DECISION
On the connection and sharing of information between the National Population Database and national databases and specialized databases[1]
THE PRIME MINISTER
Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;
Pursuant to the November 20, 2014 Law on Citizen Identification;
Pursuant to the November 19, 2015 Law on Cyberinformation Security;
Pursuant to the June 12, 2018 Law on Cyber Security;
Pursuant to the Government’s Decree No. 137/2015/ND-CP of December 31, 2015, detailing a number of articles of, and providing measures to implement, the Law on Citizen Identification;
Pursuant to the Government’s Decree No. 37/2021/ND-CP of March 29, 2021, amending and supplementing a number of articles of the Government’s Decree No. 137/2015/ND-CP of December 31, 2015, detailing a number of articles of, and providing measures to implement, the Law on Citizen Identification;
Pursuant to the Government’s Decree No. 47/2020/ND-CP of April 9, 2020, prescribing the management, connection and sharing of digital data of state agencies;
Pursuant to the Government’s Resolution No. 17/NQ-CP of March 7, 2019, on a number of major tasks and solutions to develop e-government in the 2019-2020 period, with orientations toward 2025;
At the proposal of the Minister of Public Security,
DECIDES:
Article 1. General principles of connection of information between the National Population Database and national databases and specialized databases
1. Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees that are managing national databases and specialized databases (below referred to as other databases), when acquiring one of the citizen information items belonging to the National Population Database, must satisfy the conditions specified in Clause 2, Article 7 of the Government’s Decree No. 137/2015/ND-CP of December 31, 2015, detailing a number of articles of, and providing measures to implement, the Law on Citizen Identification (below referred to as Decree No. 137/2015/ND-CP), and connect such information with the National Population Database.
2. The connection and sharing of citizen information among databases must ensure confidentiality, security, and cyberinformation security in accordance with law.
3. The use of citizen information on the National Population Database must comply with Article 11 of Decree No. 137/2015/ND-CP, and the Government’s Decree No. 37/2021/ND-CP of March 29, 2021, amending and supplementing a number of articles of Decree No. 137/2015/ND-CP.
Article 2. Sharing of citizen information among databases
1. The National Population Database shall share citizen information with national databases, specialized databases, the National Public Service Portal, ministerial- and provincial-level public service portals, and electronic single-window information systems of ministries, ministerial-level agencies, government-attached agencies, and People’s Committees of provinces and centrally run cities serving the performance of management work according to their assigned functions, tasks and powers.
2. The Electronic Civil Status Database, Database on Residence, Database on Citizen Identification, Medical Database, and other specialized databases shall provide citizen information to the National Population Database in accordance with law to ensure the consistency, completeness, accuracy and timeliness of information.
3. Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees shall share citizen data and information in the fields under their management for performance of administrative procedures and state management work according to their assigned functions, tasks and powers.
4. The connection and sharing of citizen information in cases other than those specified in Clauses 1, 2 and 3 of this Article must comply with the Prime Minister’s direction.
Article 3. Responsibilities of ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees
1. The Ministry of Public Security shall:
a/ Assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees in, conducting the connection and sharing of information between the National Population Database and other databases.
b/ Assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees in, evaluating and examining security vulnerabilities to ensure information security and safety when conducting the connection and sharing of information between the National Population Database and other databases.
c/ Manage and operate the National Population Database in a manner that satisfies technical requirements for the connection, sharing, exploitation, use and storage of citizen data and information serving the performance of administrative procedures, state management work and socio-economic development.
d/ Coordinate with political organizations, socio-political organizations, the Supreme People’s Court, the Supreme People’s Procuracy, and other state agencies in conducting the connection and sharing of information with the National Population Database.
dd/ Report to the Prime Minister, on a biannual and annual basis, the results of connection and sharing of information between the National Population Database and other databases.
2. The Ministry of Information and Communications shall:
a/ Ensure that the technical infrastructures and transmission lines for connection, management, maintenance, operation, and development of the National Data Integration and Sharing Platform operate stably, meeting the requirements for connection and sharing of data between the National Population Database and other databases and information systems of state agencies, political organizations, and socio-political organizations serving the development of e-government toward digital government and promoting digital transformation in Vietnam.
b/ Guide and urge ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees to complete their databases up to technical standards and connection and sharing requirements.
3. The Government Office shall:
a/ Maintain and operate the National E-Document Exchange Platform, meeting the requirements for data connection and sharing among ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees, serving the performance of administrative procedures on the National Public Service Portal, and ministerial- and provincial-level public service portals and electronic single-window information systems.
b/ Guide ministries, sectors and localities to standardize forms of requests and declarations used in performance of administrative procedures on the National Database on Administrative Procedures, that contain information and data fields exploitable and shareable from the National Population Database.
c/ Assume the prime responsibility for, and coordinate with the Ministry of Public Security, Ministry of Justice, Vietnam Social Security, and related agencies and units in, restructuring their professional processes of, and integrating and providing on the National Public Service Portal, 2 groups of transferable administrative procedures: birth registration - permanent residence registration - grant of health insurance cards for under-6 children; and death registration - permanent residence deregistration - provision of burial allowances, and other related administrative procedures.
4. Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees shall:
a/ Expeditiously complete databases under their management as assigned for connecting them with the National Population Database.
b/ Coordinate with the Ministry of Public Security and related units in reaching agreement on a plan on connection and sharing of data with the National Population Database, ensuring information continuity, confidentiality and safety.
c/ Periodically and regularly coordinate with the Ministry of Public Security in evaluating and examining confidential vulnerabilities of their systems, ensuring information security and safety when connecting with the National Population Database.
d/ Build, develop, maintain, and operate platforms for data integration and sharing with other databases.
dd/ Report to the Prime Minister, on a biannual and annual basis, the results of connection and sharing of information with the National Population Database.
Article 4. This Decision takes effect on the date of its signing.
Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
