Pursuant to the Law on Road traffic dated November 28, 2008;
Pursuant to the Law on investment dated November 26, 2014;
Pursuant to the Law on Enterprise dated November 26, 2014;
Pursuant to the Government s Decree No. 107/2012/ND-CP dated December 20, 2012, defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;
Pursuant to the Government’s Resolution No. 30/NQ-CP dated March 01, 2013 promulgating action program in the implementation of the Direction No. 18-CT/TW dated September 04, 2012 issued by the Secretariat of the Central Committee Communist Party of Vietnam on “reinforcement of leadership of the Communist Party for assurance of order and safety of road, railway, inland waterways traffic and remedies to traffic congestion”;
Pursuant to the Government’s Decree No. 29/2008/ND-CP dated March 14, 2008 stipulating industrial zones, export processing zones and economic zones; the Government’s Decree No. 164/2013/ND-CP dated November 12, 2013 and Decree No. 114/2015/ND-CP dated November 09 amending a number of articles of the Decree No. 29/2008/ND-CP;
Pursuant to the Prime Minister’s Decision No. 1586/QD-TTg dated October 24, 2012 granting approval for national strategy for ensuring road traffic safety until 2020 and a vision to 2030;
The Prime Minister’s Decision No. 1107/QD-TTg dated August 21, 2006 granting approval for the planning for development of industrial zones in Vietnam until 2015 and a vision to 2020;
Pursuant to the Prime Minister’s Decision No. 105/2009/QD-TTG dated August 19, 2009 promulgating the Regulation on the management of industrial complexes;
At the request of general director of the Department of Traffic Safety and general director of the Transport Development & Strategy Institute,
DECISION
Article 1.Granting approval for the project “on reinforcement of measures to ensure road traffic order and safety in the areas around industrial zones, industrial complexes across the country” as follows:
I. VIEWPOINT
1.Reinforce measures to ensure traffic order and safety with the aim of minimizing traffic accidents and congestion, making progress toward to sustainable traffic order and safety in the areas around industrial zones, industrial complexes, economic zones and export processing zones (herein ‘industrial zones, complexes’) across the country.
2.The tasks of traffic order and safety in the areas around the industrial zones and complexes shall be responsibility of the entire political system from central to local government with great importance being attached to relevant ministries, departments, local authorities, enterprises in the industrial zones, complexes.
3.Measures taken to ensure traffic order and safety in the areas around industrial zones, complexes should accord with the strategy and master plan for development of transport traffic, the master plan for industrial zones and complexes across the country and other relevant master plans.
4.Maximize mobilization of social forces, especially from enterprises operating in the industrial zones, complexes to ensure traffic order and safety.
5.Measures to ensure traffic safety should be taken in a serious, regular and constant way.
II.OBJECTIVES
1.General objectives
-Enhance awareness about compliance with laws on traffic safety among managers, employees in the industrial zones, complexes and residents thereabout.
-Improve safety conditions for traffic infrastructures in the areas around industrial zones, complexes.
-Increase state administration and cooperation among agencies, organizations and enterprises in the tasks of traffic safety with the aim of reducing from 5 – 10% of the number of traffic fatalities annually and minimize traffic congestion in the industrial zones, complexes across the country.
2.Particular objectives until 2020
-100% of administrative officers and employees working in the industrial zones, complexes and residents thereabout shall be allowed to disseminate and educate laws on traffic safety annually.
-100% of drivers for enterprises in the industrial zones, complexes shall be trained annually in safety driving skills and professional ethics.
-Eliminate 100% of blind spots and spots which are most likely to cause accidents in the areas around the industrial zones, complexes.
-100% of road traffic sign system shall be standardized.
-80 – 100% of large-and -medium-sized industrial zones, complexes shall be connected to bus routes with convenient and safe stops in the areas around industrial zones, complexes.
III.DUTIES AND MEASURES
1.State administration
-Check and revise detailed master plan for industrial zones, complexes in accordance with transport planning with great importance being attached to the connection as prescribed in the Minister of Transport’s Circular No. 50/2015/TT-BGTVT dated September 23, 2015 providing instructions on implementation of the Government’s Decree No. 11/2010/ND-CP dated February 24, 2010 stipulating management and protection of road infrastructure; construct more collector roads and parking lots in the industrial zones, complexes.
