DECISION
CONTROLLING THE IMPORT OF SUGAR IN 2006
THE MINISTER OF TRADE
Pursuant to the Government's Decree 29/2004/ND-CP of January 16, 2004, defining the functions, tasks, powers and organizational structure of the Ministry of Trade;
Pursuant to the Prime Minister's instructions in Document No. 17/TTg-KTTH of April 13, 2006, on the import of sugar in 2006;
After consulting the Ministry of Agriculture and Rural Development, the Ministry of Industry and relevant ministries and branches;
At the proposal of the director of the Import and Export Department,
DECIDES:
Article 1.- The import of sugar of all kinds under Heading No. 1701 of the current Preferential Import Tariffs to meet domestic production and consumption demands in 2006 shall be implemented according to the Trade Ministry's permits.
Article 2.- On the basis of the aggregate sugar quantity to be imported in 2006 as announced by the Ministry of Agriculture and Rural Development, the Ministry of Trade shall grant import permits for sugar under the following regulations:
1. Allocating 30% of the sugar quantity to be imported to sugar mills importing coarse sugar for sugar production; the quantity and schedule shall be announced by the Ministry of Agriculture and Rural Development after consulting the Vietnam Sugar Association.
2. Allocating 30% of the sugar quantity to be imported to enterprises importing sugar for use as production material; the quantity and schedule shall be announced by the Ministry of Industry.
3. Allocating 30% of the sugar quantity to be imported to trading enterprises. The Ministry of Trade shall grant import permits for sugar to seven key enterprises at the proposal of the following municipal People's Committees and ministries:
- Hanoi: 01 enterprise
- Ho Chi Minh City: 02 enterprises
- Hai Phong City: 01 enterprise
- Da Nang City: 01 enterprise
- The Ministry of Agriculture and Rural
Development: 01 enterprise
- The Ministry of Trade: 01 enterprise.
4. The remaining 10% of the sugar quantity to be imported shall be used as reserve for market intervention when necessary.
Article 3.- The import of sugar of all kinds under Heading No. 1701 of the current Preferential Import Tariffs to serve export production and the performance of export processing contracts for foreign partners shall not require the Trade Ministry's permits. The procedures for import and tax payment shall be carried out at customs offices under current regulations.
Article 4.- This Decision takes effect 15 days after its publication in "CONG BAO."
