Decision No. 28/2005/QD-BTC dated May 13, 2005 of the Ministry of Finance promulgating the table of charges and fees for grant and management of internet domain names and addresses in Vietnam

DECISION

PROMULGATING THE TABLE OF CHARGES AND FEES FOR GRANT AND MANAGEMENT OF INTERNET DOMAIN NAMES AND ADDRESSES IN VIETNAM

THE MINISTER OF FINANCE

Pursuant to the Government's Decree No. 86/ 2002/ND-CP of November 5, 2002, defining the functions, tasks, powers and organizational structures of the ministries and ministerial-level agencies;

Pursuant to the Government's Decree No. 77/ 2003/ND-CP of July 1, 2003, defining the functions, tasks, powers and organizational structure of the Finance Ministry;

Pursuant to the Government's Decree No. 57/ 2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;

Pursuant to the Government's Decree No. 55/ 2001/ND-CP of August 23, 2001, on the management, provision and use of Internet services;

Proceeding from the opinions of the Ministry of Post and Telematics (in Official Letter No. 1112/ BBCVT-KHTC of June 11, 2004) and at the proposal of the director of the Tax Policy Department,

DECIDES:

Article 1.- To promulgate together with this Decision the Table of charges and fees for grant  and management of Internet domain names and addresses in Vietnam.

Article 2.- Payers of the charges and/or fees at the rates mentioned in Article 1 of this Decision are Vietnamese as well as foreign organizations and individuals, that are granted and have Internet domain names and addresses in Vietnam managed by State agencies under the Government's Decree No. 55/2001/ND-CP of August 23, 2001, on management, provision and use of Internet services.

Article 3.-Agencies assigned by the Ministry of Post and Telematics the task of State management over the Internet in Vietnam shall have to collect, remit, manage and use the charges and fees provided for in this Decision (hereinafter referred to as collecting agencies). The charges and fees for grant and management of Internet domain names and addresses in Vietnam are the State budget revenues and shall be managed and used as follows:

1. Collecting agencies may deduct 90% (ninety percent) of collected charge and fee amounts before remitting them into the State budget to cover expenses for the grant and management of Internet domain names and addresses in Vietnam and the collection of such charges and fees according to the spending contents specified at Point 4.b, Section C, Part III of the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, guiding the implementation of law provisions on charges and fees, and the following spending contents:

- Payment of yearly dues to regional and international organizations in charge of domain names, addresses and Internet identification numbers which Vietnam has joined;

- Self-financing of Vietnamese participants to meetings, seminars or training courses on Internet held by international organizations;

- Payment of commissions (if any) to organizations and individuals involved in or acting as agents for the grant of Internet domain names and addresses in Vietnam.

2. Collecting agencies shall have to declare, remit and make settlement-of 10% (ten percent) of the collected charge and fee amounts into the State budget according to the current State budget index and the Finance Ministry's Circular No. 63/2002/ TT-BTC of July 24, 2002.

Article 4.- This Decision takes effect 15 days after its publication in "CONG BAO" and replaces the Finance Minister's Decision No. 84/2001/QD-BTC of September 5, 2001, promulgating the Table of charges and fees for grant and management of Internet domain names and addresses in Vietnam. Other matters related to the collection, remittance, management and use of charges and fees and the publicization of the charge and fee collection regime not mentioned in this Decision shall comply with the guidance in the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, guiding the implementation of law provisions on charges and fees.

Article 5.- Organizations and individuals being charge payers, agencies assigned by the Ministry of Post and Telematics the task of State management over Internet in Vietnam shall have to organize the collection of charges and fees for grant and management of Internet domain names and addresses in Vietnam and the concerned agencies shall have to implement this Decision.