-Check and revise bus route planning, arrange bus stops appropriately in the industrial zones, complexes, especially industrial zones greater than 100 ha.
-In the implementation of the Prime Minister’s Decision No. 13/2015/QD-TTg dated May 05, 2015 on incentive mechanisms and policies for development of public bus transport, the central-affiliated provinces and cities shall issue incentive policies for development of bus routes to industrial zones, complexes.
-Reinforce dissemination of regulations, master plans, plans in relation to the tasks of traffic safety in industrial zones, complexes.
-Formulate and issue regulations on cooperation between traffic safety committees of central-affiliated provinces and cities and industrial zone authorities, provincial confederations of labor, the People’s committees of districts in the tasks of traffic safety in the industrial zones, complexes.
-Investors, developers and enterprises in the industrial zones, complexes shall arrange personnel to monitor and manage the tasks of ensuring traffic safety.
-Encourage enterprises, industrial zones to apply traffic safety management process according to ISO 39001;
-Add the traffic safety criteria to the annual enterprise evaluation criteria.
2.Traffic infrastructure and organization
Traffic infrastructure in the industrial zones, complexes should accord with regulations, standards on transport and traffic safety, and ensure synchronization with other infrastructure in the industrial zones, complexes.
Areas outside industrial zones, complexes:
-Prioritize elimination of blind spots and spots most likely to cause traffic accidents on the roads around industrial zones, complexes.
-Check and ensure connection of industrial zones, complexes to the national road according to the Minister of Transport’s Circular No. 50/2015/TT-BGTVT dated September 23, 2015.
-Check and improve traffic safety conditions at the connection point between industrial zones, complexes and national, provincial and district roads; prioritize installation of traffic lights, distribution of traffic lanes, painting of speed humps and arrangement of pedestrian paths.
-Prioritize investment and construction of bridges for pedestrians, bicycles and bikes crossing over national and provincial routes of high and complicated traffic flow around industrial zones, complexes.
-Invest and construct collector roads around industrial zones, complexes according to the master plan.
-Study distribution of traffic lanes and impose restrictions on passing of outside vehicles through the industrial zones at peak hours.
Areas inside industrial zones, complexes:
-Check and replace road traffic sign system in the industrial zones in operation and under construction in accordance with National technical regulation QCVN 41:2016/BGTVT on road symbol signs.
-Improve traffic safety conditions at intersections inside the industrial zones, complexes; prioritize installation of warning signs, addition of black and white stripes, and speed humps.
-Carry out innovations to ensure sight distance, curve radius at turning points, intersections inside industrial complexes.
-Construct parking lots inside the industrial zones, complexes.
-Arrange appropriate stops inside the industrial zones for vehicles to pick up and drop employees.
-For industrial zones with high traffic flow at peak hours (at the start or end of a shift work), study additional construction of gates; study construction of separate gates for cargo transport vehicles.
-Improve traffic safety conditions in the areas around the wharves on inland waterways, railroad crossings, roads and railroads inside the industrial zones, complexes.
3.Transport vehicles and transport activities
-Tighten control of vehicle weight at the industrial zones, complexes.
-Check and arrange bus routes with appropriate stops inside the industrial zones, complexes in case of need. Improve service quality and ensure compliance with operation hours of the industrial zones, complexes.
-Tighten management of vehicles; vehicles moving employees from home to work place and back (herein ‘employee buses’) should meet requirements for technical safety, environmental protection and conditions for transport business as prescribed.
-Encourage enterprises inside the industrial zones, complexes to contract in renting of vehicles for taking employees to their home countries during holidays, lunar new year events.
-The industrial zones, complexes should formulate and issue their own regulations on transport in the area in accordance with actual conditions of the industrial zones, complexes including internal traffic, transportation in and out of the industrial zones, complexes.
