THE PRIME MINISTER
Decision No.24/2018/QD-TTg dated May 18, 2018 of the Prime Minister on promulgating the list of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built, and the implementation roadmap thereof
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Economical and Efficient Use of Energy dated June 28, 2010;
Pursuant to the Government’s Decree No. 21/2011/ND-CP dated March 29, 2011 elaborating and providing guidelines for implementation of the Law on Economical and Efficient Use of Energy;
At the request of the Minister of Science and Technology;
The Prime Minister decides to promulgate the list of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built, and the roadmap to implementation thereof.
Article 1. Scopeof adjustment
1. This Decision provides for the list of low-efficiency equipment that has to be discarded (prohibited from import, manufacture and domestic sale) and low-efficiency generating sets that are prohibited from being built, and the roadmap to implementation thereof.
2. This Decision does not apply to the equipment that is temporarily imported and re-exported, and serve repair, replacement and energy efficiency testing.
Article 2.Subject of application
This Decision applies to importers, manufacturers and traders of the commodities specified in Clauses 1 and 2 Article 3 of this Decision.
Article 3. List of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built
1. The list of equipment includes:
a) Home appliances: Compact fluorescent lamps, electronic ballasts for fluorescent lamps, electromagnetic ballasts for fluorescent lamps, linear tubular fluorescent lamps, electric fans, refrigerators and refrigerator freezers, non - ducted air conditioners, clothes washing machines for household use, television sets, electric cookers and storage water heaters.
b) Office and commercial equipment: computer monitors, copiers, printers and commercial refrigerated cabinets.
c) Industrial equipment: three-phase asynchronous squirrel cage electrical motors, distribution transformers, boilers used in industrial workshops.
2. Coal-fired or gas-fired generating sets used in thermal power plants.
3. Details about low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built are provided in the Appendices I, II and III hereof.
Article 4. Implementationroadmap
1. Import and manufacture of and trade in any low-efficiency equipment that fails to satisfy the minimum energy efficiency standards specified in the national standards (TCVN) in the Appendix I hereof are prohibited from the effective date of this Decision.
2. Import and manufacture of and trade in any low-efficiency equipment that fails to satisfy the minimum energy efficiency standards specified in TCVN in the Appendix II hereof are prohibited within 02 years from the effective date of this Decision.
3. The construction of new coal-fired or gas-fired generating sets used in thermal power plants is prohibited from the effective date of this Decision. To be specific:
a) It is prohibited to build new coal-fired or gas-fired generating sets that apply obsolete technology and whose efficiency on the date of initial operation fails to satisfy the minimum energy efficiency standards in the Appendix III hereof.
b) It is prohibited to import old and obsolete equipment used for any generating set whose efficiency exceeds the limit in the Appendix III hereof.
c) It is prohibited to approve the guidelines for investment in any coal-fired or gas-fired generating set whose efficiency fails to satisfy the minimum energy efficiency standards in the Appendix III hereof.
Article 5. Implementationorganization
1. The Ministry of Science and Technology shall:
a) take charge and cooperate with Ministries, ministerial authorities, Governmental authorities, People’s Committees of provinces and central-affiliated cities in providing guidelines for adopting measures for discarding low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built in accordance with regulations of this Decision.
b) take charge and cooperate with relevant ministries in establishing national standards on energy efficiency and minimum energy efficiency standards applied to energy equipment.
c) according to socio-economic development and requirements for state management during implementation, cooperate with relevant ministries reviewing and submitting revisions to the list of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built.
2. The Ministry of Industry and Trade shall take charge and cooperate with the Ministry of Science and Technology in inspecting compliance with regulations on discarding low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built in accordance with regulations of this Decision.
3. Ministries and local authorities shall, within their jurisdiction and power, take charge of discarding low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built.
Article 6. Implementationprovisions
1. This Decision takes effect on July 10, 2018.
To annul the Prime Minister’s Decision No. 78/2013/QD-TTg dated December 25, 2013 from the effective date of this Decision.
2. Ministers, heads of ministerial authorities, heads of Governmental authorities, Presidents of People s Committees of provinces and central-affiliated cities, heads of relevant organizations and units, and relevant individuals are responsible for implementation of this Decision.

LIST OF THERMAL POWER PLANTS’ COAL-FIRED AND GAS-FIRED GENERATING SETS PROHIBITED FROM BEING BUILT FROM JULY 10, 2018

It is prohibited to built new coal-fired or gas-fired generating sets that apply obsolete technology and whose efficiency on the first year of operation fails to satisfy the minimum energy efficiency standards. To be specific:
