Decision No. 20/2014/QD-UBND dated May 23, 2014 of the People's Committee of Dong Nai province on issuing the price of tap water in Dong Nai province

DECISION

ON ISSUING THE PRICE OF TAP WATER IN DONG NAI PROVINCE

THE PEOPLE’S COMMITTEE OF DONG NAI PROVINCE

Pursuant to the Law on Organization of the People’s Councils and the People’s Committees dated November 26, 2003;

Pursuant to the Law on Price approved by the National Assembly on June 20, 2012;

Pursuant to the Decree No. 117/2007/ND-CP dated July 11, 2007 of the Government on clean water production, supply and consumption

Pursuant to the Decree No. 89/2013/ND-CP of August 6, 2013, detailing a number of articles of the Price Law regarding valuation;

Pursuant to the Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding a number of articles of the Law on Price;

Pursuant to the Circular No. 01/2009/TT-BXD dated February 02, 2008 of the Ministry of Construction guiding the implementation a number contents of the Decree No. 117/2007/ND-CP dated July 11, 2007 of the Government on clean water production, supply and consumption;

Pursuant to the Joint Circular No. 75/2012/TTLT-BTC-BXD-BNNPTNT dated May 15, 2012 of the Ministry of Finance, the Ministry of Construction and the Ministry of Agriculture and Rural Development guiding principles and method of determination and competence to decide water consumption price in the urban areas, industrial zones and rural areas;

Pursuant to the Circular No. 88/2012/TT-BTC dated May 28, 2012 of the Ministry of Finance on promulgating the price bracket of clean water;

At the proposal of the Director of Dong Nai Water Supply One-Member Limited Liability Company at the Document No. 569/CN dated April 17, 2014,

DECIDES:

Article 1. To issue the price of tap water supply in Dong Nai as follows:

The above price is excluded VAT and environmental protection fee for domestic waste.

Article 2. Objectives of water usage

1. Household’s domestic water (domestic water in house)

a) Households shall use tap water for living basing on each household and water clocks having contract for using water with the water suppliers.

b) Objectives accepted by the water suppliers in using salve clocks via master clocks shall be eligible for being a slave household.

c) Labors, pupils, students who are all living in the rented rooms or houses must have valid ID or other personal papers and contracts for renting house with the main household within 12 months and above. Each person shall receive ¼ standards of the main household and the price shall be calculated in accordance with the relevant progressive level.

2. Administrative agencies, public service providersand other agencies

a) Armed forces and public security units.

b) Hospitals and schools.

c) Religious agencies, organizations and establishments.

d) Administrative agencies and other public service providers.

3. Manufacturing units

a) Industrial parks and export processing zones.

b) Manufacturing, producing and machining establishments.

c) Animal husbandry, waste treatment facilities and incinerator.

d) Water supplier for construction works.

dd) Power plans.

4. Business and service provides

a) Hotels, restaurants, guess houses and catering business.

b) Beauty treatment facilities, laundry and entertainment facilities.

c) Markets, supermarkets, whole sellers and commercial stores.

d) Water supplier for boat and ship, tank truck, vehicle washing service.

dd) Service and business providers: electric power, post office, telecommunication, banking service provider.

e)  The manufacturer and provider of ice, liquid, ice-cream, beverage.

5. Other subjects

Exclude from 04 above subjects, Dong Nai Water Supply One Member Limited Liability Company shall be allowed to apply water price on the basis of the agreement with the customer which is investment project subject.

Article 3.This Decision takes effect 10 days after the signing date and replaces the Decision No. 39/2011/QD-UBND dated June 20, 2011 of the People’s Committee of Dong Nai Province on regulating the tap water price in Dong Nai Province.

Article 4.The Chef Office of Dong Nai Province and the Director of the following department: Financial Department, Construction Department, Agriculture and Rural Development Department, the Chairpersons of Long Khanh Town, Bien Hoa City, the General Director of Industrial Park Development Group, the Director of Dong Nai Water Supply One Member Limited Liability Company and relevant organization and individuals shall take responsibility to implement this Decision.
