DECISION
Approving the program on Vietnam’s border-trade infrastructure development to 2025 with a vision towards 2030

Pursuant to the June 19, 2015 Law on Organization of the Government;
Pursuant to the June 12, 2017 Law on Foreign Trade Management;
Pursuant to the Government’s Resolution No.20/NQ-CP of August 17, 2018, promulgating the Government’s action program for realization of the Politburo’s Resolution No.16-NQ/TW of October 10, 2017 on socio-economic development of land border communes in combination with enhancement and consolidation of defense, security and external affairs;
Pursuant to the Government’s Resolution No.26/NQ-CP on renaming the tasks assigned at Resolution No.20/NQ-CP of August 17, 2018 of the Government;
At the proposal of the Minister of Industry and Trade,
DECIDES:
Article 1. To approve the program on Vietnam’s border-trade infrastructure development to 2025, with a vision towards 2030 (herein after referred to as the Program for short) with the following principal contents:
I. Viewpoints
1. To build and develop the border-trade infrastructure system, comprising border markets, supermarkets, trade centers, shopping malls, logistics centers, commodity warehouses, trade fair and exhibition centers… towards civilization and modernization suitable to the development conditions of each border area.
2. To develop border-trade infrastructures with a view to promoting the development of goods exchange and circulation at border areas, bringing into play the comparative edges of every economic region, every border locality.
3. To develop border-trade infrastructures in conformity with national, sectoral, regional and provincial planning, aiming to meet the requirements of goods circulation from production areas to border regions, to step up activities of goods trading and exchanges, raising the purchasing power and improving the border inhabitants’ life.
4. To develop border-trade infrastructures on the basis of mobilizing and using efficiently resources of individuals and organizations involving in trade activities at border localities. Meanwhile, the State adopts appropriate policies to encourage and give preferential treatment to the border-trade infrastructure development; attaching importance to border areas with development potentials and advantages.
5. To develop border-trade infrastructures in synchronism with the development of system of border gates, traffic infrastructures to border regions; in conformity with the program on economic connection between Vietnam and China, Laos as well as Cambodia and the action program for realization of the Politburo’s Resolution No. 33-NQ/TW of September 28, 2018 on the strategy for protection of national frontiers.
6. To develop border-trade infrastructures in close association with the implementation of programs on socio-economic development, hunger elimination and poverty reduction, social-security maintenance, defense- security and social order enhancement in border regions.
II. Objectives
1. General objectives
To promote cooperation in border-trade infrastructure development and connection with bordering countries in order to tap the potentials and advantages of localities on both sides of the borders; to attract investors and encourage the socialization of investment in construction and development of border-trade infrastructures; to create favorable conditions for Vietnamese border provinces to work out programs and plans on border-trade infrastructure development cooperation with bordering provinces; to incrementally develop the border-trade infrastructures of Vietnamese border localities in proportion to the border-trade infrastructures of localities of the bordering countries; to enhance the relationship of close cooperation in economic-trade, socio-cultural domains of border localities, contributing to raising the living standards of border inhabitants; to maintain defense, security, social order and safety in border areas.
2. Specific objectives to 2025 and a vision towards 2030
a/ To complete the systems of mechanisms and policies on development and management of border-trade infrastructures.
To study, propose and finalize the system of mechanisms and policies on development and management of border-trade infrastructures towards facilitating activities of goods trading, exchange and circulation in border areas.
b/ To newly build, improve or upgrade border-trade infrastructures
To scrutinize and list the border-trade infrastructures prioritized for development investment suitable to the development conditions of each border area and locality, aiming to step up activities of goods trading and exchange and improve the border inhabitants’ living conditions.
c/ To newly build, improve or upgrade border markets
To prioritize investment in the construction, improvement and upgrading of border markets meeting the border trade development demands in conformity with regional and provincial planning.
d/ To develop the system of commodity storehouses
To prioritize investment in the construction, improvement and upgrading of commodity storehouses satisfying the demands of goods trading and exchanges through border gates in conformity with regional and provincial planning.
dd/ To develop systems of supermarkets and trade centers
To further invest in the development of systems of supermarkets and trade centers in border areas in conformity with regional and provincial planning.
e/ To develop logistics centers in service of goods export
To prioritize investment in the development of logistics centers meeting the demands of goods circulation, promoting goods export and import entrepot activities; connecting commodities from production areas to export border gates in conformity with regional and provincial planning.
g/ To train human resources and traders for development and management of border-trade infrastructures.
