DECISION

Promulgating the price list of newly built houses, works and architectural structures in Ho Chi Minh City

HO CHI MINH CITY PEOPLE’S COMMITTEE

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015;

Pursuant to the Government’s Decree No. 99/2015/ND-CP dated October 20, 2015, detailing and guiding the implementation of a number of articles of the Housing Law;

Pursuant to the Government’s Decree No. 140/2016/ND-CP dated October 10, 2016, on registration fee and the Government’s Decree No. 20/2019/ND-CP dated February 21, 2019, amending and supplementing a number of articles of the Government’s Decree No. 140/2016/ND-CP dated October 10, 2016, on registration fee;

Pursuant to the Ministry of Finance’s Circular No. 301/2016/TT-BTC dated November 15, 2016, guiding registration fee;

At the proposals of the Department of Construction in Report No. 5296/TTr-SXD-KTXD dated May 8, 2019; Official Dispatch No. 8137/SXD-KTXD dated July 4, 2019; Report No. 9279/TTr-SXD-KTXD dated July 29, 2019, promulgating the price list of newly built houses, works and architectural structures in Ho Chi Minh City; appraisal opinions of the Department of Justice in Official Dispatch No. 1794/STP-VB dated April 4, 2019 and Official Dispatch No. 3564/STP-VB dated June 24, 2019.

DECIDES:

Article 1. To promulgate together with this Decision the price list of newly built houses, works and architectural structures for the purposes of:

1. Calculating registration fee;

2. Calculating the standard prices for newly-built houses in order to sell old houses under the ownership of the State according to regulations.

Article 2. Construction value of houses, works and architectural structures not included in the price list of newly built houses, works and architectural structures in Ho Chi Minh City issued together with this Decision shall comply with the construction investment capital ratios and general construction prices of structural parts of the works announced by the Ministry of Construction.

Article 3. Pursuant to the Central regulations on construction prices in urban cities and price fluctuations on the market, the Department of Construction is assigned to assume the prime responsibility for, and coordinate with relevant agencies in, studying, formulating and advising Ho Chi Minh City People’s Committee to appropriately modify the price list.

The Department of Construction is assigned to provide instructions for arising cases that have not yet been included in the price list attached to this Decision.

Article 4. This Decision takes effect from September 10, 2019. This Decision replaces Decision No. 66/2012/QD-UBND dated December 28, 2012, of Ho Chi Minh City People’s Committee, promulgating the standard construction investment capital ratios in Ho Chi Minh City.

Article 5. Chief of Office of the City People’s Committee, Directors of Departments and Branches, Chairpersons of People’s Committees of districts, rural districts, wards, communes, and townships, heads of relevant agencies, units, organizations, households and individuals shall implement this Decision./.