4.Traffic safety propaganda
Innovate and increase efficiency of dissemination and education about laws on traffic order and safety in the industrial zones, complexes as follows:
-Include dissemination and education about laws on traffic safety tonational, provincial traffic safety committees’ programs and other relevant programs.Attach great importance to dissemination of such issues as wearing helmets while riding bicycles, bikes; prohibitions on traveling in opposition to prescribed direction, carrying more than the number of people as stipulated, invasion of traffic safety corridors, organization of selling and buying activities on roadbeds, roadsides.
-Include dissemination and education about laws on traffic safety to the enterprises’ annual training programs for labor safety, fire prevention and combat.
-Include dissemination and education about laws on traffic safety to trade union’s meetings, meetings between workers and enterprise owners … in coordination with local traffic safety committees, confederations of labor.
-Formulate documents and guides to dissemination and education about laws on traffic safety in the industrial zones, complexes.
-Organize training to increase professional ethics and driving skills for drivers of the enterprises in the industrial zones, complexes.
-Formulate programs for cooperation between provincial, municipal traffic safety committees and industrial zone authorities, provincial confederations of labor and local authorities in the dissemination and education about laws on traffic safety annually.
5.Investigation and inspection
-Establish interdisciplinary inspectorates to carry out inspection, investigation, and supervision of the implementation of regulations, master plans and plans concerning the tasks of traffic safety in the industrial zones, complexes.
-Regularly carry out theme-based patrols and control in the industrial zones, complexes, especially in themes concerning wearing helmets, riding and driving speed, use of alcohol and beer, transport in excess of prescribed number of people, traveling in opposition to the prescribed direction, or in wrong lanes…
-Traffic police forces, traffic inspection units shall conduct regular patrols and controls and impose severe penalties on any employee bus that violates regulations on traffic safety and transport business conditions.
-Seek coordination with other forces including traffic police forces, police investigation units, police authorities… in distributing lanes and directing traffic at peak hours at the gates or in positions with complicated traffic in the industrial zones, complexes.
6.Human forces
-Provide training to enhance capacity in the tasks of ensuring traffic safety in industrial zones, complexes for personnel from industrial zone authorities, confederations of labor, enterprises in the industrial zones, complexes, and other relevant personnel.
-Provide training to the grassroots-level network of propagandists, autonomous work groups for the dissemination of the laws on traffic safety in the industrial zones, complexes.
7.Funds
-Maximize mobilization of all resources, especially funds from the investors for the industrial zones, complexes, financial contributions from the enterprises in the industrial zones, complexes for the implementation of the Project with priority given to innovation and upgrading of safety conditions of traffic infrastructure in the areas of industrial zones, complexes.
-Take advantage of domestic and foreign funds from multiple sectors and in different forms with great importance attached to financial contributions from non-governmental organizations, assistance funds from the countries the enterprises of which are operating in the industrial zones, complexes for the tasks of disseminating laws and training human forces.
Specific funds for the implementation of the Project as follows:
-Expenditures on amendments and supplements to legislative documents: annual administrative management funds from the Ministry of Transport and People’s Committees of provinces.
-Expenditures on checking and revising master plans for industrial zones, complexes, master plans for bus routes: funds from People’s committees of provinces.
-Expenditures on the implementation of measures aimed at improving traffic infrastructure and organizing traffic outside the industrial zones, complexes:
+ On a national road scale: Directorate for Roads of Vietnam’s annual budgets for road maintenance, traffic safety tasks and other sources;
+ On a provincial, district and urban scale: funds from People s committees of provinces, investors for industrial zones, complexes and enterprises.
-Expenditures on the implementation of measures aimed at improving traffic structure and organizing traffic in the areas of industrial zones, complexes: funds from investors for industrial zones, complexes and enterprises.
-Expenditures on dissemination and education about laws on traffic safety, human force training:
+ Funds from investors for the industrial zones, complexes and enterprises;
+ Funds fromNational Traffic Safety Committee;
+ The Ministry of Transport’s annual traffic safety funds;
+ Funds from provincial traffic safety committees.
