DECISION
On promulgating the Plan to eliminate procedures and list of commodities need specialized examination (with HS code) under the management of the
Ministry of Industry and Trade in the period of 2019 with vision toward 2021
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/NĐ-CP on detailing a number of articles of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 on detailing, and providing measures to implement, the Customs Law regarding customs procedures and customs inspection, supervision and control;
Pursuant to the Resolution No. 02/NQ-CP dated January 01, 2019 of the Government on continuing implementation of major tasks and solutions for improving the business environment and the national competitiveness in 2019 and orientation towards 2021;
Pursuant to the Decision No. 1254/QD-TTg dated September 26, 2019 of the Prime Minister on approval the Action plan for promotion of National single-window system, ASEAN single-window system, reform of specialized inspections over imports and exports and trade facilitation for the period of 2018 - 2020;
Pursuant to the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance on promulgating the List of Vietnam’s posts and exports; At the proposal of the Director of the Science and Technology Department; DECIDES:
Article 1: To promulgate the Plan to eliminate procedures and list of commodities need specialized examination (with HS code) under the management of the Ministry of Industry and Trade at the Appendix attached to this Decision.
Article 2: Criteria for elimination of procedures and list of commodities need specialized examination under the management of the Ministry of Industry and Trade:
- Commodities are input materials or intermediary products, imported semi-finished products for food production establishments based on the assessment and analysis of risks to food safety.
- Commodities are products, equipment and machinery that have other management measures to ensure the purpose of state management and can replace the implementation of specialized examination in customs clearance procedures.
- Commodities are products, equipment and machinery without the national technical standards or technical regulations when conducting specialized examination in customs clearance procedures.
Article 3: Principals of elimination of procedures and list of commodities need specialized examination under the management of the Ministry of Industry and Trade:
- Complying with the consistency and synchronization of legal basis.
- Ensuring the efficiency and objectives of state management on the basis of assessing the role of specialized examination activities in the overall management measures of the state for production, circulation, business and Use of goods by businesses and consumers.
- Applying risk management principles to regularly review, evaluate and promptly adjust the list of goods subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade.
Article 4: Implementation
- Department of Science and Technology shall assume the prime responsibility and coordinate with the Industrial Safety and Environment Technical Department and the concerned agencies and units in organizing the implementation of the plan to eliminate procedures and the list of commodities (with HS code) of the specialized examination under the management of the Ministry of Industry and Trade in Appendix 1, Appendix 2 and Appendix 3 of this Decision, promptly instructing and answering obstacles and problems (if any).
- Department of Energy Saving and Sustainable Development shall preside over and coordinated with relevant agencies and units to implement the Plan to eliminate procedures and the list of commodities (with HS code) for specialized inspection on energy efficiency prescribed in sector I in Appendix 4 of this Decision, promptly instructing and answering obstacles and problems (if any).
- This Decision takes effect on the signing date.
Article 5: Chief of the Ministry Office; Directors of Departments: Science and
Technology, Sustainable Energy Saving and Development, Director of Industrial
Safety and Environmental Technology Department, Heads of units under the Ministry of Industry and Trade and related organizations and individuals are responsible to implement this Decision.
