment and the Ministry of Finance shall make plans on allocation of funds and mobilization of other sources for the implementation of this scheme.
2. The Ministry of Foreign Affairs shall direct Vietnamese representative missions in foreign countries to collect and supply information on overseas labor markets.
3. Ministries, branches and provincial/municipal People's Committees shall, according to their functions and powers, have to specify mechanisms and policies, make plans on allocation of budget capital and mobilization of other sources, and organize job-training for laborers going to work overseas; and direct their subordinate labor export enterprises and establishments providing job-training for laborers going to work overseas to implement this scheme.
4. The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with ministries, branches and provincial/municipal People's Committees in:
- Guiding the planning and organization of the implementation of the scheme;
- Inspecting, examining and summing up the scheme implementation for periodical report to the Prime Minister.
Article 4.- This Decision takes effect 15 days after its publication in "CONG BAO."
Article 5.- Ministers, heads of ministerial-level agencies and Government-attached agencies, and presidents of provincial/municipal People's Committees shall have to implement this Decision.