- To train, foster and raise the capability of the contingent of personnel performing the management of border-trade infrastructures.
- To train, foster and develop the contingent of traders, business households, ensuring that they grasp the regulations on border-trade infrastructures when participating in business activities at border markets, supermarkets, trade centers, shopping malls, etc.
III. PROGRAM CONTENTS
1. To finalize mechanisms and policies on the development of border-trade infrastructures
a/ To formulate and finalize mechanisms and policies on the development and management of border-trade infrastructures, including the proposed preferential mechanisms and policies on development of assorted border-trade infrastructures; on preferential treatment to the attraction of investment capital sources, socialization of investment in border-trade infrastructure development; assorted charges and fees; payment modes…; preferential treatment to traders participating in business activities in border-trade infrastructures of various types.
b/ To scrutinize and make lists of border-trade infrastructures prioritized for investment, upgrading, including state budget- funded projects, projects calling for investment and projects encouraged for investment socialization.
2. To scrutinize and integrate master plans related to border- trade infrastructures into national, regional and provincial planning
To scrutinize, study and propose appropriate contents at master plans related to border-trade infrastructures under the Government’s Resolution No. 110/NQ-CP of December 01, 2019 for integration into national, regional and provincial planning as provided.
3. To attract, mobilize resources for the development of border- trade infrastructures
a/ To prioritize the allocation of state budget fund for new construction, improvement and/or upgrading of a number of assorted border trade infrastructures with an important role in development of trade exchanges at border areas.
b/ To encourage and support enterprises in effecting the socialization of investment in the construction of border-trade infrastructures, helping mobilize and use efficiently non-state budget resources, social resources for development of border-trade infrastructures.
c/ To encourage border localities to attract investment capital for the development of border-trade infrastructures from individuals and organizations in accordance with current regulations.
d/ To mobilize international development partners to assist in funding the construction of border-trade infrastructures according to current regulations.
4. To connect border-trade infrastructures with bordering countries and regional countries
a/ To boost negotiations and proceed to early conclusion of governmental agreements on connection and development of border-trade infrastructures with bordering countries.
b/ To materialize plans and programs on cooperation with bordering countries, aiming to develop the connection of border- trade infrastructures.
c/ To organize promotion programs on goods trading via border markets, supermarkets, trade centers, shopping malls, trade fair and exhibition centers, including the organization of trade fairs, exhibitions, trader connection, advertisement, consultancy, agency and other services in order to boost activities of goods exchanges and circulation with bordering countries and regional countries.
d/ To develop services in support of goods exchanges and circulation at border markets, supermarkets, trade centers, shopping malls, logistics centers, commodity warehouses, trade fair and exhibition centers, etc.
dd/ To encourage border provinces to sign agreements on cooperation in border-trade infrastructure development and connection with neighboring countries in order to concretize the governmental frame agreements on border-trade infrastructure connection and development.
5. To develop the contingent of traders participating in business activities in assorted border-trade infrastructures.
a/ To train and develop the contingent of traders participating in business activities in assorted border-trade infrastructures; to propagate and disseminate laws, policies, goods origins, payment modes, contract conclusion, experiences and techniques in preserving, packaging and labeling goods strictly according to standards, ensuring product quality…; to heighten the knowledge and practice skills on professional operations, aiming to bring about optimum business efficiency when participating in business activities in border markets, supermarkets, trade centers, shopping malls, logistics centers, commodity storehouses, trade fair and exhibition centers.
b/ To organize the exchange of experiences; to establish and develop relationship and alignment between domestic traders and traders of bordering countries and other regional countries.
