THE PRIME MINISTER
Decision No. 1563/QD-TTg dated August 08, 2016 of the Prime Minister approving the master plan for e-commerce development in 2016 – 2020 period
Pursuant to the Law on Government organization dated June 19, 2015;
Pursuant to the Law on Electronic transaction dated November 29, 2005;
Pursuant to the Law on Information technology dated June 29, 2006;
Pursuant to the Law on Commerce dated June 14, 2005;
Pursuant to the Decree No. 52/2013/ND-CP dated May 16, 2013 by the Government on electronic commerce;
At the proposal of the Minister of Industry and Trade,
DECIDES:
Article 1.To approve the master plan for electronic commerce development in 2016 - 2020 period containing the following contents:
I. VIEWPOINTS
1. Electronic commerce (hereinafter referred to as e-commerce) is an important infrastructural factor of commerce sector and of information society; is a mean helping Vietnamese enterprises to enhance domestic market development and develop the export and import, participating in the global supply chain, increasing national competitiveness in international integration; contributing in the enhancement of industrialization and modernization of Vietnam.
2. E-commerce is a domain with a high content of technology application with rapid development. Enterprises are the key forces in the implementation and the state is in charge of managing and facilitating the development of e-commerce. Management policies are established depending on the reality to facilitate the enterprises and protect the rights of the consumers applying e-commerce.
II.DEVELOPMENT GOALS AND OBJECTIVES
Targets to be reached by 2020:
1. Regarding infrastructure for e-commerce
a) The legal infrastructure for e-commerce by a legislative document system which can be comprehensively adjusted is completed for keeping with the actual development of various e-commerce models and activities in the society;
b) A national e-commerce payment system and e-payment integrated applications is built up and developed to be utilized widely for e-commerce models, especially Business to Customer (B2C), Business to Business (B2B), Government to Customer (G2C) and Government to Business (G2B) E-commerce models;
c) A service network is developed, covering the transport, delivery and fulfillment of orders of e-commerce in all the provinces and cities in Vietnam, gradually extending into the regional area to enhance cross-border e-commerce activities;
d) A safe and secured infrastructure is developed through the establishment of an e-commerce transaction management and supervision system, e-commerce website rating and e-vouchers authentication and settlement of disputes and violations pertaining to e-commerce;
dd) E-commerce human resources are provided with train, answering to the demand of different enterprises and organizations.
2. Regarding e-commerce market size
a) 30% of the population make online purchase with the total value of 350 USD/person/year on average;
b) B2C e-commerce sales increase by 20% per year, equivalent to USD 10 billiion, accounted for 5% of the total retail sales of goods and the consumption turnover of the whole country;
c) Cross-border e-commerce grows rapidly, practically serving the import and export. B2B e-commerce transaction is accounted for 30% of the turnover of import-export by 2020.
3. Regarding the application of e-commerce services in enterprises
a) 50% of enterprises have their own web portals where their products are introduced and sold;
b) 80% of enterprises make or carry out orders via e-commercie applications;
c) 100% of super markets, shopping malls and modern distributioon establishments accept the payment via Point of Sale (POS) system and allow consumers to make non-cash payment when buying products;
d) 70% of electricity, water, telecommunications and communications service providers accept the payment of bill via non-cash payment services;
dd) 50% of individuals/households in big cities use non-cash payment media in daily consumption;
e) A number of large e-commerce traders which are reputable in the Southeast Asia are established;
4. Regarding the application of e-commerce services in regulatory agencies
a) 100% of public services of Ministries and regulatory bodies have been provided online at level 3 by 2016;
b) 50% of public services related to import and export activities will have been provided online at level 4 by 2020;
b) 30% of public services related to commerce and manufacture activities will have been provided online at level 4 by 2020;
d) 100% of information in the selection of contractors and the conduct of contracts is published on National online procurement network system, 50% of public procurement is conducted online via the National online procurement network system;
dd) All of administrative procedures under the national single-window system are conducted in form of online public service at level 4; the national single-window system is extended for all the Ministries and regulatory bodies regarding the scale and the subjects;
e) The ASEAN single-window system is fully connected and ready for exchanging information with commercial partners other than ASEAN, facilitating the sale of Vietnam s exported goods and enhancing the control of imported goods.
III.CONTENTS
1. Complete policies and legal regulations on e-commerce
Review, supplement, modify and promulgate new policies and legislative documents, facilitating the development of e-commerce, keeping up with the development of technologies in such sector. To be specific:
a) Promulate legislative documents to promptly adjust e-commerce models on the basis of new technologies like mobile e-commerce, interactive TV e-commerce;
b) Complete legislative documents pertaining to the management of the business involving electronic commerce where modern management models are offered for managing effectively the business under online environment;
c) Complete the system of legislative documents related to the settlement of disputes and handling of violations in e-commerce;
d) Modify legal regulations obstructing the application of electronic commerce according to regulations on promotion, advertisement and online sale;
dd) Issue policies and measures to encourage the enterprises to use electronic invoices when selling products;
e) Issue documents specifying payment methods and services serving the e-commerce;
g) Issue policies and measures to encourage the enterprises to develop and apply e-payment applications to support the buyers; encourage consumers to use non-cash payment services.
