Decision No. 1661/QD-BTC dated July 15, 2013 of the Ministry of Finance issuing the minimum price level or load and unload container services at Cai Mep – Thi Vai deep water port, Ba Ria – Vung Tau province
Pursuant to the Law No. 11/2012/QH13 on Price dated June 20, 2012;
Pursuant to the Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
In furtherance of directions of the National Assembly Standing Committee at the official dispatch No. 389/UBTVQH13-TCNS dated March 20, 2013 allowing pilot implementation of price stabilization for the services of loading and unloading containers at area of Cai Mep – Thi Vai deep-water port, Ba Ria – Vung Tau province by measure of determining minimum price in period till the end of June 30, 2015;
On the basis of suggestions of the Ministry of Transport at the Official Dispatch No. 6145/BGTVT-VT dated June 27, 2013 on the minimum price of service of loading and unloading containers at area of Cai Mep – Thi Vai deep-water port, the Corporation of Sai Gon New Port at official dispatch No. 999/TC-KHKD dated July 03, 2013, on formulating the floor price level for service of loading and unloading containers at area of Cai Mep – Thi Vai port;
At the proposal of the Director of Price Management Department,
DECIDES:
Article 1.To promulgate the minimum level of price of service of loading and unloading containers at area of Cai Mep – Thi Vai deep-water port, Ba Ria – Vung Tau province as follows:
1. The minimum price level for service of loading and unloading export and import containers (not applicable to transshipment containers):

For containers with cold goods, dangerous goods, overload, oversize goods and goods with strange size: unit price will be agreed by enterprise of Port and customers but not lower than the minimum price specified in clause 1 Article 1 of this Decision.
2. Based on market changes, the minimum price prescribed by the Ministry of Finance at Clause 1 Article 1 above, enterprises doing business in exploiting the deep-water seaport at Cai Mep – Thi Vai area, Ba Ria – Vung Tau province self-decide the specific price level but not lower than the minimum price prescribed by the Ministry of Finance; have report in writing about specific prices of enterprises to Maritime Port Authorities, the provincial Department of Finance, Taxation Department of Ba Ria – Vung Tau province; concurrently send a copy to the Ministry of Transport (Vietnam Maritime Administration) and the Ministry of Finance (the Price Management Department).
Article 2.The minimum price levels as prescribed in Article 1 included VAT.
Article 3.This Decision takes effect on August 01, 2013 to August 30, 2015. The handling of transitional stage from the effective day of the Decision on minimum prices shall be handled as follows:
- Service of loading and unloading containers which supply for ships having docked before the effective date of minimum prices shall comply with the prices agreed by parties in contracts.
- Service of loading and unloading containers which supply for ships docked after the effective date of minimum prices shall comply with the minimum prices as prescribed by State.
Article 4.Implementation organization
1. After implementing regulation on minimum prices at this Decision for 6 months, the Ministry of Transport shall direct specialized agencies, enterprises doing business in exploiting seaport to report implementation of the minimum price prescribed in Clause 1 Article 1 of this Decision to be conformable with actual conditions at area of Cai Mep – Thi Vai deep-water port.
2. The Ministry of Transport shall direct specialized agencies, enterprises doing business in exploiting seaport to organize implementation of the minimum price as prescribed by State; direct Maritime Port Authorities to coordinate with local financial and taxation agencies in examining implementation of the minimum price, strictly handling acts breaching law on price control.