6. To heighten the quality of human resources involving in the development and management of border-trade infrastructures
To formulate programs on training and development of human resources involving in the development and management of border-trade infrastructures; to guide the implementation of legal provisions and policies related to border-trade infrastructures; to raise the capability and skills on management and administration of operation of assorted border-trade infrastructures.
7. To propagate and advertise the development of border-trade infrastructures
To work out programs on propagation and advertisement on printed matters, special pages on development of border-trade infrastructures.
8. To establish databases on development of border-trade infrastructures
To build database systems and centers and make reports on development of border-trade infrastructures in service of management activities of agencies, organizations and enterprises.
9. To inspect and oversee the operation of the Program
To inspect and oversee the implementation of activities of the Program.
IV. IMPLEMENTATION FUNDING
The funding sources for implementation of the Program will be allocated and mobilized from the state budget, socialization sources and other lawful sources under current provisions of law.
Article 2. Organization of implementation
1. Responsibilities of ministries, ministerial-level agencies
a/ The Ministry of Industry and Trade shall act as the prime body for implementation of the Program
- To formulate plans and funding estimates for realization of contents of the Program according to development demands and in conformity with the practical situation and annually send them to the Ministry of Finance and the Ministry of Planning and Investment for consideration and allocation of funding sources for implementation as provided.
- To assume prime responsibility for, and coordinate with relevant ministries, ministerial-level agencies and People’s Committees of border provinces in, managing, guiding, inspecting and overseeing the implementation of the Program; to send annual or extraordinary reports to the Prime Minister; to make preliminary and final reviews and assessment of the results and efficiency of implementation of the Program; to promptly detect arising problems and report them to the Prime Minister, proposing amendments and supplementations suitable to the practical situation.
b/ The Ministry of Finance
- To balance and allocate funds from the state budget sources for materialization of the Program’s contents according to annual plans under the current provisions of the State Budget Law, the Investment Law, the Public Investment Law and relevant guidance.
- To direct the General Department of Customs to perform the function of customs-related state management within its management scope and in areas of customs activities.
- To coordinate with the Ministry of Industry and Trade in guiding, inspecting and supervising the implementation of the Program.
c/ The Ministry of Planning and Investment
- To balance and arrange sources of development investment capital in medium-term and annual public investment plans for materialization of the Program’s contents in accordance with provisions of the State Budget Law, the Investment Law, the Public Investment Law and relevant guiding documents.
- To coordinate with the Ministry of Industry and Trade in guiding, examining and overseeing the implementation of the Program.
d/ The Ministry of Defense
To direct the Border Guards to perform the responsibility of state management over national frontiers, exits and entries, political security, social order and safety in border areas under provisions of law and international treaties on borders and border gates.
dd/ The ministries of Foreign Affairs, Public Security, Agriculture and Rural Development, Health, Resources and Environment, Transport and the State Bank of Vietnam shall base on their assigned functions and tasks to coordinate with the Ministry of Industry and Trade in organizing the implementation of the Program.
2. Responsibilities of the People’s Committees of border provinces
a/ To proactively organize and formulate plans on the implementation of the Program suitable to the local development demands.
b/ To allocate funds from local budget and other lawfully mobilized sources for implementation of the Program in localities as provided.
c/ To coordinate with the Ministry of Industry and Trade in reviewing, incorporating and integrating contents of master plans on development of border-trade infrastructures into provincial planning according to the Law on Planning and Resolution No.110/NQ-CP of December 2, 2019 of the Government.
d/ To incorporate contents of the Program into other programs and schemes in localities for utmost mobilization of local resources for efficient implementation of the Program.
dd/ To send periodical or requested extraordinary sum-up reports to the Ministry of Industry and Trade on the implementation of the Program in localities.
3. If meeting with problems in the course of organizing the implementation, ministries, ministerial-level agencies and People’s Committees of border provinces are requested to promptly report them to the Ministry of Industry and Trade for sum-up reports to the Prime Minister.
Article 3. This Decision takes effect on the date of its signing.
Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, heads of related agencies and units shall implement this Decision.-