2. Increase capability of managing and conducting e-commerce activities
a) Build up and strengthen the machinery of state management pertaining to e-commerce in local areas;
b) Establish and develop officers specialized in e-commerce in local areas serving the state management of e-commerce;
c) Develop the capability of persons in charge of enforcing legal regulations pertaining to e-commerce (inspectors, market management officers, procurators, courts’s employees) in local areas through the regular provision of training in knowledge and skills in e-commerce; equipment of modern media to support the monitoring, supervision and settlement of displutes, handling of violations against regulations on e-commerce on the internet;
d) Widen and strengthen the capability of the e-commerce management web portal www.online.gov.vn which shall be considered as the essence of the mechanism for monitoring and executing the state management in electronic commerce;
dd) Establish a mechanism/machinery to promptly settle disputes and issues arising during e-commerce activities; encourage the participation of social organizations and non-governmental organizations in the establishment of dispute settlement mechanism (online or offline) for e-commerce;
e) Enhance the statistic activities pertaining to e-commerce, make such activities regular tasks of functional agencies, practically serving the management and development of policies on e-commerce;
g) Enhance the online provision of public services related to the business, strengthen the applicaitoon of information technology in public administrative procedures.
3. Develop e-commerce infrastructure
Invest in the construction and completion of essential infrastructure for e-commerce, including:
a) National e-commerce payment system. Security payment infrastructural development shall be focused to support the online payment for public administrative services;
b) Infrastructure for smart card in e-commerce card;
c) Online management system for the completion of orders and transport of goods serving e-commerce;
d) Infrastructure for authentication and serurity transaction for e-commerce;
dd) Standard system for exchange of messages and data in e-commerce;
e) System for securing the trust, protecting benefits of consumers using online sale services and settling disputes over online sale;
g) Infrastructure for digital voucher in commercial activities.
4. Develop human resources for e-commerce activities
a) Establish training programs for administrative officers and professional programs for officers in charge of e-commerce;
b) Carry out short-term advanced training programs specialized in e-commerce for employees of enterprises according to the conditions of local agreas and the business sectors;
c) Enhance the propagation and dissemination to raise the community’s awareness of e-commerce through the communications by newspapers, online newspapers, broadcasts, publications, social network and other media;
d) Enhance full-time education in e-commerce, combining education activities with practical business of the enterprise;
dd) Enhance the application and online education of e-commerce, encourage universities, colleges, enterprises and socio-professional organizations to cooperate in developing online education systems and school material supply systems serving the research, education and study about e-commerce.
5. Develop and apply new technologies in e-commerce
a) Encourage and assist the research and application of new technologies in e-commerce;
b) Encourage the development of mobile e-commerce and the development of digital information in e-commerce;
c) Develop products and measures to assist enterprise to apply e-commerce on each stage of business process;
d) Develop intergrated services depending on modern technologies like smart-card, global positioning system (GPS), object/bar-code detection technology;
dd) Encourage enterprises/individuals to start up in a new e-commerce model, applying advanced technologies;
e) Encourage the technology research and transfer to ensure the safety and security for e-commerce activities; establish systems for monitoring, authenticating and securing e-commerce transactions.
6. Develop e-commerce in key areas and sectors
a) Support the development of e-commerce of key economic areas, routes and corridors to enhance the capability to distribute and sell goods so as to raise the competitive capability of the enterprise, improving the trading and consuming habits of local areas;
b) Concentrate on enhancing the application of e-commerce to key exported product manufacture to increase the capability to approach to the market, widening the exporting scale;
c) Build up projects and support the enhancement of application of e-commerce in main manufacture and services to form the basis for extending the application of e-commerce to other sectors.
7. International cooperation
a) Intiatively participate in activities of cooepration in e-commerce at international and regional commercial organizations and multilateral and bilateral cooperation organizaitons;
b) Establish the mechanism of bilateral cooperation in e-commerce with a number of big commercial partners in regional area to promote the investment and trade in e-commerce with key market;
c) Conduct researches and propose plans on accession to international treaties and multilateral cooperation in e-commerce;
d) Cooperate with other countries to promote cross-border e-commerce activities and paperless trade.
IV.FUNDING FOR IMPLEMENTATION
1. Funding for the implementation of the master plan shall be provided by the State budget, business investment, loans from credit institutions, international funds and other lawful funds according to laws.
2. Funding from the State budget shall be provided according to the decentralization of government budget as follows:
a) Funds for projects and tasks which constitute expenditure items of ministries, ministerial-level agencies and Governmental agencies shall be allocated by the central budget and incorporated in annual budget expenditure estimates of these ministries and agencies;
b) Funds for projects and tasks which constitute expenditure items of People s Committees of provinces shall be allocated by local budgets and incorporated in annual local budget estimates.
Article 2.Organization of implementation
1. The master plan on e-commerce development shall be implemented in line and in compliance with strategies, master plans and plans on development of the industry and trade sector and other economic sectors, especially the export, distribution and other services; strategies, master plans, plans, schemes and programs on development and application of information and communications technologies: programs on administrative reform and application of information technology to the operations of state agencies.
2. The Ministry of Industry and Trade shall preside over and cooperate with ministries, ministerial-level agencies, Governmental agencies, People’s Committees of provinces in implementing this Decision. Annually send the reports of implementation and proposal of measures and cases beyond their competence to the Prime Minister; make a report on the implementation when the master plan finishes.
3. Based on such master plan, ministries, ministerial-level agencies, governmental agencies and provincial-level People s Committees shall:
a) Elaborate, appraise, approve and allocate budget estimates according to current regulations on power decentralization for implementation of their own e-commerce development plans as specified in the APPENDIX enclosed herewith;
b) Pursuant to the fact of application of e-commerce in local areas, People’s Committees of provinces shall build up Plans on development of e-commerce in 2016 - 2020 period in their own local areas, approve and allocate budget for the implementation of such plans;
c) Inspect, assess and report on an annual or irregular basis on the implementation of this master plan under the guidance and requirements of the Ministry of Industry and Trade for summarization and reporting to the Prime Minister.
Article 3.This Decisiontakes effect on the signing date.
Article 4.Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, Presidents of People’s Committees of provinces shall be responsible for implementing this Decision./.
