DECISION
On principles and order of priority for the adjustment and addition of power project plannings
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Electricity Law dated December 03, 2004; Law on Amending and Supplementing a Number of Articles of the Electricity Law dated November 20, 2012;
Pursuant to the Law No. 21/2017/QH14 on Planning;
Pursuant to the Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government on detailing implementation of a number of articles of the Electricity Law and the Law on Amending and Supplementing a Number of Articles of the Electricity Law;
Pursuant to the Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government on defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Resolution No. 751/2019/UBTV14 dated August 16, 2019 of the National Assembly’s Standing Committee on elaborating a number of articles of the Law on Planning;
Pursuant to the Resolution No. 110/NQ-CP dated December 02, 2019 of the Government on portfolio of plans integrated into the national, regional and provincial planning in accordance with Point c, Clause 1 in Article 59 of the Law on Planning;
Pursuant to the Resolution No. 21-NQ/BCSD dated January 10, 2020 of the Party’s civil affairs committee of the Ministry of Industry and Trade on principles of and procedures for adjusting and supplementing the planning of power projects;
At the request of the Director of the Electricity and Renewable Energy Authority,
DECIDES:
Article 1: To issue principles and order of adjusting and addition of power project plannings in the transitional period until the National Power Plan and provincial plans are approved in compliance with the Planning Law (see the Appendix attached to this Decision for more details).
Article 2. Implementation
EREA leads and collaborates with relevant agencies to urgently appraise the additions of power projects to plannings, ensuring the electricity supply for the country’s socio-economic development and promoting the potential of renewable energy in Vietnam.
Article 3. Implementation effectiveness and responsibilities
- This decision comes into force from its signing date.
- Chief of the Ministry Office, the Director of the Electricity and Renewable Energy Authority and relevant units are responsible for implementing this Decision./.

APPENDIX
On principles and order of priority for the adjustment and addition of power project plannings
(Issued together with the Decision No. 329/QD-BCT dated January 22, 2020 by the Ministry of Industry and Trade)
- Procedures for appraising and approving adjustments and addition of the power plannings
Pursuant to the Resolution No. 751/2019/UBTV14 dated August 16, 2019 by the Standing Committee of the National Assembly on elaborating a number of articles of the Law on Planning and the Resolution No. 110/NQ-CP dated December 02, 2019 by the Government on portfolio of plans integrated into the national, regional and provincial plans in accordance with Point c, Clause 1 in Article 59 of the Planning Law, temporarily continue applying regulations on the order and procedures for planning appraisal and approval in accordance with the Circular No. 43/2013/TT-BCT dated December 31, 2013 of the Ministry of Industry and Trade until the passage of the national electricity development planning in the period of 2021-2030 with a vision to 2045.
- Principles and order of adjusting and addition of power plannings
The addition of the power plannings is implemented on the basis of prioritizing power grids prior to power sources. For power source projects, priorities are given to areas with the ability to absorb capacities; high-load areas and poor provinces with few approved projects.
- Power grid projects
The order of priorities is placed as follows:
- Power transmission grid projects which have not been included in the revised PDP VII approved by the Prime Minister in the 5-year plan of EVN or 220 kV power transmission grid projects which were approved in the Power Development Plan of provinces/centrally-administrated cities in the period of 2016-2025 with the possible extension to 2035.
- Projects which have been already included in the revised PDP VII but need adjustments in terms of operation progress and scale.
- Projects for absorbing the capacities of hydropower and renewable energy.
- Grid projects generating power for new loads or adjusting the power generation plan for loads such as providing power to industrial parks and factories that absorb high capacities.
- Power connection projects which have been already approved in the PDP but not yet approved for connections or are being proposed for appropriate adjustments.
b) Power source projects
The inclusion of power source projects in the PDP is conducted with the following priority order:
- Wind power projects with priorities over appraised projects, projects of which power plants and connection grids can be completed before November, 2021 in areas which are not overloaded.
- Waste-to-energy projects (ensuring environmental issues)
- Biomass power projects.
- Small and medium-sized hydropower projects with the plannings adjusting their installed capacity.
- Small and medium-sized hydropower projects proposed for new addition.
- Traditional power projects with priorities for power sources which can absorb a large volume of renewable energy (large hydropower and gas power sources). However, these projects need to be researched carefully in PDP 8 due to their high complexity.
- Solar power projects implemented in accordance with the Announcement No. 402/TB-VPCP dated November 22, 2019 by the Office of Government on the Conclusion of the Prime Minister Nguyen Xuan Phuc at the meeting of the Government’s executive board on the Draft mechanisms to promote the development of solar power projects in Vietnam.
- Order of adjusting and supplementing the plannings of wind power projects
Wind power projects with land advantages as well as possible connection and operation before November, 2021 are appraised, adjusted and included in the planning with the order of priorities as follows:
- Projects with completed appraisals
- Projects in advantageous locations and has possibility for grid connection.
- Other projects.
In each group of projects above, the order of priorities will be determined in line with the principle “the project with written request sent to the Ministry of Industry and Trade by the provincial people’s committee first will be processed first”./.
