THE PRIME MINISTER
Decision No. 269/QD-TTg of February 23, 2011, providing the 2011 electricity sale price
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the December 3, 2004 Electricity Law; and the Government's Decree No. 105/ 2005/ND-CP of August 17, 2005, detailing and guiding a number of articles of the Electricity Law;
Pursuant to the Prime Minister's Decision No. 21/2009/QD-TTg of February 12, 2009, providing market-based electricity sale prices for 2009 and for 2010-2012;
Pursuant to the Prime Minister's Decision No. 268/QD-TTg of February, 2011, providing the electricity retail price tariff;
At the proposal of the Minister of Industry and Trade,
DECIDES:
Article 1. To approve the 2011 electricity sale price as follows:
1. The average electricity sale price is VND 1,242/kWh (exclusive of value-added tax), VND 165/kWh higher than the 20 average electricity sale price.
2. This price applies from March 1, 2011.
Article 2. Organization of implementation
1. To assign the Ministry of Industry and Trade:
a/ Based on the average electricity sale price provided in Clause 1, Article 1 of this Decision and the electricity retail price tariff approved under the Prime Minister's Decision No. 268/ QD-TTg of February 23, 2011, to calculate and notify detailed electricity sale prices for groups of buyers and guide their implementation. Particularity, the electricity price for the first scale in 2011 equals 80% of the approved average electricity sale price since the electricity sector still makes loss in 2011;
b/ To finalize the Regulation on methods, order d2vfi procedures for appraisal and promulgation of market-based electricity sale prices and submit it to the Prime Minister for approval the first quarter of 2011;
c/To assume the prime responsibility for, and coordinate with the Ministry of Finance in, supervising the application of the 2011 electricity price, assessing the electricity price adjustment's impacts on production and life and proactively taking necessary measures to stabilize the electricity price. To report on matters beyond its competence to the Prime Minister for consideration and decision.
2. To assign the Ministry of Finance:
a/To assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade and Electricity of Vietnam in, based on the approved electricity sale price, elaborating a plan to ensure financial balance for the electricity sector, and report this plan to the Prime Minister for consideration and decision;
b/ To approve the coal sale price for electricity production in 2011 under the electricity sale plan corresponding to the approved average electricity sale price provided in Clause I, Article 1 of this Decision.
Article 3. Effect
1. This Decision takes effect on the date of its signing.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People's Committees and concerned units shall implement this Decision.-