IV.IMPLEMENTATION
1.The Department of Traffic Safety:
-Act as an advisor for ministerial leaders on the implementation of the Project; direct, inspect, supervise and speed up the implementation of the Project;
-Direct and propose cooperation and integration of traffic safety propagation activities in the areas of industrial zones, complexes into theNational Traffic Safety Committee and Ministry of Transport’sprograms and projects on traffic safety;
-Cooperate with traffic safety committees andthe Services of Transport of central-affiliated provinces, cities during the implementation of the Project;
-Report difficulties that arise during the implementation of the Project to the ministerial leaders for instructions.
2.The Department of Transport:Cooperate withthe Services of Transport in stepping up development of bus transport to the industrial zones, complexes.
3.Directorate for Roads of Vietnam:
-Cooperate with the Services of Transport ofcentral-affiliated provinces, cities in eliminating blind spots and spots likely to cause traffic accidents on the national road system around the industrial zones, complexes;
-Cooperate withthe Services of Transport of central-affiliated provinces and cities in improving traffic safety conditions at the connection points between the industrial zones, complexes and the national road;
-Cooperate with relevant organizations in constructing pedestrian bridges across national roads in the areas ofindustrial zones, complexes in case of need.
4.Provincial traffic safety committees:
-Preside over formulation and issuance of regulations on cooperation between traffic safety committees of provinces and industrial zone authorities, provincial confederations of labor, the People’s committees of districts in the tasks of traffic safety in the industrial zones, complexes.
-Direct integration of dissemination and education about laws on traffic safety into traffic safety committees’ programs;
-Preside over and cooperate with relevant organizations in organizing training to the grassroots-level network of propagandists, autonomous work groups for the dissemination of the laws on traffic safety in the areas of industrial zones, complexes.
5.The Services of Transport:
Act as an advisor for presidents of the People’s committees of provinces on the implementation of the Project in accordance with local circumstances with great importance being attached to following tasks:
-Prioritize elimination of blind spots and spots most likely to cause traffic accidents on provincial, urban roads around the industrial zones, complexes.
-Check and improve traffic safety conditions at the connection points between the industrial zones, complexes and provincial, district and urban roads;
-Construct pedestrian bridges across local roads in the areas of industrial zones, complexes in case of need.
-Revise bus planning in localities, step up development of bus transport to the industrial zones, complexes; arrange appropriate bus stops;
-Make proposals to the People’s committees of provinces for the establishment of interdisciplinary inspectorates for inspection, investigation, and supervision of the implementation of regulations, master plans and plans concerning the tasks of traffic safety in the industrial zones, complexes.
-Make proposals to the People’s committees of provinces for directing the People’s committees of districts to carry out contents of the Project with regard to industrial complexes in local administration division.
6.Industrial zone authorities:
Act as an advisor for presidents of the People’s committees of provinces on the implementation of the Project in accordance with local circumstances with great importance being attached to following tasks:
-Check and revise detailed master plans for industrial zones to suit transport master plan;
-Reinforce dissemination of regulations, master plans, plans in relation to the tasks of traffic safety;
-Request the investors, developers and enterprises in the industrial zones, complexes to arrange personnel to monitor and manage the tasks of ensuring traffic safety.
-Add the traffic safety criteria to the annual enterprise evaluation criteria.
-Check and replace road symbol signs in the industrial zones;
-Improve traffic safety conditions at intersections in the industrial zones; arrange parking lots, bus stops appropriately.
-Encourage enterprises in the industrial zones to contract in employee shuttling services;
-Encourage enterprises, industrial zones to apply traffic safety management process according to ISO 39001;
-Request industrial zones to formulate and issue their own regulations on transport in accordance with actual conditions of individual industrial zones;
-Include dissemination and education about laws on traffic safety to the enterprises’ annual training programs for labor safety, fire prevention and combat;
-Include dissemination and education of laws on traffic safety to trade union’s meetings, meetings between workers and enterprise owners;

Article 2.This Decision takes effect since the signing date.
Article 3.Chief of the Ministry Office, Chief Inspector of the Ministry, general directors of Directorate for Roads of Vietnam, ministerial-affiliated departments, the Transport Development & Strategy Institute, directors of the Services of Transport, heads of relevant organizations and individuals shall be responsible for executing this Decision./.
