DECISION

PUBLICIZING THE CONNECTION FEE, COMMUNICATIONS CHARGES, AND THE METHOD OF CALCULATION OF CHARGES FOR GSM MOBILE PHONE SERVICES PROVIDED BY THE VIETNAM POST AND TELECOMMUNICATIONS GROUP

THE MINISTER OF POST AND TELEMATICS

Pursuant to the Government's Decree No. 90/2002/ ND-CP of November 11, 2002, defining the functions, tasks, powers and organizational structure of the Ministry of Post and Telematics;

Pursuant to the Prime Minister's Decision No. 217/ 2003/QD-TTg of October 27, 2003, on the management of post and telecommunications service charges;

Considering the proposal of the Vietnam Post and Telecommunications Corporation (now the Vietnam Post and Telecommunications Group) in Official Letter No. 1819/GCTTofApril6, 2006, on the adjustment of charges for GSM mobile phone services and CDMA telephone services provided by VNPT;

At the proposal of the director of the Planning-Finance Department,

DECIDES:

Article 1.- To publicize the connection fee, communications charges, and the method of calculation of charges for GSM mobile phone services provided by the Vietnam Post and Telecommuni­cations Group (VNPT) as follows:

1. Connection fee for post-paid GSM mobile phone services:

- The maximum fee level: VND 181,818/phone-connection;

- The minimum fee level: VND 127,272/phone-connection.

2. Communications charges:

2.1. For postpaid GSM mobile phone services:

- The maximum charge level: VND 1,554/minute;

- The minimum charge level: VND 1,227/minute.

2.2. For prepaid GSM mobile phone services:

- The maximum charge level: VND 2,727/minute;

- The minimum charge level: VND 2,000/minute.

2.3. For prepaid daily-subscription GSM mobile phone services:

- The maximum charge level: VND 1,909/minute;

- The minimum charge level: VND 1,382/minute.

3. Charge calculation method: GSM mobile phone service charges shall be calculated according to the first charge calculation unit and subsequent charge calculation units, provided that the first charge calculation unit shall not be smaller than 6-second block and the subsequent charge calculation unit shall not be smaller than 1-second block.

Article 2.- Charge levels defined in Article 1 of this Decision are exclusive of value added tax.

Article 3.- The Vietnam Post and Telecommuni­cations Group shall:

1. Base itself on the provisions of Article 1 and Article 2 of this Decision, publicize specific connection fees, communications charges, and the method of calculation of GSM mobile phone service charges. When publicizing decisions on specific charge rates according its competence, the Group shall notify the Ministry of Post and Telematics thereof at least 10 days before such decisions take effect.

2. Provide for the reduction of GSM mobile phone service charges on holidays and Sundays, and from 23:00 hrs of the previous day to 07:00 hrs of the following day from Monday thru Saturday, provided that the reduction level shall not exceed 30% of the charge level specified in Article 1 for each service.

Article 4.- The provisions of this Decision shall apply to users of GSM mobile phone services provided by the Vietnam Post and Telecommunications Group.

Article 5.-This Decision takes effect 15 days after its publication in "CONG BAO." All other regulations contrary to this Decision are hereby annulled.

Article 6.- The director of the Office, the director of the Planning-Finance Department and heads of concerned units under the Ministry of Post and Telematics, and the general director of Vietnam Post and Telecommunications Group shall have to implement this Decision.
